Plans and specifications previously submitted may thereafter be returned to the applicant or destroyed by the Building Official or City Engineer. The Building Official or City Engineer may extend the time for action by the applicant for a period not exceeding six months beyond the one- year limit upon written request by the applicant showing that circumstances beyond the control of the applicant have prevented action from being taken and upon payment of an extension fee equal to 25 percent of the plan check fee. No permit application shall be extended more than once. Once an application has expired, the applicant shall resubmit plans and specifications and pay a new 100% plan check fee. 25% of plan check fee 25% of plan check fee C. Electrical Code Permit and Plan Check Fees Except as otherwise provided in the PAP, at the time of filing an application a fee shall be paid to the City of Palmdale as set forth in this Section. The following fees shall include all wiring and electrical equipment in or on each building, or other electrical equipment on the same premises constructed at the same time. For garages, carports, and other accessory buildings, used in conjunction with multifamily residential buildings use BRANCH CIRCUIT FEE OR UNIT FEE SCHEDULE. For garages, carports and other minor accessory buildings constructed at the same time as single or two-family residential buildings, a fee will not be required. For other types of residential occupancies and alterations, additions and modifications to existing residential buildings, use BRANCH CIRCUIT FEE OR UNIT FEE SCHEDULE. Plans shall reflect laws and ordinances in effect at the time a permit is issued except as provided herein below in this section. Nothing in this section shall prohibit modifying the permit set of plans to reflect changes in laws and ordinances, which have become effective since the approval of the standard plan. The standard plans shall become null and void where the work required by such changes exceeds ten percent of the value of the building or structure. When it is desired to use an approved “standard plan” for an identical structure, two plot plans and one duplicate plan shall be submitted and a plan checking fee equal to 70 percent of the full plan checking fee required above shall be paid at the time application is made for such identical structure . Such duplicate plans shall be compared, stamped and kept on the project site. In case of deviation from this standard plan, except as permitted in this section, complete plans, together with a full plan-checking fee, shall be submitted for the proposed work. A plan checking fees shall be paid when the plans are submitted for review. With respect to the work described below wiring shall not be installed, nor any other work for which a permit is required shall be done, until the plans have been approved. Only after the plans have been approved may the applicant apply for an electrical permit for such work. CC 2021-057 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALMDALE RESTATING IN ITS ENTIRETY THE PALMDALE FEE SCHEDULE AND REPEALING RESOLUTION NO. CC 2020-074 WHEREAS, the City Council has determined that City staff provides many types of services involving requests by City customers (“Applicants”); and the City imposes service fees (“Service Fees”) and development-related fees (“Development Fees”) upon Applicants to recover the costs of staff time, and other expenses related to providing these services; and WHEREAS, current Service Fees and Development Fees charged for the City’s Services do not adequately recoup the City’s costs of providing certain Services and thus, a significant amount of these costs are currently paid out of the City’s general fund and, therefore, borne by the general public; and WHEREAS, the City Council finds that providing these Services is of special benefit to Applicants both separate and apart from the general benefit to the public; and therefore, in the interests of fairness to the general public, the City desires to better recover the costs of providing these Services from Applicants who have sought the City’s services by revising its schedule of City-Wide Fees; and WHEREAS, the City desires to adjust certain fees up to the actual costs incurred to the City in providing these services; 1. Adopt Resolution No. CC 2021-057 to Authorize a Citywide Fee Increase of 3.6 Percent Based Upon the Consumer Price Index (CPI), from April 2020 to April 2021, Effective July 1, 2021 for certain departments; 2. Authorize the proposed fees and charges for code enforcement, sewer, public works grading plan check and permit fees; 3. Authorize the proposed rates for Planning, Engineering, Building and Safety, in a biennial phase approach; WHEREAS, notice of public hearing has been given pursuant to Government Code Section 6062a, and written notice has been provided to interested parties who filed written requests for mailed notice of meetings on new or increased development- related fees or service charges; and Page 47 of 50 ---PAGE BREAK--- WHEREAS, the City Council conducted a duly noticed public hearing on June 15, 2021 at which time the public was invited to make oral and written presentations as part of the regularly scheduled meeting prior to the adoption of this Resolution; and WHEREAS, at least ten (10) days prior to the public hearing referenced above, the City made available for public inspection information required under Government Code Section 66000, et seq.; and WHEREAS, the City published notice of the public hearing as described above in accordance with Government Code Sections 6062(a), 66014, 66016, 66017 and 66018 for the various Service Fees and Development Fees. NOW THEREFORE, BE IT RESOLVED, THE CITY COUNCIL OF THE CITY OF PALMDALE DOES HEREBY FIND, DETERMINE, RESOLVE AND ORDER AS FOLLOWS: SECTION 1. Repeal Resolution No. CC 2020-074 in its entirety. Unless Federal or State Regulations, or an ordinance of the City prohibits such or prescribes alternate procedures, any person subject to payment of the fees, rates, and charges established hereunder may apply to the City Manager for a waiver or reduction of such fees, rates, or charges. The application shall be made in writing and shall state in detail the factual basis for the request, including a description of the proposed project, program, activity, or other undertaking involved and the extraordinary benefits to the City resulting therefrom which justify the requested waiver or reduction of fees, rates, or charges. The City Manager may consider the application and upon a finding of extraordinary benefit to the City, waive or reduce such fee rate or charge. The determination of the City Manager shall be final and conclusive. SECTION 7. The City Council hereby finds and determines that the existing, new or increased fees, rates, and charges established in this Resolution are in an amount reasonably necessary to recover the costs of providing the service, review, document, facility, or commodity for which such fee, rate, or charge is levied or authorized to be levied. SECTION 8. The new rates, fees, and charges set forth in this Resolution shall become effective July 1, 2021 upon adoption of Resolution No. CC 2021-057 and the City Clerk is hereby directed to email a signed copy of the Master Schedule of Fees for Service to each City department.
