BEFORE THE HEARING EXAMINER FOR CITY OF REDMOND In the Matter of the Appeal of ) NO. ) ) WPDC Cleveland LLC ) Origins Appeal ) ) of approved Permits ) BLDG-2016-09802/BPLN2016-02092 ) Order Striking Hearing Date Authorizing Tenant Improvements and ) and Staying Appeal Change of Occupancy for the structure at ) 16390 Cleveland Street, Redmond ) Issued February 17, 2017 ) Since the original pre-hearing conference, the Applicant in the above-captioned applications applied for a revision to the approved building permit under appeal. The application for building permit revision was approved May 19, 2017, rendering the appeal of the previous building permit (though not necessarily change of occupancy permit) moot. Because the revised permit's 14-day appeal period expires June 2nd, the May 31, 2017 date reserved will not work for reconvened pre-hearing conference or for hearing and will be stricken. It is necessary to reconvene the pre-hearing conference after the appeal period is over on the revised permit. On Tuesday May 23rd, the parties were informed of the examiner's intent to strike the May 31st date and stay the appeal pending the conclusion of the appeal period on the revised permit in order to allow the parties to respond with questions relevant to status/process, and also to identify the best date for reconvening. Based on communications through the Hearing Examiner Clerk, June 22, 2017 has been determined the best date. ORDER 1. The appeal is stayed and the May 31, 2017 hearing is stricken. 2.
