Willowbrook Golf Course Annexation and Rezone Petition Signers Stop Willowbrook Golf Course Annexation and Rezone...We need the full picture To: The Star City Council re: Willowbrook Golf Community, File number AZ-21-12 The Willowbrook Development is proposing to build a total of 1,094 dwelling units (146 patio homes, 948 single family detached homes, 13 acres commercial) on 716 acres, to rezone R3626110480, R3626121000, R366121100, R3626130010, R3626130190, R3626130460, R3828130510, R3626140010, R3626150080, R3626150150, R3626150210, R3626160220, R3626160010, R3626160300, R3626170020, R3828170040, R3626170060, R3826170150, R3626170250, R3626170320, R3626170600 from (Rural Residential) to (R2), annex into the City of Star We are OPPOSED to the annexation of this development for some or all the following reasons:• Incomplete Application/inaccurate Application • Improper use of Site Amenities- Using golf course to calculate home count (Municipal Code 8-4E) • Unresolved/unfunded mitigation measures for Star Road, CanAda Road, Wing Road, Beacon Light, Floating Feather, New Hope.. • Increase in traffic/ parking issues and demand on roads- Traffic Impact Study shows that 13,000 daily trips will be generated by this development alone. (7207.1 ACHD Policy Manual) • Trisect BLM making it unusable- Star Transportation and Pathway Committee proposes two new roads through BLM. • Decrease in road safety for school children- with only two exits for 1409 dwellings, and changing the classification of Lanktree Gulch Rd, Deep Canyon Rd, and CanAda due to the increased number trips will decrease safety. • Overcrowding at nearby schools- West ADA Planning and Development Administrator stated in her letter they will need to build a school and require another bond in order to increase capacity. • Lack of Police coverage - per 3/20/23 Board of County Commissioner meetings, it was stated that for the past 25 years they’ve had 8 deputies per patrol team. The staffing level of Ada County patrol has not changed in 25 years, while the County’s population has risen 85% • Increase burden on understaffed police and fire departments. • Increase in density- the density for this project does not comply with the Star Comprehensive Plan and is not compatible with the surrounding developments.. • Incompatibility- All surrounding neighborhoods are rural residential single family detached homes on 1 acre to 10 acre lots. This project creates a density of up to 10.5 homes per acre, that are unlike the existing lots in Hillsdale and Monument Ridge. • Non-compliance with the Star Comprehensive Plan Special Transition Overlay Zone - Ref. 2022 Star Comprehensive Plan, pg. 36 • Cumulative impact - already approved projects is having a harmful effect upon the desirable open and rural characteristics of Star. • Undetermined designation/approval of additional roads required by ACHD/ ITD • Water – No details on the proposed domestic and wastewater systems, to ensure Star citizens don’t get burdened with building out these systems. • Commercial development – Proposed commercial development in the foothills is not part of the Star Comprehensive Plan. For these reasons, we ask the City Council to honor their process and ensure full due diligence is Voice of Star 1 of 30 ---PAGE BREAK--- complete. In addition, we ask that the council review the conceptual plan and ask that the applicant revise their plan to conform with the Star Comprehensive Plan, one that will ensure this project will add to the prosperity and be a benefit to the City of Star. Therefore, we request that the Star City Council DENY this application for Willowbrook Golf Community until it is revised with lower density to accommodate road capacity and follow the Star Comprehensive Plan and until a complete application has been submitted and reviewed. The current Star Comprehensive Plan has the land for the proposed Willowbrook Development zoned at R1 - one unit per acre. The Willowbrook Development is requesting a zoning of R2 - 2 units per acre. In addition, Willowbrook is hoping to include a golf course and other commercial endeavors without actually applying for the appropriate zoning for these items. If you look at the current Star Comprehensive Plan Land Use Map you will find that there is no accomodation for commercial development in that area. Some will say that because Willowbrook applied under the old Star Comprehensive Plan they should be entitled to develop their land under that plan. Two problems with that line of thinking: 1. There is no code/law that requires the city to process this application under an obsolete Comprehensive Plan; 2. And since Willowbrook's conceptual plan has substantially changed since the time of the initial application and no detrimental reliance has occured the City should only consider this application under the current Comprehensive Plan. If Willowbrook is to seek approval under the former Comprehensive Plan, shouldn't that Plan be available for the citizens of Star and the City Council to review? Of course the Star