Box 780 MA 01940 RE: 57 Marlborough Rd- Osborne Hills Subdivision Modification Decision for the Preliminary Subdivision Plan for Osborne Hills Subdivision – Form B Dear Mr. DiBiase: On January 9, 2020 and January 23, 2020, the Salem Planning Board held public meetings to discuss the preliminary subdivision plan submitted by Paul DiBiase/ Osborne Hills Realty Trust for the modification of land located in Salem, MA currently shown as Phases 6, 7, 8, 9, and 10, comprising lots 88 through 131 of the “Definitive Subdivision of Osborne Hills Realty in Salem, Massachusetts” as approved under the subdivision control law by the Salem Planning Board dated November 2, 2006. On January 23, 2019, the Planning Board voted by a vote of nine in favor (Chair Ben Anderson, Kirt Rieder, Matt Veno, Helen Sides, Noah Koretz, DJ Napolitano, Bill Griset, Matt Smith, and Carole Hamilton), and none opposed, to approve the preliminary subdivision plan with modifications based on the following information: 1. The Board strongly suggests that the applicant provide and document a second means of egress for this subdivision. 2. That the applicant moves forward into the definitive stage with a plan in keeping with the plan submitted to the Planning Board and entitled, “Preliminary Cluster Subdivision Plan Modification of Strongwater Crossing Formerly Known as Osborne Hills, Salem, Massachusetts,” and dated December 10, 2019. 3. The preferred layout for the subdivision of this parcel shall meet the requirements of the Cluster Residential Development Special Permit, because such a layout will promote more efficient use of land in harmony with its natural features and will protect and promote the health, safety, convenience and general welfare of the inhabitants of the city. 4. The Board recognized that as proposed in this preliminary application, the building lots and the buildings to be constructed thereon have dimensional controls and density ---PAGE BREAK--- Planning Board Decision 57 Marlborough Road/Osborne Hills – Form B/Preliminary Subdivision Approval February 10, 2020 2 regulations varying from those otherwise permitted by the ordinance or by-law and that subsequent variances from the Zoning Board of Appeals will be required. 5. That the project shall ensure the permanent protection of open space through restrictive covenants and any other proper restrictions deemed necessary. 6. The applicant shall clarify, in a definitive plan, the language from “Section 9.03- Conservation Restriction” from the “Declaration of Covenants, Easements & Agreements Relating to Open Space and Common Parcels, Homeowners Association and Other Amenities for Strongwater Crossing, Salem, Massachusetts” dated October 4, 2007, to say that “the developer or the association may transfer ownership of the open space to the City of Salem.” Furthermore, the Salem Planning Board requests that the following information be submitted with the application for a Cluster Residential Development Special Permit (This information is in addition to the required information for submitting a Cluster Residential Development Special Permit): 1. Information showing that proposed changes to the site drainage comply with all stormwater management regulations and does not drain onto abutting properties. 2. Information on how open space will be protected and preserved. 3. Confirm that the crossing of resource areas does not include perennial streams, and if the crossing does occur over a perennial stream, confirm that the crossing meets the Massachusetts River and Stream Crossing Standards. 4. Consider meeting the stream crossing standards to maximum extent practical even if not a perennial stream. 5. Confirm that cut/fill will not result in moving water/runoff from one riverine network to another; or trapping stormwater.
