Yerington City Council Meeting June 14, 2021 at 10:00am – City Hall The regular meeting of the Yerington City Council was held in the Council Chambers with social distancing guidelines in place with the following present: Mayor John J. Garry Council Members Selena Catalano (Via Telephone), Terceira Schunke and Shane Martin City Manager Robert Switzer City Attorney Chuck Zumpft Public Works Director Jay Flakus Chief of Police Darren Wagner City Clerk Sheema D. Shaw Grants Administrator Angela Moore Absent: Councilman Jerry Bryant Guests: Mr. David Ray, Mr. Vince Angle, Ms. Haley Richardson, Mr. Ken Jacobsen, Ms. Kailena Vasquez, Mrs. Misty Stevens, Mr. Delmar Stevens, Mrs. Michelle Keats, Mrs. Brandy Tate, Ms. Shauna Turner, Mr. John Byrne, Ms. Courtney Quinterro, Yerington High School Baseball and Softball Champions. The meeting was called to order and roll call was reported by Mayor Garry. The Pledge of Allegiance was led by Mayor Garry. Public Participation Mayor Garry stated today is Flag Day and asked for comments, no comments were made at this time. Agenda Approval Mayor Garry stated the agenda would be approved as presented unless there were any objections or corrections. City Manager Switzer recommended to delete agenda item number ten, more information was given after the agenda was posted. Another agenda item will be brought to City Council for approval. Business License item B needs to be removed from the revocation list due to a payment being made. The agenda was approved with the corrections stated by Mayor Garry. Revoke Business Licenses Due to Non-Payment for 1st QT January – March 2021. A. Raymond Brent Hammack dba Hammack Bros Construction, Residential Construction, 22 Shelter Hills Dr. Yerington, NV 89447 Mayor Garry stated Business License item A and C will be revoked due to nonpayment of first quarter, January through March 2021 as corrected. Mayor Garry asked for comments, no comments were made and the business licenses were revoked unanimously. Approve a 10-Year Extension of Lease for Airport Hangar # 8 Michael Bussio & Richard Davis. City Manager Switzer stated a renewal of the hangar lease is needed and more will be provided to City Council later this month. ---PAGE BREAK--- Mayor Garry stated the extension of Airport Hangar Lease #8 for Mr. Bussio and Mr. Davis would be approved as presented unless there were any objections. No objections were made and the 10-year extension of lease for Airport Hangar #8 was approved unanimously. Approve a 10-Year Extension of Lease for Airport Hangar #300 for Billie Lee Baker. City Manager Switzer stated the agenda item is another renewal lease for the Airport. Mayor Garry stated the extension of Airport Hangar #300 for Mr. Baker would be approved as presented unless there were any objections. No objections were made and the 10-year extension of lease for Airport Hangar #300 was approved unanimously. Approve a 10-Year Extension of Lease for Airport Hangar #504, Dr. James Vawter. Mayor Garry stated the extension of Airport Hangar #504 for Dr. Vawter would be approved as presented unless there were any objections. No objections were made and the 10-year extension of lease for Airport Hangar #504 was approved unanimously. Approve a Recommendation from the Yerington Planning Commission: Matthew Galvin has Submitted a Variance of Land Use Application for 314 School Street, APN 001-123- 38 to Install a 6-foot Fence to the Front of his Property. City Manager Switzer stated backup material was provided within the application regarding a variance with this property. The Yerington Planning Commission approved of the recommendation. The owner of the property is a sheriff with Lyon County and will receive a K-9 handlers’ job. City Manager Switzer recommends approval by City Council. Councilwoman Schunke stated if the owner moves or sells the property, would the fence then come down? City Manager Switzer stated yes, the fence will only be approved for the current owner. If the owner moves, the fence would need to be taken back down to the 4-foot fence height. Councilwoman Schunke made a motion to approve a recommendation from the Yerington Planning Commission for Mr. Matthew Galvin for a variance of a land use application for 314 School Street, APN 001-123-38 to install a six-foot fence to the front of his property, seconded by Councilman Martin. Mayor Garry asked for comments, no comments were made and the motion was approved unanimously. Approve a Recommendation from the Yerington Planning Commission: Justin Drake & Mandi R. Drake have Submitted an Application for a Reversion to Acreage or Vacation or Abandonment of Street or Easement for Parcel(s) 001-121-08 and 001-121-09 to Combine the Parcels into one Parcel. City Manager Switzer stated the Yerington Planning Commission did meet regarding this item and he recommends approval by City Council. The action includes two separate parcels combining into one parcel. Councilwoman Schunke made a motion to approve a recommendation from the Yerington Planning Commission for Mr. Justin Drake and Mrs. Mandi R. Drake for a reversion to acreage or vacation or abandonment of street or easement for parcels 001- 121-08 and 001-121-09 to combine the parcels into one parcel, seconded by Councilman Martin. Mayor Garry asked for comments, no