regular business hours on December 27 The Aquatic Center will be closed December 24 and 25 The Library will be closed on December 24 and 25 and will be open December 26 from 10 00 am to 2 00 pm New Year City Hall will be closed on January 2 The Aquatic Center will be closed January 1 and the Library will be open on January 1 and closed on January 2 03 APPOINTMENTS A Planning Commission Mayor Figley appointed subject to Council approval the following reappointments to the Planning Commission Claudio Lima Charles Piper Sharon Corning Pugh McCallum approve the reappointments Motion passed and activities 0 10 PRESENTATIONS A Civil Engineering Cooperative Program Public Works Director Brown introduced Oregon State University Intern Dan Howard who provided an overview ofthe Civil Engineering Cooperative internship program 0 38 CONSENT AGENDA A Approve Woodburn City Council minutes of December 12 2011 B Approve extension of City Administrator s Employment Agreement and Councilor Cox requested that item B be addressed separately by the Council Councilor Lonergan seconded the request McCallumCox adopt the consent agenda as modified The motion passed unanimously Council discussed the proposed extension of City Administrator s employment agreement Councilor Cox feels that this item requires additional discussion and is best addressed in an Executive Session Council discussed the past practices regarding City Administrator contracts Cox Pugh that the issue ofthe City Administrator s employment agreement extension be referred to an Executive Session at a future date Motion passed 42 with Councilors McCallum and Morris and voting no 0 46 COUNCIL BILL NO 2883 AN ORDINANCE AMENDING ORDINANCE 2307 THE WILLAMETTE WAVEDIVISION VII LLC CABLE TELEVISION FRANCHISE TO EXTEND SAID FRANCHISE ORDINANCE UNTIL JUNE 30 2012 AND DECLARING AN EMERGENCY Councilor McCallum introduced Council Bill 2883 Recorder Shearer read the two readings of the bill since there were no objections On a roll call vote for final passage the motion passed unanimously Mayor Figley declared Council Bill 2883 duly passed 0 48 COUNCIL BILL NO 2884 AN ORDINANCE READOPTING ORDINANCE 2291 THE DATAVISION TELECOMMUNICATIONS FRANCHISE UNTIL JUNE 30 2012 AND DECLARING AN EMERGENCY Councilor McCallum introduced Council Bill 2884 Recorder Shearer read the two readings of the bill since there were no objections On a roll call vote for final passage the motion passed unanimously Mayor Figley declared Council Bill 2884 duly passed Page 2 Council Meeting Minutes December 12 2011 ---PAGE BREAK--- COUNCIL MEETING MINUTES DECEMBER 12 2011 0 49 PUBLIC RESTROOM AT THE DOWNTOWN PLAZA Councilor McCallum introduced the discussion regarding the temporary public restroom currently located in the downtown Plaza Councilor Lonergan who represents Ward 5 where the plaza is located discussed his impressions ofthe public urination problem historically and the usage statistics ofthe current portable restroom He doesn t find the restroom attractive but believes there is sufficient usage to warrant placement during the summer event season Councilor Schmidt believes there should be a restroom downtown but does not favor a permanent facility He recommends placement of a portable restroom at the transit facility behind the Public Works Annex building He also recommends encouraging use of existing City buildings such as the Library City Hall Councilor Lonergan and McCallum are not convinced using existing City buildings would fully address the problem due to limited availability in the evening hours Councilor Cox does not favor the permanent placement of a portable restroom in the downtown area He believes they are not hygienic or aesthetic for the downtown area He believes there has to be a better solution He also does not believe the City has an obligation to provide a public restroom in this area and furthermore does not have the funding to construct and maintain a public restroom He feels citizens should be responsible for finding and utilizing appropriate restrooms He suggests that signage directing the public to existing public restrooms in the Library and City Hall be established City Administrator Derickson and Community Services Director Row discussed usage since the placement of the restroom in late Juneearly July There has been varying degrees of usage with high usage around events at the plaza and there has been no reported vandalism Public Works Director Brown reported on downtown garbage cleanup activities performed by Public Works staff which includes occasional public defecation cleanup Councilor Pugh reiterated that there is no funding available to make a public restroom available He doesn t support the portable option either partially because of aesthetics largely due to cost Councilor Morris has done his own informal polling and does not support the placement of a portable restroom downtown Durrell Crays of 167 N Settlemier testified that he surveyed members of the Downtown Neighborhood Association and they are strongly opposed to the placement of a portable restroom downtown except when associated with a specific event He feels that the problem could be addressed by downtown businesses as he feels the usage is by customers of the downtown businesses He encouraged Council to consider developing a long term plan for a permanent restroom near the transit facility and not settle for a short term fix Page 3 Council Meeting Minutes December 12 2011 ---PAGE BREAK--- COUNCIL MEETING MINUTES DECEMBER 12 2011 Councilor McCallum feels that there is a need for restroom facilities downtown outside the plaza to ensure that the continued development and revitalization of downtown is not hampered Mayor Figley stated that in a perfect world we would have permanent restroom facilities with adequate staffing to maintain them in the downtown area She believes the usage of the existing portable restroom indicates a need for such facilities Lonergan McCallum authorize the City to make a restroom available in the downtown area outside of the Plaza for approximately five months a year in the summertime On a roll call vote Councilors Lonergan McCallum and Schmidt voted yes and Councilors Pugh Cox and Morris voted no Mayor Figley cast the deciding vote as yes The motion passed 43 1 38 CANCELLATION OF DECEMBER 26 2011 COUNCIL MEETING McCallumCox cancel the December 26 2011 meeting Motion passed unanimously 1 39 CITY ADMINISTRATOR S REPORT Economic Community Development Director introduced the new part time Urban Renewal planner Matt Craigie 1 40 MAYOR AND COUNCIL REPORTS Councilor McCallum commended Public Works for their participation in the Firefighters Food Drive 1 43 ADJOURNMENT Lonergan