Comprehensive Plan is only a guideline for the City to use as a tool for developing our area, but if the City is not going to do everything they can to follow the Comprehensive Plan (put together by the people of Star) what is the purpose of having one? Willowbrook Master Planned Golf Community Sloppy /incomplete and contradictory application for "Master Planned" Willowbrook development will lead to a confusing annexation and zoning process full of unintended consequences. Sloppy/incomplete - as seen in the application page, numerous corrections and omissions are noted and resubmissions completed, sort of. Yet the application still lacks the basic requirements. Such as no commercial elevations. Contradictory - As stated, in the applicant's updated narrative, "The Willowbrook Golf Community is located on property within Phase 8 of the Hillsdale Estates community and has been contemplated for development since Hillsdale’s establishment in 1995." There are two inaccuracies contained within this one sentence. First, this is not Phase 8 of Hilldale Estates. Hillsdale Estates is a separate entity from Willowbrook and Willowbrook could never be annexed into Hillsdale. Secondly, their original Conceptual Master Plan did not include a Golf Course or Commercial facilities. The following quotes are taken from the applicant's narrative. These are only a few of the many that lead the reader to wonder how a zoning of R2 can accommodate the various uses the applicant is contemplating. Additionally, some of these requests are completely out of the realm of intended uses of the R2 zone, including, bars, restaurants and most other commercial facilities. These facilities would more appropriately be handled under a C1 or Mixed Use zoning classification. Quotes from the updated Narrative. "Only the golf course and golf clubhouse facilities will proceed as the first phase." "This application seeks approval of the golf clubhouse only, which will include a restaurant, bar, and pro shop retail incidental to the golf course use." "The Conceptual Master Plan for Willowbrook includes an 18-hole championship golf course, approximately 1094 single-family detached home sites, and approximately 110,000 square feet of neighborhood commercial and retail space." "As described above, the current application package would annex the approximately 726-acre property with R2 Zoning, and allow only the golf course and golf clubhouse facilities to be built as the first phase of the Project." (including bar and restaurant as noted above.) "The proposed R2 zone is consistent with the applicable Future Land Use Map’s designation of Estate Residential for this property, calling for 1-3 units per acre." (R2 is a maximum of 2 units per acre.) "The integrated mixed uses, all centered around the golf course as the primary amenity ...(The applicant's use of the word "amenity" implies this would satisfy the requirement for having multiple amenties throughout the development. Per Municipal Code 8-4E-2: Standards, E-Maintenance this is not correct.) ---PAGE BREAK--- The applicant appears to be trying to get multiple zoning designations under a blanket R2 zoning by using the Development Agreement process. For the council to consider this would require them to overlook many conditions in the Municipal Code and Comprehensive Plan. For example, restaurants and bars are not permissible use in an R2 zone nor are most commercial uses. See Municipal Code Title 8-3A-3 for more information. For the above reasons and more the City Council should seriously consider postponing the annexation and zoning public hearing until they receive a complete and clear "Master Plan" from the applicant. An entire two weeks prior to the public hearing – before it has even been added to the City’s agenda – before all agency reports are submitted and posted – before the staff recommendation report is posted. Don’t worry. You can still submit your letters up to a day prior to the public hearing, May 9, 2023. Today’s deadline ensures the letters submitted today or prior will be included in the council members review packet. Part 1. ---PAGE BREAK--- Willowbrook Master Planned Golf Community It’s all about the roads. How will the Willowbrook project affect the citizens of Star? The TIS (Traffic Impact Study) states that multiple roads, including Beacon Light, Floating Feather, Star Road, Plummer, Pollard, Can Ada, the existing portion of Wing Rd and others will need to be mitigated beyond what the agencies have planned to do. The TIS indicates no mitigation to these roads will be required until full buildout of the project, anticipated to be 2045. *Roads that would need to be mitigated due to Willowbrook development (Assuming Arie and Wing Roads are constructed): · Beacon Light Road and Pollard Road – Multilane roundabouts/traffic signals – UNFUNDED. · Beacon Light Road and SH16 – Still under consideration by ITD. · Beacon Light Road and Palmer Lane – Multilane roundabouts/traffic signal – UNFUNDED. · Star Road from Hwy 44 to Floating Feather – Expand Star Road