Staff sends this letter to demonstrate compliance with Oregon Revised Statutes (ORS) 227.178(2). Section references are to the Woodburn Development Ordinance (WDO). Italicized items below are from the March 8 incompleteness letter. E. Cross access: 1. Revise the site plans to delineate and note cross access and a cross access easement to be granted on 2600 Newberg Highway to the benefit of both 2540 & 2620 Newberg Highway (Tax Lot 052W12DB03800; Dairy Queen) per 3.04.03D.2 and 3.04.03C.4a. Illustrate a drive aisle stub to the Dairy Queen property that conforms with 3.04.03C.4b. The applicant’s response memo of April 30, 2024 stated (page “The requested cross access & easement are not permissible by ODOT and would only serve to increase congestion for the proposed development & cause more potential for cars seeking access to the hwy to go the wrong way out the northwest driveway. Ratios: Revise the site plan to provide table calculating how minimum off-street parking is determined per 3.05.02C and Table 3.05A. In other words, confirm that parking is per table rows 6 & 12 and yields 46 minimum required stalls. (The draft site plan illustrates 53.) Revise the Sheet A.10 “Parking Req.” block so that convenience store square footage (“gen. retail”) correctly cites the Table 3.05A item 6 ratio of 1 space per 200 sq ft, not the item 7 ratio of 1 space per 250. (This results in minimum parking increasing from 42 to 46 spaces.) Also correct the compact parking space calculation result from max 8 of 42 to max 9 of 46. Are some pumps allocated for self-serve and others for attendant service or “mini serve”? The applicant’s response memo of April 30, 2024 stated (page “Traffic queuing will be managed through the strategic placement of signage and pavement lines, which will offer the safest and most efficient flow of traffic. Our staff will be on hand to provide assistance if any queries arise. See revised site plan A/A1.1 & queuing plan B/A1.1”. Anticipating a condition of approval through 3.05.02J regarding directional striping, please revise the queuing plan to add “one-way” striping at canopy entrances, min 6, and something like “exit” with a right-turn arrow at canopy exits, min 6. SEE REVISED SITE PLAN A1.1 Second, revise the narrative to reference the revised queuing plan as Detail B on Sheet A1.1. SEE REVISED CONDITIONAL USE NARRATIVE Q. THE HYDRAULICALLY ISOLATED CONCRETE AREA BENEATH THE CANOPY IS SLOPED INWARD TO CHANEL WATER INTO CATCH BASINS THAT ARE CONNECTED TO AN OIL WATER SEPARATOR THAT IN-TERN IS CONNECTED TO THE EXISTING SANITARY SEWER LINE. THE PAVEMENT AROUND THE HYDRAULICALLY ISOLATED CONCRETE AREA SLOPES AWAY TO KEEP RUN OFF FROM ENTERING THE SYSTEM. (IF ANY ADDITIONAL INFORMATION IS NEEDED, PLEASE SPECIFY SPECIFICALLY WHAT YOU ARE LOOKING FOR.) Drainage report has not been provided and plans do not show a private detention facility that will meet City’s Storm Master Plan requirements. SEE STORMWATER LETTER (ORIGINALITY SUBMITTED 2/8/24). THE REQUIREMENT FOR DETENTION WAS NOT AN ISSUE ON PREVIOUS APPROVAL FOR THIS PROJECT. WHAT IS TRIGGERING THIS NOW? The submitted plans do not show a 16’ wide (minimum) easement along the existing public sewer main located between proposed buildings and pump station. THE 2 HYDRANTS TESTED MEET THE ABOVE STATED REQUIREMENTS & THERE ARE ADDITIONAL HYDRANTS ON THE LOOPED SYSTEM IF MORE ARE REQUIRED. PLEASE LET US KNOW IF THERE IS ANY ADDITIONAL INFORMATION YOU NEED.
