Printed Name (Must Be Property Owner) Signature (Must Be Property Owner) ---PAGE BREAK--- RESOLUTION NO. 19-12 A Resolution of the City Council of the City of Whitefish, Montana, establishing a Sidewalk Cost-Sharing Program. WHEREAS, § 7-14-4122, MCA, authorizes the City Council to regulate and provide for the construction or repair of sidewalks, foot pavements, curbs, gutters or any combination thereof, and WHEREAS, pursuant to§ 7-14-4122, MCA, the City passed an ordinance, § 7-lA of the City Code, that requires the abutting prope1iy owner to construct, maintain and repair the sidewalk; and WHEREAS, for several years, the City has budgeted funds to assist prope1iy owners in complying with their duty to construct, maintain and repair the abutting sidewalks; and WHEREAS, the City recognizes that safe, maintained sidewalks benefit the City as a whole and its inhabitants; and WHEREAS, the City desires to formally establish a Sidewalk Cost-Sha1ing Program to assist prope1iy owners in constructing, maintaining and repairing abutting sidewalks. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Whitefish, Montana, as follows: Section 1: All of the recitals set fo1ih above are hereby adopted as Findings of Fact. Section 2: The City Council hereby establishes a Sidewalk Cost-Sharing Program under which, upon a property owner's execution of a Sidewalk Cost-Shaiing Agreement, the City shall pay for 50% of the per-square-foot cost of or repairing a sidewalk and the abutting prope1iy owner shall pay for the remaining 50%. Section 3: The City Council shall establish the annual City contribution to the Sidewalk Cost-Sharing Program through the budget process. Section 4: The Director of Public Works or his/her designee shall administer the Sidewalk Cost-Sharing Program and dete1mine the eligibility of projects.