to five lanes with roundabout at Floating Feather. Star Road has only been planned to be a three-lane road in this section. The impact on this road by Willowbrook will require it to be expanded to five lanes. This plan is in direct conflict with existing facilities on this road, including Star Elementary, Skate Park, LifeSpring Church and several residences. This expansion is not planned and is UNFUNDED. · Floating Feather between Star Road and Plummer – widen to five lanes – UNFUNDED. · Floating Feather between Plummer and Pollard – widen to three lanes – Funded in 2036- 2040. · Pollard Road (between Beacon Light Road and Floating Feather Road) – widen to three lanes – UNFUNDED. *The above data was collected from the original TIS, which has since been deleted from the City of Star website for Willowbrook and replaced with an updated TIS. In the original report, the required improvements to the streets mentioned above were shown to be unplanned and unfunded. The revised TIS, which comes to the same conclusions with the need to expand these roads beyond what has been planned for, now no longer states that they are unfunded (or FUNDED). We will leave that to your interpretation. · Can Ada – New Hope to Purple Sage – In reading the TIS you will notice that the mitigation required on Can Ada is not fully analyzed. In the TIS, this segment of Can Ada will need to be expanded to handle the traffic from Willowbrook (approximately 40% of the expected 13,000- 14,000 additional trips per day from the Willowbrook development). The main issue with Can Ada, however, is the steep hill starting at New Hope and going northward towards Lanktree Gulch. Kittleson (TIS authors), ACHD, and CHD4 are aware this road cannot handle additional traffic but have not yet come up with a solution for re-routing this portion of Can Ada to handle the additional traffic coming from Willowbrook. Additionally, the portion of Can Ada from New Hope to Highway 44 will require additional right-of-way that they have not yet secured. So… what does all this mean to the residents of the City of Star? The Willowbrook Development Agreement, the binding contract between the City and the developer, has no stipulation in it for the developer to pay for any of these off-site roadway expansions mentioned above. However, in the ACHD Policy Manual, 7203.2 Exceptions to Usual Performance Requirements, it reads: ---PAGE BREAK--- “If a proposed development involves a land use of scale or nature that exceeds the traffic capacity of the adjacent system or presents an unreasonable financial burden on the District, the development standards may be increased. The District reserves the right to set standards, require additional improvements, or require extraordinary impact fees related to the scale of the proposed project and the capacity limitations of the existing facilities. (See Section 7300.)” Therefore, the City of Star should be requiring Willowbrook to fund in whole or in “large part” these improvements. If not, the citizens of Star will end up with many roadways that are inadequate for the volume expected on these roads or will have to foot the bill to pay to expand them. For the above reasons and more the City Council should seriously consider postponing the annexation and zoning public hearing until they receive a complete and clear "Master Plan" from the applicant spelling out how these road issues are going to be handled. Unfortunately, when you start with a sloppy and incomplete application you end up with studies and analysis that are incomplete and unclear. The issue of the roads was first officially addressed at the neighborhood meeting. Many who attended spoke out about their concerns about whether the roads could handle that much traffic. Unfortunately, the applicant did not bring that concern to the City of Star as they were required to do at the time they filed their application. If the applicant had, perhaps the city could have gone into the “Roads Workshop” a bit better informed. Without knowledge of this major concern and without a true understanding of the unique infill nature of this project the city gave incomplete instructions to Kittelson to only study the roads outlying the development. So, the local roads which play an integral part in providing access to the Willowbrook development were ignored. The application also lacked any specific detail on the nature of the commercial businesses that are being contemplated so it would not be possible for Kittelson to evaluate the amount of traffic that the 110,000 square feet of commercial space would generate. Somehow the number used by Kittelson was only 75,000. In Kittelsons defense for the numbers error, I’m thinking they were a bit confused about the entire application as it is a very unusual to submit a R2 zoning request that includes a golf course and a whole bunch of commercial, including a restaurant and a bar. Kittelson also seemed a bit unclear about what the first phase of the development included. Was it just the golf course, sports shop and bar or