1 Star City Council Meeting Minutes September 3, 2013 The regular meeting of the Star City Council was called to order at 7:00 pm at the Star City Hall, 10769 W. State Street. Council President Tammy McDaniel called the meeting to order and all stood for the Pledge of Allegiance. Roll Call: Council members Tom Erlebach, Gary Smith, Tammy McDaniel and Chad Bell were all present. Mayor Nathan Mitchell was absent. Approval of the Agenda: Erlebach moved to approve the agenda, Smith seconded the motion. All aye: motion carried. Consent Agenda: Bell moved to approve the Consent Agenda consisting of Claims Against the City for August 2013, Regular Meeting Minutes of August 6 and August 20, 2013, Erlebach seconded the motion. All aye: motion carried. Public Input: Council President McDaniel stated there were several people wanting to comment on the Sundance Conditional Use Permit. She stated she appreciated the fact that they wanted to give input, but the public hearing was closed and the Council tabled the decision at the last meeting with the direction to the applicant to obtain an agreement with the highway districts. Public - Kelsi Tackitt, 864 N. Star Road, stated she and her friend ride their horses on the River Walk and they want to put a rubber mat on the bridge because it is slick. McDaniel stated that the Council would take it under advisement and asked that the applicant look into the cost. Irene Wilson stated that Blake Trailers will give them a quote. Councilman Erlebach asked them to stay off the grass with their horses. Gail Glasgow, 259 Mira Avenue, would like to address issue of horses going through the subdivisions, and the kids riding in the common areas and he is concerned about the damage being done. Dr. Crane stated that the Church did not receive a notice about the Sundance Conditional Use Public Hearing. City Clerk, Cathy Ward stated that a notice was sent to the church and nothing has been returned. Bell stated the decision on the roads was between Knife River and the highway districts. Old/New Business: Knife River Conditional Use Permit - McDaniel reviewed the public hearing. Smith stated he was not present at the last meeting and needs to get up to speed. McDaniel restated the request to extract gravel by Knife River. Bell stated that the application that was presented was tabled with instructions for Knife River to go to ACHD/ITD to work out an agreement on the roads. Dave Szplett, Idaho Transportation Department, stated that is a public road currently as it was built with public monies as part of mitigation with Mr. Anderson. The intention was to give ---PAGE BREAK--- 2 ownership of the road to Ada County Highway District to become a local road. However, was not built to accommodate the heavy gravel trucks. The agreement between Knife River and ITD will be that Road will be given to the applicant. Bell explained to Smith about the roads, ownership, and the fact that the City has no jurisdiction on roads, they belong to ITD and ACHD. We have no authority on roadways; all we can do is put conditions on the gravel excavation and have the applicant follow regulations of other districts. McDaniel stated that options are to condition the conditional use permit to have the applicant sign agreements with ACHD and ITD and include the other conditions per staff report. Bell moved to approve the Conditional Use Permit with the stated conditions of approval, Erlebach seconded the motion. Bell stated that he doesn’t mean to be short on the subject. This doesn’t mean we don’t care or aren’t listening; we are putting conditions on the applicant for them to comply. Bell knows all the concerns, but the roads are not something we have control over. We have a procedure by law that we are required to follow. We have limited them to the conditions of approval. All aye: motion carried. Flood Ordinance Review – Ordinance No. 232 – McDaniel reviewed the discussion from last meeting. Bell moved that pursuant to Idaho Code 50-902, the rule requiring an Ordinance to be read on three different days, with one reading to be in full, be dispensed with and that Ordinance No. 232 be considered after reading once by title only, Erlebach seconded the motion. All aye: motion carried. Bell moved to approve Ordinance No. 232, an Ordinance of the City of Star, Idaho, a municipal corporation of the State of Idaho, amending Star City Code Title 10, “Flood Control”, Chapter 1 “Flood Control Regulations”, Section 10-1-5: Rules and Definitions; providing a repealer clause; providing for severability; and providing an effective date, Erlebach seconded the motion. Roll Call: Elrebach, Smith, McDaniel, Bell – all aye: motion carried. Reports: Staff – Staff had nothing to report. Council – Smith stated that the District 14 meeting had been cancelled. Bell stated that he attended the Valley Regional Transit meeting. They are talking about more ventures. Their fleet is all moving to natural gas vehicles. McDaniel stated that she just reviewed the bills. Adjourn: Bell moved to adjourn the meeting, Erlebach seconded the motion. The meeting was adjourned at 8:15 pm.
