As I noted in the call, we are concerned that the off-site stream may be incorrectly classified and may in fact be capable of providing salmon with habitat if the stream were accessible. This is based on other nearby projects where the streams in question were determined to meet the physical criteria from WAC 222-16-031 for presumed fish habitat. In fact, King County DOT is replacing a culvert under NE 124th just east of this site (see attached plans) and is in the process of obtaining permits to do this work. The stream needs to be assessed to see if it meets the physical criteria from the WAC and the WA Forest Practices Board Manual 13. I suggest we have a site visit to make this determination so that we can verify the stream’s classification before going further with project impact assessments. Also, it should be noted that WDFW has info in Salmon scape (http://apps.wdfw.wa.gov/salmonscape/map.html#) that suggests the stream is potential fish bearing and the culvert under NE 124th is a partial fish passage barrier (Culvert ID #932274) This is an important question to be resolved for this project, future expansions at this site and any other parcels adjacent to this stream. Stream classification of offsite stream The CAR notes there is a stream offsite and has classified this stream as a non-fish bearing stream. We disagree. King County’s IMAP shows this stream as a Type 2 fish bearing stream. Given its connectivity to a known fish bearing stream north of NE 124th, it is very likely that the stream does or can support salmon. If the applicant has data to suggest otherwise, it should be provided for review. Assuming the stream is fish- bearing or potential fish-bearing, the project needs to ensure that it will not be impacting this stream or its regulated buffer. ATTACHMENT 4 ---PAGE BREAK--- King County’s iMap identifies the stream located at least 475 feet east of the currently proposed development as an “Unclassified” stream, that crosses under NE 124th Street through a series of culverts and ditches before connecting with the Class 1 Stream to the west, and is not classified by King County as fish bearing. Please see attached figure. Also, the proposed development is separated from the “Unclassified” stream by a parking lot and existing development and will have no impact on the stream. Additionally, the buffer for the “Unclassified” stream is 150 feet; all proposed development, conceptual or approved, is located outside of this buffer (See attached figure). BMPs and erosion control measures proposed for the project will also ensure that the proposed development will have no impact on the stream. 2. With respect to the onsite wetlands and their proposed filling, the applicant should work with WDOE and the US Army Corps of Engineers to ensure that they agree these wetlands are not subject to regulations under the Clean Water Act. The state and federal agencies determinations may differ from Redmond’s findings and regulations. Based on a review of the City’s code, historic aerial views in Google earth, which show development and creation of the wetlands onsite, and because the low value habitat wetlands are isolated and not hydraulically connected to any water of the state, it has been determined that the manmade wetlands delineated onsite were created by development and are therefore manmade and not considered jurisdictional. We appreciate the opportunity to review this proposal and look forward to the City of Redmond’s responses.
