Data Release Form Data requested: Requesting Party: Signature of Requesting Party: Company name: Address: City, State, Zip: Phone: TO THE REQUESTING PARTY: The data provided hereunder is provided “as is” and Summit County expressly disclaims all warranties, UCC and otherwise, express or implied, including warranties as to the accuracy of the data and merchantability and fitness for a particular purpose, and further expressly disclaims responsibility for all incidental, consequential or special damages arising out of or in connection with the use or performance of the data. There are no warranties which extend beyond the description on the face hereof. The data provided by Summit County shall remain the property of the County, which retains all rights commensurate with ownership, including the right to sell, release, license use or provide the data to others as it deems appropriate in its sole discretion and the copyright to the data and the form in which it is compiled and presented. The requestor acknowledges and agrees that Summit County is not required by law to abstract or summarize GIS data or convert GIS data from one form to another. Requesting party agrees that the data provided will be used in accordance with all federal, state, and local laws, including all privacy laws, rules and regulations. The following clause shall appear on all maps or plans or documents created through the use of this Summit County GIS data: “This drawing is neither a legally recorded map nor a survey and is not intended to be used as such. The information displayed is a compilation of records, information and data obtained from various sources, including Summit County which is not responsible for its accuracy or timeliness.” I acknowledge this disclaimer of warranty and expressly waive all warranties, express or implied, and waive any right of claim for damages incidental, consequential or special, arising out of or in the connection with the use or performance of the data. I agree to pay for the requested data the sum of $1,200.