does it include the 240 some odd houses and 40 or so townhomes the application seemed to be including in the first phase. When ACHD finally got the final revised TIS there was no way that ACHD could come to any kind of accurate summary and recommendation to mitigate the numerous adverse impacts this development will have on not only the unimproved, non-compliant local rural roads that are going to be mixed in with this urban style mixed use development that spans across nearly the entire northern part of Star, but also numerous roads within Star as discussed in our prior message Roads, Roads, Roads part 1. Please read through the TIS, CHD4 and ACHD reports found on the Star website We will give a more in-depth look at the ACHD report shortly. Willowbrook Master Planned Golf Community 1000 in 10 Our stated goal leading up to the Willowbrook Public Hearing for annexation and zoning, which happens 10 days from now, is to get 1000 people to either (or both) sign the petition and/or attend the Public Hearing. We currently have just under 500 signatures and this week will be the big push. We will be canvassing neighborhoods to spread the word. Any assistance you can give would be appreciated. We are not trying to stop the development but rather are asking the city to follow the vision so that we can trust the process. What does that mean? The slogan: "follow the Vision", "Trust the Process" is found on the back wall of the city council chambers pointing at the audience of citizens. Perhaps it should be on the wall behind the audience to serve as a reminder to the city leaders of their ominous task. The “Vision”. Quite simply is the Comprehensive Plan and in a nutshell is spelled out in Chapter 3 of the Comprehensive Plan.. Chapter 3 - Vision As development occurs the community wants to protect, preserve, and enhance open spaces, the Boise River, and the steep slope areas generally to the north. The community does not want Star to become a “Stack and Pack” metropolitan city but wants to strive to retain its small-town family friendly character while growing a strong commercial base and vibrant downtown. Star acknowledges that it will continue to grow as the Treasure Valley grows, but Star’s growth is to be a unique balance of environmentally sensitive urban and rural development. Urban development will be directed to our downtown, activity centers, and on lands with grades compatible for urban development as well as along regionally significant transportation corridors. The city will work in cooperation with landowners and local agencies to plan for and preserve rural planning areas in which large lot residential and agricultural uses continue in appropriate locations. The city will balance development with environmental stewardship, especially along the Boise River and in the steep slope areas. The Process This is where the concern lies. For nearly 5 years Willowbrook has attempted to thwart the will of the people as outlined in the Comprehensive Plan by submitting various ideas for building out 1500 acres of land in the foothills. Each time they have had to go back to the drawing board for various reasons. One would think that the applicant would take heed of the obstacles they have faced and change their plans to not only fit within the Vision but also consider the ---PAGE BREAK--- obstacles he himself has created on the land surrounding the property he now wishes to develop. But instead, they went from a R3 request on all his land to just R2 on half his land stuffed in around a golf course and also added 110,000 square feet of commercial space. All of this in a designated R1 zone as spelled out in the Comprehensive Plan. They are trying to be grandfathered into a prior Comp Plan which would have allowed for R2. Not sure how that pans out legally, but it still does not address the problems with the local roads. But it’s not all the applicants’ fault. He is just trying to maximize his profit, regardless of how it will affect the surrounding neighborhoods, how it will affect all the citizens of Star, including overwhelming the roads and schools. These points have been discussed in prior posts from various members of the community and will be dealt with in additional posts throughout the week. Part of their reason for not “getting it” is probably partly because the city has not firmly stood by the process and demanded a complete application with all the necessary details. After all these years they still are lacking just the basics required under the Municipal Code. Just on the most basic level they have not included elevations of the commercial facilities they are contemplating, there are no exterior elevations of the rears of homes that back up against collector roads. They have simply not given any specific detail about this master planned community. Details they know they have to show. Where are the amenities, the pathways The adherence to the Special Transition Overlay Zone? This is a “Master” plan? Also lacking in necessary information is the TIS. The TIS fails to address