City Beach Commercial Use Permit A Commercial Permit is required to conduct commercial activity at City Beach. The permit program enables the City of Whitefish to manage commercial use and ensures adherence to all rules and regulations. Fees from this program help support the costs of maintaining and administering the boat launch and City Beach. All businesses must obtain a permit prior to conducting business at City Beach. Commercial uses include, but are not limited to, watercraft retail sales, equipment rentals (motorized only), boat and dock maintenance services, and guided activities including angling, tours, and watersports. Non-profit organizations and educational groups that receive money from participants are also required to purchase a permit. The City of Whitefish will allow 6 annual permits to businesses providing guiding services and 4 annual permits to motorized rental delivery businesses. There is no limit on boat storage/delivery, marine service/sales, and dock service commercial use permits. Non-motorized rental delivery is not permitted. Permit Fee: $125 (includes one boat launch season pass or punch card with 5 single use launches) All permit holders are required to understand and agree to the following rules: AIS Inspections and Decontaminations: All watercraft MUST be inspected prior to launching in Whitefish Lake from May through September. Certain high-risk watercraft must be decontaminated prior to launching in Whitefish Lake. AIS Self Certification: During the months of October through April, all commercial permit holders must complete the Aquatic Invasive Species (AIS) Boat Inspection Certification Exam. Certification enables local commercial businesses to receive a code to access the boat launch during the off season. This online certification can be found on the City’s website at www.cityofwhitefish.org. Vending Ordinance: All commercial permit holders must read and understand the following Ordinance No. 7-3-9 regarding vending in the City Beach area. Vendors of any kind or nature are hereby prohibited and it is declared unlawful for such vendors to hawk or sell or attempt to sell any goods, wares, merchandise, food or services within the boundaries of any of the city's public parks, and the waters within two hundred feet (200') of Whitefish City Beach, and the designated swimming areas and docks, except by permit authorized and obtained from the director of the parks and recreation department, or in his or her absence, an individual designated by the director. These regulations prohibit product demonstrations, customer solicitation, exchange of money on park property (including tips), and beaching of commercial watercraft. P.O. Businesses that rent skis, boats, jet skis and other items in the City of Whitefish are required to collect the 3% resort tax on such items based on City Code. • Businesses that have a physical location outside of the City of Whitefish: These businesses do not have to collect Resort Tax if the sale of taxable items and the delivery and exchange to the customer of taxable items both takes place outside city limits. However, when a business starts the sale, regardless of location, and then the business delivers to and exchanges the item with the Customer using their own vehicle or equipment (such as the business’ delivery truck and trailer) and the Customer takes delivery of the item in the City Limits of Whitefish, the transaction is then completed in the City of Whitefish and subject to the City’s 3% Resort tax. These businesses will also need a Business License and can apply as a Business Located Outside of the City Limits. Whitefish City Beach Rules: All commercial permit holders must read and understand the following rules and regulations of Whitefish City Beach and abide by all the laws governing the use of the launch facility, parking areas and the park: No dogs allowed on beach or park area; no lifeguards on duty; swim at your own risk; no diving off floating dock; all children twelve (12) and younger must be directly supervised by an adult; no fishing, swimming or sunbathing on boat launch dock; no skateboards, skating or biking on the sidewalks of the park; no smoking, alcohol or glass containers allowed; comply with the no wake zone within two hundred feet (200') of the boat launch; no commercial vending within two hundred feet (200') of the beach, swimming area and docks; and, no fireworks. All commercial permit applicants will be reviewed and evaluated for impacts to parking. The City reserves the right to limit parking or deny City Beach Commercial Use Permits based on the significance of parking impacts to the City Beach neighborhood. For-profit entities are limited to 2 parking spots per launch. Boat Launch: All commercial users must have either a season pass for each vessel or purchase a day pass for each vessel. A boat launch waiver form is required for each season pass purchased. The season pass must be affixed to the watercraft and is non-transferable between boats. A single season pass or a punch card with five, single use launches are included with this commercial permit. Failure to obtain a commercial use permit violates code 15-06.
