CIVIL CASH DEPOSIT – WARRANTY ASSURANCE Page 1 of 2 Development Engineering Division Receipt No.: Project Name: Permit No.: Building Permit No.: CITY OF REDMOND RECEIPT FOR CASH DEPOSIT – WARRANTY SECURITY ASSURANCE For Improvements The City of Redmond, Washington, hereinafter “the City”, hereby acknowledges receipt from of the amount of which shall be held by the City without interest for the purpose of guaranteeing that the improvements made in connection with construction of the project known as , located at , shall remain free of defects in materials, workmanship, and installation, and in the case of landscaping shall survive, for a period of ONE year(s) from the date of written acceptance by the City. These improvements include, but are not limited to: If, in the sole determination of the Planning Director or a designee of same, hereafter “the Director”, the above-referenced improvements prove to be defective with respect to materials, workmanship, installation, or in the case of landscaping, shall fail to survive for the period referenced above and, if after written notice of such defect of failure to survive, the same is not corrected with the time established by the Director, all rights to reimbursement of this cash bond shall be forfeited to the City. Provided further that should said defects result in replacement, and should the City exercise its discretion to arrange for immediate repair or replacement from an independent source, and if the City is not reimbursed for the emergency repair or replacement expenses and costs associated with the, as specified by the City within the time established by the Director, all rights to reimbursement of this cash bond likewise shall be forfeited to the City, notwithstanding the fact that no notice of such defect or failure to survive was given prior to such ---PAGE BREAK--- CIVIL CASH DEPOSIT – WARRANTY ASSURANCE Page 2 of 2 repair or replacement. Otherwise, at the expiration of the warranty period and satisfactory completion, as determined by the Director, said cash shall be returned without any interest accrued to the entity or individual posting said cash. Forfeiture of the cash deposit as herein provided shall be in addition to all other rights and remedies granted by law, equity or contract to the City to seek reimbursement of damages incurred or to enforce the provision of any such contract as referenced herein.