the local roads this development will surround and must use to gain access to this new development. But this missing piece of the puzzle is not the doing of the applicant. The city instructed the TIS will include only the roads/intersections outside the immediate area of the development. Because of this “oversite” the TIS does not give the entire picture of the adverse effects this development will have on the unimproved, out of standards rural roads. This has made it impossible for ACHD to give an accurate assessment report to the city about all the adverse effects this development will have on the roads. More details on the ACHD and subsequent amendment they have made will be discussed in the week ahead. But here we are for now. It is what it is and come May 9 it will be up to the people to ensure the City council follows the Vision so that we can trust the process. But for that to happen we need an overwhelming turnout. So please sign the petition and/or attend the public hearing meeting. You don’t even need to speak but it would be great if you did. Page 15, ACHD Review Letter, summarizes the impact this development will have on the community if the mitigation of the roads is not required. “To accommodate the future traffic impacts, the city may need to consider a revision to the land uses, request a change to the MSM (Master Street Map) to accommodate the future traffic impacts from the preliminary plats within the development, or accept high levels of traffic congestions in area of the city impacted by the traffic generated by the Willowbrook Master Planned Community.” Also review the letter from the West Ada County School District, Page 11. If so, you may want to read the public testimony guidelines, which can be found on the City of Star website Public Hearings I Star, Idaho (staridaho.org) to help you prepare. Maybe consider writing down everything you want ---PAGE BREAK--- to cover. Take some time to practice. If your speech (reading) is going to take more than 3 minutes make a list of the most important facts you want them to hear and then give the council a copy of your entire speech. Have 7 copies of your speech to hand out. PUBLIC TESTIMONY GUIDELINES • Focus on the Facts - It is the applicants’, representative, and/or public's responsibility to persuade the decision-makers to vote or decide in favor of your request. It will not help your cause to anger, alienate or antagonize the decision-makers that are listening to your presentation. Complaints are usually a poor use of time and do not aid in a timely and fair decision-making process. • Know the Law and Be Well Informed - Officials are not likely to make decisions in violation of county or state codes. No amount of passion, persuasion, or pleading will accomplish this task. Research the subject/application request and past decisions before you plan your testimony. The applicant or member of the public may request a copy of the staff report, public/agency response letters, and other pertinent information regarding the subject application, prior to the hearing. • Discuss the Application with the Planning and Zoning Administrator -The P&Z Administrator is available by appointment to discuss the application in advance of the hearing. • State your Request Clearly - The decision-makers want to know the details of what they are being asked to approve. Be careful to include ALL information regarding your request. • Speak to the Point - The hearing body is grateful when the testimony is pertinent, well organized, and directly relates to the application request. One person may speak for several members of the public with the same opinion. Provide the decision makers or P&Z Administrator with a list of names and addresses of all persons with the same opinion(s). Long stories, personal philosophy, and what Aunt Sophie said at dinner last night (hear-say) are not decision-making facts. • Be Confident - Testimony is not required to be given by a professional engineer, developer, or planner. All non-repetitive, public testimony is welcomed at the Public Hearing. • Be Reasonable - The decision makers must consider all pertinent and factual points of view, interests, proposals, and facts. The decision makers will seek the best course for serving the overall public good. It is the speakers’ obligation to present the speakers’ in interests. However, remember that there is always other legitimate competition. Be prepared to compromise, if necessary. • Testimony May Be Submitted To the City in Writing - At most hearings, all testimony is reviewed by the decision making body with assistance from staff. If written testimony is specific, to the point and concise, it will be given as much attention as oral testimony, especially if the decision-makers have more time to review your written comments. By necessity, oral testimony has time limits so that more people can speak. Written testimony has no length limitations. It may be effective to summarize your testimony orally in 3 to 5 minutes and then submit the details in writing.
