Agreements between the Artist and the City of Coalville or the Artist and Summit County will include the following points: 1. The ARTIST certifies that his/her artwork is original and available for purchase. The artist certifies that works are soundly and professionally constructed of durable and sturdy materials, have no breakable or easily damaged parts or pieces, are suitable for outdoor public display, are constructed in a way which will not cause safety or liability problems, and will require no maintenance during the twelve-month exhibit period. 2. The ARTIST is responsible for securely attaching works to a durable steel base or mounting plate in order for the piece to be welded to a metal pedestal or, if over six feet in height, bolted to a concrete placement. 3. The ARTIST is responsible for the integrity and workmanship of the piece, its parts, and its attachment to the mounting plate. 4. The City of Coalville is responsible for securely installing all artwork and maintaining liability insurance coverage on all works. Coalville will not be responsible for any damage or claims in connection with installation of artwork. 5. ARTIST is responsible for the event of vandalism, theft, damage, natural occurrences, or act of GOD. 6. ARTIST is responsible for transporting the piece to the installation site at the beginning of the 12 month period and removing the piece at the end of the 12 (twelve) month period. 7. ARTIST has the option to loan piece to keep in same location or move to new one at Summit County/City of Coalville discretion. Transportation arrangements shall be determined at that time between the Artist and the City of Coalville. 8. If piece is sold to a private buyer during the year, buyer is asked to retrieve piece at the end of the 12 (twelve) month period. If buyer decides to take it during the 12 (twelve) month period, Artist shall replace it with a new piece to finish out the year. 9. Summit County Artscape and the City of Coalville reserves the right to make all installation/placement decisions and to make emergency repairs to works when necessary. ---PAGE BREAK--- 10. Coalville has the right to decline any artwork and/or to require the removal of the same. 11. Summit County and the City of Coalville will make a reasonable effort to market works exhibited and will produce and distribute informational materials. The ARTIST agrees that Summit County will facilitate any sales and will retain a 15% commission for the public art fund for artwork purchased during this exhibit with the exception of the winner of the People’s Choice Award.
