All aspects of the petition for and creation of any Special Capital Improvement District and of the undertaking and funding of any corresponding Qualified Capital Improvement Project to make Qualified Capital Improvements are governed by applicable provisions of the Code of Ordinances of Pickens County, Georgia. 2. The filing of an application for a petition, the submission of a preliminary petition or the submission of a final petition nor the expenditure of funds in furtherance of any application or petition shall not establish any rights in favor of the Applicant or in favor of any Affected Property Owner with regard to any duties or obligations of Pickens County, its Board of Commissioners, its other officials, or its employees. 3. The Public Works Director is authorized to require Applicants to supplement their preliminary petition by providing, at the Applicant's own cost, any additional information, studies, reports, or plans deemed necessary by the Public Works Director as a condition precedent to further consideration of an application, preliminary petition or final petition. 4. The Public Works Director retains the sole discretion to determine what information, studies, reports, and plans are required for each proposed Qualified Capital Improvement Project on a case-by-case basis. 5. The Public Works Director retains the sole discretion to prioritize applications and petitions for the creation of any Special Capital Improvement District and the undertaking of corresponding proposed Qualified Capital Improvements considering various relevant factors determined by him or her. 6. Only a publicly-owned Qualified Capital Improvement Project shall be eligible to be conducted in a Special Capital Improvement District. Qualified Capital Improvements must be constructed on public property in order for the Qualified Capital Improvement Project to be eligible to be conducted in a Special Capital Improvement District. 8. No proposed Qualified Capital Improvement Project shall be considered by the Board of Commissioners until the private property necessary to complete the proposed Qualified Capital Improvement Project is offered for dedication to Pickens County by the applicable Affected Property Owners in writing and in the form and manner required by the Public Works Director. 9. The Board of Commissioners retains the sole discretion as to: Whether any Special Capital Improvement District shall be created; What Qualified Capital Improvement Project will be undertaken therein; What Qualified Capital Improvements will be made therein; and What funding sources will be used to fund the project, including to what degree and in what amount special fees, assessments and/or ad valorem taxes will be levied on the Affected Property Owners. An Applicant may petition for the creation of a Special Capital Improvement District pursuant by filing an application for a Preliminary Petition with the Public Works Director. Note: “Affected Property Owner” means an owner of a property lying within a proposed Special Capital Improvement District put forward by an Applicant or within a Special Capital Improvement District created by the Board of Commissioners. “Applicant” means an Affected Property Owner who petitions for the creation of a Special Capital Improvement District. “Qualified Capital Improvement Project” means a project undertaken to make Qualified Capital Improvements to public property in a Special Capital Improvement District which is funded, in whole or in part by special fees, assessments and/or ad valorem taxes levied on Affected Property Owners. “Qualified Capital Improvements” means capital improvements with a useful life of ten (10) years or more, made by new construction or other action, including road paving, road surfacing, sidewalks, curbs, gutters, stormwater control structures, water lines, traffic control devices, and lighting fixtures, but not including sanitary sewers. “Special Capital Improvement District” means a district created by the Board of Commissioners comprised of residential parcels within an existing residential subdivision or comprised of property lying within a discrete and definable land use intensity district used for purposes other than residential use, in which Qualified Capital Improvement Projects are undertaken to make Qualified Capital Improvements. 2. If the Public Works Director determines that the application is complete, he or she shall develop a preliminary cost estimate for the proposed Qualified Capital Improvement Project and provide to the Applicant, within forty (40) calendar days of the receipt of the application, the preliminary cost estimate and the Preliminary Petition to be completed by the Applicant. The Applicant shall then have forty (40) calendar days from the issuance of the Preliminary Petition to complete the Preliminary Petition by obtaining the signatures of at least eighty percent (80%) of the Affected Property Owners and to return the completed Preliminary Petition to the Public Works Director. 4. Upon the timely return of the completed Preliminary Petition, the Public Works Director shall verify the required signatures and determine whether the proposed project will require additional preliminary steps prior to the issuance of the Final Petition, including, but not limited to, the dedication of necessary private property, the completion of preliminary studies, reports, or plans and the procurement of additional cost estimates. 5. After the verification of the signatures of Affected Property Owners and the completion of any required additional preliminary steps, the Public Works Director shall issue the Final Petition to the Applicant, if all requirements concerning the Preliminary Petition are satisfied. 6. After the issuance of the Final Petition, the Applicant shall have forty (40) calendar days to obtain the signatures of at least eighty percent (80%) of the Affected Property Owners on the Final Petition and to provide the completed Final Petition to the Public Works Director. 7. As soon as possible after verification of the signatures on the Final Petition, the Public Works Director shall submit the Final Petition to the Board of Commissioners together with estimated costs, construction timelines, funding details and any other information and recommendations as the Public Works Director may deem appropriate. 8. As scheduling allows, the Board of Commissioners shall consider the Final Petition and exercise its sole discretion as to whether the proposed Special Capital Improvement District will be created, what Qualified Capital Improvement Project will be undertaken and what funding sources will be used to fund the project, including to what degree and in what amount special fees, assessments and/or ad valorem taxes will be levied on the Affected Property Owners.
