Whitefish Police Department Case Report 275 Flathead Ave. Date of Incident_________ Whitefish, MT. 59937 Time of Incident_________ (406) 863-2420 PARTNER OR FAMILY MEMBER ASSAULT: Montana Code Annotated 45-5-206 PARTNER OF FAMILY MEMBER ASSAULT: 1) A person commits the offense of partner or family member assault if the person purposely or knowingly causes bodily injury to a partner or family member; negligently causes bodily injury or family member with a weapon; or purposely or knowingly causes reasonable apprehension of bodily injury in a partner or family member. 2) For the purposes of Title 40, Chapter 15, 46-6-311, and this section, “Family Member” means mothers, fathers, children, brothers, sisters and other past and present family members of a household. “Partners” means spouses, former spouses, persons who have a child in common, and persons who have been or are currently in a dating or ongoing intimate relationship with a person of the opposite sex. 3) A person convicted of Partner or Family Member Assault for the first or second offense shall be fined not to exceed $1000 or be imprisoned in the county jail for a term not to exceed 1 yr., or both. On a third or subsequent conviction for Partner or Family Member Assault, the offender shall be fined not to exceed $ 50,000 or be imprisoned for a term not to exceed 5 years, or both. NOTICE: If you are the victim of Partner or Family Member Assault, the City Attorney’s Office can file criminal charges against your abuser. The forms you need can be obtained at Whitefish City Court. You may contact the Whitefish Municipal Court at (406) 863-2440. You have the right to go to Court and file a petition requesting any of the following orders for relief: 1. An order restraining your abuser from abusing you; 2. An order ordering your abuser to leave your household; 3. An order preventing your abuser from transferring any property, except in the usual course of business; 4. An order awarding you or the other parent custody of, or visitation with a minor child or children; 5. An order restraining your abuser from molesting or interfering with minor children in your custody; or 6. An order directing the party not granted custody to pay support of minor children, or to pay support of the other party if there is legal obligation to do so.
