WOODBURN PLANNING COMMISSION PUBLIC HEARING/MEETING MINUTES April 14, 2022 CONVENED: The Planning Commission met in a 7 p.m. virtual public meeting session via GoToMeeting, Chair Piper presiding. ROLL CALL: Chair Piper Present Vice-Chair Ellsworth Present Commissioner Hernandez-Mejia Present Commissioner Berlin Absent Commissioner Corning Present Commissioner Bartel Absent Commissioner Lassen Present (Arrived @ 7:23pm) Staff Present: Chris Kerr, Community Development Director Colin Cortes, Senior Planner McKenzie Granum, Assistant City Attorney Introduction Chair Piper opened the meeting at 7:05pm and led the commission into the Pledge of Allegiance. Minutes: Vice-Chair Ellsworth moved to have the minutes of September 9, 2021, October 14, 2021, February 10, 2022, and February 24, 2022 be approved. Commissioner Corning seconded. The Commission voted unanimously in favor of approving the minutes. Business from the Audience: None. Communication: None. Public Hearings: Chair Piper introduced the public hearing of LA 21-02 Middle Housing. There is no public hearing statement, therefore Chair Piper moved on to the Staff Report. Senior Planner Colin Cortes gave the Staff Report. He explained what the main role of the commission was for tonight. He then gave a quick summary of the last time they had a meeting about middle housing. Senior Planner Cortes discussed the updates and changes to the middle housing report and what staff had added since the last meeting. He moved into the three items staff is hoping to fix some of the standards. The first is to reduce a zoning setback and staff is proposing to shrink the setback from 5ft to 1ft, for each side of the easement. The second change is for townhouse lots, because the law is requiring the city can’t require a minimum lot size for a townhouse that is wider than 15ft and larger than 1500 square ft. For lots in general, there is a requirement along the street, there is something called a public utility ---PAGE BREAK--- easement requirement, typically 5ft long since it’s the minimum. Staff is proposing that a for a townhouse lot that’s at a corner and it’s at the minimum size, that the second frontage side, will be exempt from doing the 5ft PUD. The idea is that if the PUD was required, it would limit the effective width of the building from 15ft to 10ft. The last and third item is to allow developers to submit a zooming adjustment application. In order to request to adjust the medium-density residential zoning district, minimum siding setbacks, which are very deep standards, and allow developers to make application requests that they be reduced to a limited degree. Lastly, Senior Planner Cortes showed a slide about the recommended statement if the Commission decided to move a motion of approval. He asked the Commission if they have any questions. Chair Piper moved on to the testimony of the applicant, which there was none. He moved to testimony of proponents and opponents, which there were none and there was no rebuttal. Chair Piper closed the public hearing and the Commission moved to deliberate and there were no additional comments. Commissioner Corning moved that the Planning Commission recommend to City Council to approve the Legislation Amendment 21-02 of the Woodburn Comprehensive Plan and the Woodburn Development Ordinance (WDO) to comply with Oregon House Bill 2001 of 2019 and the Oregon Department of Land Conservation and Development (DLCD) through administrative rules OAR 660-46. Commissioner Mejia-Hernandez seconded the motion. Chair Piper asked Senior Planner Cortes to begin the roll call vote. Those in favor were Commissioner Corning, Commissioner Mejia-Hernandez and Vice-Chair Ellsworth. Those who opposed was Chair Piper. The motion carries 3-1 and it’s approved. Business from the Commission: Chair Piper explained as to why he was opposed to approving the Legislation Amendment 21-02. The other commissioners also expressed their feelings, both the positive and negative thoughts on the Legislation Amendment 21-02. Staff Update: Staff recommended that Chair Piper give a quick summery to Commissioner Lassen. Community Development Director Chris Kerr had a few updates. Director Kerr updated the project map for the commission and encourages them to take one, in order to answer resident’s questions about the current projects. He even mentioned the Current Project webpage and that it’s up to date. Director Kerr talked about the upcoming City Council meeting on April 25, 2022. It’ll be a work session and planning items about the WDO Transportation plan and modifying the system development changes for the city. Director Kerr discussed the budget amendment application on the agenda, in order to add more staff to the department. He mentioned recent staff promotions and why the department needs more staff, in order to keep up with the workload. ---PAGE BREAK--- For upcoming Planning Commission items, there is quasi-judicial items lined up for the next two meetings. On April 28, 2022, there will be two quasi-judicial items; one is the Cooley Rd. subdivision, about 8 lots and the second one is the subdivision on Parr Rd. On May 12, 2022, it will be a commercial application for a gas station over on Oregon Way. Adjournment: Chair Piper entertained a motion to adjourn. Vice-Chair Ellsworth motioned to adjourn the meeting. Commissioner Corning seconded. The vote was unanimous and meeting adjourned at 7:32pm.
