RESOLUTION NO. 19-15 A Resolution of the City Council of the City of Whitefish, Montana, approving amendments to the rates and policies for impact fees assessed by the City of Whitefish. WHEREAS, pursuant to Ordinance No. 07-25, adopted by the City Council on August 6, 2007, the City implemented several different types of impact fees on new construction and/or development within the City limits as authorized by§§ 7-6-1601 , et seq., MCA; and WHEREAS, pursuant to Ordinance No. 10-03, adopted by the City Council on December 20, 2010, certain amendments were made after the City had some experience in implementation of impact fees; and WHEREAS, pursuant to Ordinance No. 13-05, adopted by the City Council on May 20, 2013, certain amendments were made to reduce water and wastewater impact fees for small projects; and WHEREAS, pursuant to Ordinance No. 18-38, adopted by the City Council on December 3, 2018, ce1iain amendments were made to the impact fee methodology and rates; and WHEREAS, pursuant to Resolution No. 18-44, adopted by the City Council on November 19, 2018, impact fee rates were adjusted with an effective date of January 1, 201 9; and WHEREAS, City staff reviewed the Capital Improvements Program for the Water Treatment Plant, and based on capacity issues identified further amendments that it recommended would be in the best interests of the City to adopt; and WHEREAS, City staff prepared amendments to the rates for the impact fees assessed by the City, as shown in Exhibit A; and WHEREAS, notice of a public hearing at which the proposed amendments would be considered by the City Council was published in conformity with 7-6-4013 and 7-1-41 27, MCA; and WHEREAS, at a public hearing held by the City Council on July 15, 2019, the Whitefish City Council received and considered oral and written reports by City staff, received public input, and considered the proposed amendments; and WHEREAS, the rates proposed by the City staff and supported by the "Impact Fee Update" are reasonable and based on the specific instructions for the methodology of calculating impact fees pursuant to§§ 7-6-1602 and 7-6-1603, MCA; and WHEREAS, it will be in the best interests of the City of Whitefish, and its inhabitants, to approve the amendments proposed by City staff. - 1 - ---PAGE BREAK--- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Whitefish, Montana, as follows: Section 1: All the recitals set forth above are hereby adopted as Findings of Fact. Section 2: The amendments to the impact fees as shown in Exhibit A, attached hereto and incorporated herein by reference, are hereby adopted. Section 3: This Resolution shall take effect September 1, 2019, after its adoption by the City Council, and signing by the Mayor thereof. ATTEST: Michelle Howke, City Clerk - 2 - ---PAGE BREAK--- EXHIBIT A Impact fees shall be assessed in accordance with the Whitefish City Code, Chapter 10, Section 2. The impact fee rates below are generated from the formulas for calculating impact fees set forth in the "Impact Fee Update" dated August 2018, which is incorporated herein by reference. When applicable, a single family detached dwelling unit equates to one Equivalent Residential Unit (ERU). All other residential development (apartments, townhomes, condos, duplexes, triplexes, etc.) and nonresidential development shall be assessed on a per square foot of new floor area. A. The impact fee rate for paved trails shall be five hundred eighty-three dollars ($583.00) per single family residential detached dwelling unit, two hundred fourteen dollars ($214.00) per lodging room, and six cents ($0.06) per square foot of new floor area for other residential and nonresidential development. B. The impact fee rate for park maintenance building shall be one hundred twenty-eight dollars ($128.00) per single family residential detached dwelling unit, forty-seven dollars ($47.00) per lodging room, and one cent ($0.01) per square foot of new floor area for other residential and nonresidential development. C. The impact fee rates for emergency services building shall be four hundred forty-six dollars ($446.00) per single family residential detached dwelling unit and twenty-two cents ($0.22) per square foot of new floor area for other residential and nonresidential development. D. The impact fee rates for city hall shall be forty-seven dollars ($47.00) per single family residential detached dwelling unit and two cents ($0.02) per square foot of new floor area added for other residential and nonresidential development. E. Pursuant to and consistent with the requirements of § 7-6-1601(5)(a), MCA, and § 10-2-13 of the Whitefish City Code, all development pe1mits subject to impact fees, as subsequently adjusted by city council resolution, shall pay an administrative fee in addition to the impact fee rates above, in an amount equal to five percent of the assessed impact fees.
