Order Dismissing Appeal City of Redmond Hearing Examiner Origins Appeal, BLDG-2016-09802/BPLN2016-02092 page 1 of 1 BEFORE THE HEARING EXAMINER FOR CITY OF REDMOND In the Matter of the Appeal of ) ) WPDC Cleveland LLC ) Origins Appeal ) ) of approved Permits ) BLDG-2016-09802/BPLN2016-02092 ) Order Dismissing Appeal Authorizing Tenant Improvements and ) Change of Occupancy for the structure at ) 16390 Cleveland Street, Redmond ) Issued February 17, 2017 ) The above-captioned appeal was heard on August 2 and August 4, 2017. At the conclusion of proceedings, a post-hearing submission schedule was established. The schedule allowed rebuttal evidence from the Appellant in response to an Applicant exhibit, due by August 10th, and allowed response from the Applicant and City to the rebuttal by August 15th. Post-hearing legal argument was requested to be submitted by August 22, 2017. The decision was scheduled to issue on September 6, 2017. On August 17, 2017, the parties submitted a stipulated stay of proceedings to allow for settlement discussions. The stipulation proposed extension of the post-hearing briefing deadline through September 1, 2017, which resulted in a decision deadline of September 18th. On August 30, 2017, counsel for the Applicant alerted the Hearing Examiner Clerk that the parties appeared to have reached agreement, which they hoped would be executed by September 1st. On September 1, 2017, counsel for the Appellant indicated that settlement had been finalized. The Appellant withdrew the appeal. Order The appeal is dismissed. Issued September 5, 2017. By: Sharon A.
