Appellant's Exhibit 36 (as referenced in June 30, 2017 Appellant WPDC Cleveland LLC's Witness and Exhibit List) ---PAGE BREAK--- Appellant claims that, the Project Site is located within 1,000 feet of the "City's Downtown Park playground": a) Per the WAC, the definition of "playground" means, a public outdoor recreation area for children, usually equipped with swings, slides, and other playground equipment, owned and/or managed by a city, county, state, or federal government. b) There will not be any playground equipment on site. There will be, per the City's website, "fountains of water jets - fun for the kids!" c) The City has the site designated as a public park (please see PDF attached) which is consistent with the state's definition of park. d) Per the RZC, a marijuana retailer cannot locate within 100 ft. of a public park. When measured using Property Viewer, the project site is approximately 596 ft. away from the park and outside the required buffer. aNg-saovsT i. (south property line) and 1,106 ft. (west property line) away from the school and outside the required 1,000 ft. buffer.
