WHITEFISH LEGACY HOMES PROGRAM FEE IN LIEU – Valid as of October 3, 2022 Example: A 36-unit apartment project providing 3.6 units deed restricted for the voluntary Legacy Homes Program (36 x 10% = 3.6). If the developer provides 3 Legacy units, a fee of $109,364.40 would be required for the remaining 0.6 units ($182,274 x 0.6) If the developer provides no Legacy units and wishes to pay the fee in lieu of the units, a fee of $656,186.40 in-lieu of the 3.6 units is required ($182,274 x 3.6) If the developer provides 2 Legacy units, a fee of $291,638.40 in-lieu of the remaining 1.6 units is required ($182,274 x 1.6) Applicability Fee In Lieu One option to meet the Legacy Homes Program $182,274 per unit
