1 Star City Council Meeting Minutes December 16, 2014 The regular meeting of the Star City Council was held on December 16, 2014 at Star City Hall, 10769 W. State Street, Star, Idaho. Mayor Mitchell called the meeting to order at 7:00 pm and all stood for the Pledge of Allegiance. Roll Call: Council persons Chad Bell, Tom Erlebach, Richard Lockett and Tammy McDaniel were all present. Approval of the Agenda: Bell moved to amend and approve the agenda, adding an Executive Session per Idaho Code 67-2345(1)(b) Personnel as item eight, Lockett seconded the motion. All aye: motion carried. Consent Agenda: McDaniel moved to approve the Consent Agenda consisting of Regular Meeting Minutes for December 2, 2014 and Findings of Fact & Conclusions of Law for Clydesdale Ranch Preliminary Plat, Lockett seconded the motion. All aye: motion carried. Public Input: Public Input – No one from the public spoke. Old/New Business: Public Hearing – Rezone for Hiddenbrook Development – Mayor Mitchell reviewed the process for the public hearing. The Mayor asked Council if there was any ex parte contact or conflicts of interest; hearing none the Mayor opened the public hearing. Applicant – Oliver Cleaver, 2001 N. Linder Road, Eagle, Idaho stated he was the original developer of the Pristine Meadows Subdivision in 2001. Since then he has sold off two portions of the plat and now has only this remaining 2.1 acres. This piece was originally zoned commercial, but as Floating Feather Road has not been developed, he felt rezoning it to residential would be a better use of the property and is asking for low density R-2. Erlebach noted Cleaver has a “For Sale” sign on the property and wondered if he intended to sale it as commercial or residential property. Cleaver stated he has had no interest in the property as commercial, but there has been some interest in low density residential. McDaniel asked Cleaver if he had any interest in developing the property himself. Cleaver stated he did not personally want to develop, and envisioned it to match the Fenix Ranchettes property next door. Staff – Staff had nothing to add. The Zoning Administrator was not present. Public – Jay VanHonten, 11600 W. Floating Feather Road, Star, Idaho stated he owns the property directly across from this property. He was concerned that with the irregular shape of the parcel it may not be conducive to low density; feels the development will look like high density. VanHonten stated he did not want to see four houses on the property. Mayor Mitchell stated he understood his concern with density and asked if he would rather see a commercial development or residential. VanHonten stated he would like to not see it developed at all. He would like to see is stay commercial as his property may someday be developed as commercial. ---PAGE BREAK--- 2 Applicant Rebuttal – Cleaver noted it is currently zoned commercial and could be developed without coming before Council. He felt residential is a better use for the property. Mayor Mitchell further explained some of what could be put in if left commercial; but because of the property’s triangular shape it really was not conducive to commercial. Applicant is looking at residential zoning and he felt this would be the best use of the property. Erlebach pointed out a white line on the aerial map west of the property and asked what this line represented. Cleaver stated the line was actually the property line, not a road; and the small piece was part of Pristine Meadows. Erlebach asked if Pristine Meadows did not use the small triangle piece would Cleaver maybe acquire it back. Cleaver stated he would not; they may just landscape it. Mayor Mitchell pointed out the lot is plotted as a common lot for Pristine Meadows. Mayor Mitchell closed the public hearing and moved to deliberations. Council – Bell questioned the zoning and number of houses. The Mayor explained the zoning would restrict the number of houses and Cleaver was requesting an R-2 zoning. According to the City Comp Plan this parcel is platted low density which is R-1 or R-2. McDaniel noted higher density is north and south of this parcel, with medium density to the west and low density to the east; therefore R-2 would fit in. Erlebach asked about the entrance to the property. Mayor Mitchell explained that the Ada County Highway District would probably only require one entrance. Bell moved to approve File RZ-15-02 Hiddenbrook Development Rezone from Commercial C-1 to Residential R-2 zoning designation, McDaniel seconded the motion. Bell explained he felt the residential zoning fit into the Comp Plan and this would be the best use of the property. All aye: motion carried. Ordinance No. 242 Lionwood Properties Rezone – The Mayor explained this Ordinance was to codify a decision the Council had previously approved. McDaniel moved that pursuant to Idaho Code, Section 50-902, the rule requiring an Ordinance to be read on three different days, with one reading to be in full, be dispensed with and that Ordinance No. 242 be considered after reading once by title only, Erlebach seconded the motion. Roll Call: McDaniel, Lockett, Elrebach and Bell – all aye: motion carried. Bell moved to approve Ordinance No. 242, an Ordinance of the City of Star, Idaho, rezoning certain real property located in the City of Star, generally located east of Can Ada Road and south of the Havencrest Subdivision (Ada County Parcel #S0407233950, Star, Idaho from a Residential (R-2) classification to a Residential (R-3) classification; amending the Zoning Map of the City of Star to reflect such changes; and providing an effective date, Lockett seconded the motion. All aye: motion carried. Building Energy, Inc. – Ingo Stroup – Ingo Stroup was not present. Reports: Staff – Staff had nothing to report. Council – McDaniel informed the Council she would be making another trip to Vegas regarding her mother and will probably miss the second meeting in January. ---PAGE BREAK--- 3 Lockett stated he attended the Fire Department Meeting, the tree lighting ceremony, and the Chamber Holiday Bazaar. Erlebach stated he attended the Chamber Meeting and attendance was up. He mentioned the fence on the River Walk to the east is down and missing. The Mayor stated he would check on it. Erlebach noted a citizen was asking him about a boat ramp. The Mayor explained he had met with The Land Trust and Fish and Game to discuss designs. He explained there are other concerns regarding items not completed by The Land Trust that they may want to consider before doing the boat ramp. Erlebach stated he wanted to thank whoever replaced the mismatched lights on the Christmas tree in front of City Hall. Bell stated he had nothing to report. Mayor – Mayor Mitchell stated he is scheduled to meet with Kelly Fairless with Valley Regional Transit to discuss long range plans. Bell mentioned he was also to attend this meeting. The construction on the building at Hunters Creek Park is coming along. The Mayor is also in discussions with the County regarding the River Walk and long range plans for the Carlson property. They are on track for the transfer of ownership of the 60 acres at Heron River sometime in the late summer. Executive Session 67-2345 – Bell moved to enter into Executive Session under Idaho Code Section 67-2345(1)(b), Erlebach seconded the motion. All aye: motion carried. The Executive Session concluded and the regular meeting was reconvened by Mayor Mitchell. Adjournment: Mayor Mitchell declared the meeting adjourned at 8:25 pm.
