Yerington City Council Meeting September 26, 2022 at 10:00 a.m. – City Hall The regular meeting of the Yerington City Council was held in the Council Chambers at 10:00 a.m. with the following present: Mayor John J. Garry Council Members Jerry Bryant, Matthew Galvin and Frank Pizzo City Manager Robert Switzer Chief of Police Darren Wagner Public Works Director Jay Flakus Building Inspector Joel Brown Absent: City Attorney Chuck Zumpft City Clerk Sheema D. Shaw Grants Administrator Angela Moore Guests: David Ray Earl and Barbara Freet Brian Butcher Laura Butcher Mathew Gutner Chantae Lessard Gary Hardesty The meeting was called to order within the James Sanford Community Center and roll call was reported by Mayor Garry. The Pledge of Allegiance was led by Mayor Garry. Public Participation Mayor Garry asked for comments. David Ray stated that he has resigned from the Mason Valley Citizen Advisory Board and wanted to thank Helping Hands for Seniors for their efforts in the community as they will be closing their doors at the end of this month due to lack of funds. Agenda Approval Mayor Garry stated the agenda would be approved as presented unless there were any objections or corrections. City Manager Switzer stated no corrections needed to be made on the agenda. Mayor Garry stated the agenda was approved as presented and the motion was approved unanimously. Minutes Mayor Garry stated the minutes from the prior meeting dated September 12, 2022 would be approved unless there were any objections or corrections. Jack McCormick dba Ameriscape Landscaping, Landscaping, 4250 Park Place, Winnemucca, NV 89445 – NEW Mayor Garry stated the business license applications would be approved as presented unless there were any objections or corrections. Mayor Garry stated no objections were made at this time and the business license applications were approved unanimously. Revoke Business Licenses Due to Non-Payment for the 2ND Quarter April – June 2022 A. Dianna Summers dba Mason Valley News, Inc., 13095 Publishers Drive, Fishers, IN., 46038 B. Reldon Hatch dba Rel’s Racing, 705 West Bridge Street, Yerington, NV 89447 C. Holly dba Sysco Sacramento, Inc., 251 Little Falls Drive, Wilmington, DE 79808 D. Carson Tahoe Physician Clinics dba Carson Tahoe Medical Group, PO Box 2168, Carson City, NV 89702 E. Janice Erickson dba Bella LeCrow, 222 Valley Drive, Yerington, NV 89447 F. Lynn White dba CC’s Salon, 105 N. Main Street, Yerington, NV 89447 G. Scott Gray dba Stewart Title Corporation, 360 Post Oak Blvd., Suite 100 MC 15-5, Houston, TX 77056 Mayor Garry stated the revocation of business licenses due to non-payment for the second quarter, April through June 2022, would be approved unless there were any objections or corrections. City Manager Robert Switzer stated items and have made a recommendation to remove these from the revocation list. Mayor Garry stated if there were no other objections were made and the motion to revoke the business licenses due to non-payment for second quarter, April through June 2022, with the removal of Rel’s Racing SYSCO Sacramento Inc. and Bella LeCrow has been approved unanimously. Review Bills Previously Submitted for Payment Bills, Salaries and Vouchers: Accounts Payable Checks 09/12/2022 35834 through 35885 ---PAGE BREAK--- Mayor Garry stated the bills previously submitted for payment, checks 35884 through 35885 totaling $ 1,474,512.16, would be approved unless there were any objections or corrections. Mayor Garry stated no comments were made at this time and the bills previously submitted for payment were approved unanimously. Designation of Hill as on Official Highway Vehicle (OHV) Recreation Facility Boundaries were discussed for the OHV and it was mentioned that designating this area does not financially obligate the city for any funding and would not be an economical burden to the city. It will in fact, open up possibilities for different funding opportunities, through federal and state programs, in the future for which the city may apply that could include fencing to decrease noise and/or vandalism and could increase possibilities of allowing educational and/or training classes for safety, mentorships, education on current laws, etc. There are wide variety and number of opportunities available. Councilman Bryant motioned to approve the designation Hill as an official OHV Recreation Facility incorporating 942 acres. Councilman Galvin seconded this motion. There was no further discussion. Motion passed unanimously. FS-10 Financial Statement for July – September FY2022-23 City Manager Switzer gave an overview of the Financial Statement for July through September 2022. Amendment to the Willow Creek General Improvement District (GID) Wastewater Agreement Discussion on the Willow Creek General Improvement District (GID) Wastewater Agreement revealed, if allowing the proposed amendment, Lyon County would be responsible for the charging and collection of payment for the Privilege to Connect fees for new development within the Willow Creek GID, which was previously performed by the City of Yerington. Councilman Galvin made a motion to accept the Amendment as presented. Councilman Bryant seconded the motion. There was no further discussion. Motion passed unanimously. Request for a Refund for Sewer Fees Paid by Earl Freet for 211 Quail Run Drive, Yerington, NV Earl Freet paid for services that were not rendered due to connection malfunction. Councilman Pizzo made a motion to accept the request for a refund of sewer charges paid during the time span preceding the discovery of the connection status in the amount of $615.88. Councilman Bryant seconded the motion. There was no further discussion. Motion passed unanimously. Discussion of a Draft Copy of a Large Event Ordinance ---PAGE BREAK--- The draft copy of the Large Event Ordinance was discussed. Safety, increased communication and occupancy levels were discussed. Councilman Bryant stated that we should review the attendance structure of a class one event. Councilman Galvin asked if we have ever had an issue with the larger events. City Manager Switzer stated that we have not had any issues however with the grown of Night in the Country and other events this draft ordinance needs to be revisited. This ordinance would not apply to school events, just special events. Chief Wagner stated that this ordinance was not meant to prohibit events, but rather to have better control of the larger events for safety and police issues. No action taken. Public Participation Mayor Garry asked for comments and no comments were made at this time. Department Reports Chief of Police Wagner updated council on training statuses and scheduled meetings. Public Works Director Flakus stated discussion on the one-way streets by the schools would be discussed at the next council meeting on October 10, 2022 and asked to be informed of any ideas or suggestions for improvements on Main Street and any information on any curbs or streets that need to be repaired. All information and suggestions are appreciated. Councilman Pizzo reminded everyone of the “Fly In” on October 08, 2022. Councilman Bryant mentioned having the next council meeting available via Zoom. He also gave “kudos” to Officer Mendoza for doing a job well done.