comments were made and the motion was approved unanimously. Approve a Quote from Q & D Construction for $399,168.00, one-half of the cost ($199.584.00) from Regional Transportation Commission (RTC) funds and the remaining balance to come from the American Rescue Plan Act Funds, to complete Road Reconstruction at Whispering River Subdivision. ---PAGE BREAK--- City Manager Switzer requested to remove the agenda item for approval by City Council. Approve Resolution 2021-01; A Resolution to Augment the Budget for FY 2020-21; Accepting $591,873.00 from the Coronavirus Relief Grant Fund into the Special Revenue Grant Fund pursuant to NRS 354.598005(b). City Manager Switzer stated a final draft of the resolution with the correct budgeted amounts for revenues and expenditures was given to City Council. Revenue is in the amount of $443,200.00, with expenditures in the amount of $473,200.00. The City requests for City Council to accept the amount of $591,873.00 for the Coronavirus Relief Fund. Final figures include revenues in the amount of $1,035,063.00, with expenditures in the amount of $1,065,063.00. City Manager Switzer would recommend approval by City Council. Councilwoman Schunke made a motion to approve Resolution 2021-01; a resolution to augment the budget for FY 2020-21; accepting $591,863.00 from the Coronavirus Relief Grant Fund into the Special Revenue Grant Fund pursuant to NRS 354.598005(b), seconded by Councilman Martin. Mayor Garry asked for comments, no comments were made and the motion was approved unanimously. Approval to Transfer Fiscal Year 2021 Budget Appropriation Within the General Fund FROM: Street Fund in the Amount of $35,000.00, Building Fund in the Amount of $5,000.00 TO: The Management and City Hall Fund in the Amount of $20,000.00 and Airport Fund in the Amount of $20,000.00 for a Total Amount of $40,000.00 pursuant to NRS 354.598005(5). City Manager Switzer stated this action is usually accomplished within June each year. An excess amount of expenses was budgeted and need to be moved into the Management and City Hall Fund. The City Hall Fund was budgeted to be cut between five to ten percent based on the pandemic, but the expenses remained the same. The action by City Council is to balance out the funds. City Manager Switzer recommends approval by City Council. Councilwoman Schunke made a motion to approve to transfer fiscual year 2021 budget appropriation within the General Fund from the Street Fund in the amount of $35,000.00 and the Building Fund in the amount of $5,000.00 to the Management and City Hall Fund in the amount of $20,000.00 and the Airport Fund in the amount of $20,000.00 for a total amount of $40,000.00 pursuant to NRS 354.598005(5), seconded by Councilman Martin. Mayor Garry asked for comments, no comments were made and the motion was approved unanimously. Review Bills Previously Submitted for Payment Bills, Salaries and Vouchers: Accounts Payable Checks 05/25/2021 33759 through 33775 06/03/2021 33779 through 33794 Payroll Checks 06/03/2021 33776 through 33777 Payroll Vouchers 06/03/2021 06032101 through 06032119 Transmittal Checks 06/01/2021 33778 Transmittal Vouchers 06/01/2021 06012101 Mayor Garry stated the bills previously submitted for payment would be approved unless there are any objections or corrections. No comments were made at this time and the bills previously submitted for payment were approved unanimously. ---PAGE BREAK--- Department Reports Chief of Police Wagner stated a fire incident occurred with a vehicle at the residence of a Yerington Police Officer. An investigation is still ongoing, but he could answer any questions. Public Works Director Flakus stated the Public Works Department is currently working on leaks around town. City Manager Switzer stated he met with an executive director of the National League of Cities and discussed the American Rescue Plan Act funds. The executive director offered some incites for the use of the funding. Councilwoman Catalano stated to please make sure the students of Yerington High School know that she is very proud of all of them and congratulations. Councilwoman Schunke agreed with Councilwoman Catalano and was proud of the students. Councilwoman Schunke stated George Dini Day on June 24th. Mayor Garry stated Yerington High School bears the name of the City of Yerington. The City would like to express our pride with the students. Councilman Bryant put together the certificates for the students to celebrate and congratulate their championships. Certificates and flowers were handed out to the Yerington High School students awarding the baseball and softball champions. Mr. Angle with the Yerington High School Varsity baseball team attended and the team had a record of fifty wins to one loss including the zone championship. Ms. Haley Richardson with the Yerington High School softball team attended. Yerington High School Track and Field finished in first place in their league of 2A. Kaydence Hernandez and Kutoven Stevens were the two that placed for track and field. Public Participation Mr. David Ray stated he requests to recognize Mr. Ross Whitacre, a former City Council Member who passed away in Yerington. Mayor Garry asked for comments and no comments were made at this time. There being no further business the meeting was adjourned.
