ORDINANCE NO. 23-21 An Ordinance of the City Council of the City of Whitefish, Montana, amending Title 6, Chapter 1, Section 9, One-Way Traffic. WHEREAS, the City of Whitefish has established one-way traffic zones in order to ensure public safety, preserve City streets and infrastructure, and maintain adequate traffic flow; and WHEREAS, City staff has been working with Whitefish School District officials and concerned parents regarding a crosswalk condition that has developed at the intersection of Pine A venue and E. 6th Street resulting from the relocation of Muldown Elementmy School; and WHEREAS, it has been detetmined the block of E. 6th Street between Park A venue and Pine Avenue should be modified to accommodate one-way eastbound vehicular traffic and two-way bicycle and pedestrian traffic; and WHEREAS, appropriate signage, striping and temporary barriers should be used to differentiate between bicycle/pedestrian lanes and driving lanes; and WHEREAS, the City of Whitefish Public Works Department and Police Department have reviewed this transportation safety measure and recommend its completion; and WHEREAS, it is in the best interests of the City and its inhabitants to establish this modification. NOW, THEREFORE, be it ordained by the City Council of the City of Whitefish, Montana, as follows: Section 1 : The forgoing recitals are hereby adopted as findings of fact. Section 2: Title 6, Chapter 1, Section 9 of the Whitefish City Code is hereby amended as set fotih in Exhibit A attached hereto. Section 3: If any section, subsection, sentence, clause, phrase, or word in this chapter is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this chapter. The City Council hereby declares that it would have passed this chapter and each section, subsection, sentence, clause, phrase, and words thereof, itTespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or words have been declared invalid or unconstitutional, and if for any reason this chapter should be declared invalid or unconstitutional, then the remaining ordinance provisions will remain in full force and effect. Section 4: This Ordinance shall take effect thitiy (30) days after its adoption by the City Council of the City of Whitefish, Montana, and signing by the Mayor thereof. Michelle Howke, City Clerk ---PAGE BREAK--- 6-1-9: EXHIBIT A Whitefish City Code Title 6 - Motor Vehicles and Traffic Chapter 1 - General Traffic Provisions Section 9- One-Way Traffic ONE-WAY TRAFFIC: It shall be unlawful for any person to drive or operate any motor vehicle of any kind upon or over any of the following designated streets, alleys or po1tions thereof indicated and described, except in the direction set out in this section: Lakeside Boulevard and that portion of Oregon Avenue lying east of Woodland Place, and traffic shall only move from west to east on said p01tion of Oregon A venue onto Lakeside Boulevard to the intersection of Lakeside Boulevard and Washington A venue. Lakeside Boulevard and Skyles Place lying west of Dakota Avenue, and traffic shall only move from west to east on said p01tion of Lakeside Boulevard onto Skyles Place to the intersection of Skyles Place and Dakota A venue. E. 6th Street lying between Park Avenue and Pine Avenue, and traffic shall only move from west to east on said portion of E. 6th Street. Exhibit A
