Section ID: Section: Title: Pahrump Town Ordinance - PTO 21 Last Revised Date: 05/07/1986 Description: Pahrump Town Board Service Ordinance NOTICE OF PROPOSAL OF BILL NO. 86-3 PAHRUMP TOWN ORDINANCE NO. 21 - PAHRUMP TOWN BOARD SERVICE ORDINANCE THE PAHRUMP TOWN BOARD finds as follows: WHEREAS, Senate Bill No. 463 was proposed and thereafter passed by the legislature of the State of Nevada during its 1985 legislative session; and WHEREAS, such bill was signed into law by Nevada Governor Bryan; and WHEREAS, such bill is in part an amendment to NRS 269.018; and WHEREAS, such part further defined the term of members of the Town Board within the state of Nevada; and WHEREAS, the Town Board of the unincorporated Town of Pahrump is now bound by such action and may be required to hold such elections; WHEREAS, the Town Board of the unincorporated Town of Pahrump is now bound by such action and may be required to hold such elections; NOW THEREFORE, the Pahrump Town Board, pursuant to the authority of NRS 269.018 and 269.160 inclusive does ordain: Sections: 21.000 Title 21.100 How Elected and For How Long 21.200 Selection and Term of Service 21.000 TITLE. An ordinance to set forth the terms of office of members of the Pahrump Town Board method by which staggered terms shall be set, and setting forth the term of service of the Chairman of the Town Board and Town Clerk. 21.010 SHORT TITLE. This title shall be known as the "Pahrump Town Board Service Ordinance." 21.100 HOW ELECTED AND FOR HOW LONG. The Pahrump Town Board shall conduct an election in the Town of Pahrump on the first Tuesday after the first ---PAGE BREAK--- Monday of November each year to choose the successors of those members of the Pahrump Town Board whose terms expire in the following January. The general election laws of the State of Nevada apply, except for the year, to these elections. The term of office of Pahrump Town Board members is two years. 21.110 NOVEMBER 1986 ELECTION - SPECIAL CASE. Notwithstanding Section 21.100 the term of office of all five members of the Pahrump Town Board elected in the general election of November 1984 shall end in January 1987. Therefore, those desiring to stand for election for the 1987-1988 term shall do so for all five seats in the general election of November 1986. 21.111 STAGGERED TERMS. The Pahrump TOHn Board members elect shall meet on the first Monday in January 1987 and shall select by lot two(2) members to serve one year terms and three members to serve two year terms. 21.200 SELECTION AND TERM OF SERVICE. 21.210 CHAIRMAN OF THE PAHRUHP TOWN BOARD AND PAHRUHP TOWN CLERK. At the first meeting of the Pahrump Town Board each January at which the members elect are seated, the Pahrump Town Board shall choose one of its members to act as the Chairman of the Pahrump Town Board and(1) other member to act as Pahrump Town Clerk. Each shall serve in that capacity for a period of one year. The member serving for one year may assume the same duties in the following year as long as that person shall continue to be a member of the Pahrump Town Board. If either position should become vacant during the one year term of service, for any reason, the Pahrump Town Board shall choose at it's next regularly scheduled meeting one of their members to serve in the vacated position for the balance of the one(1) year term. 21.220 VACATION OF OFFICE DUE TO RESIGNATION OR DEATH. In the event that a Town Board Member shall resign or die during thier unexpired term of office, the Board of Commissioners of the County of Nye shall appoint a registered voter of the Town of Pahrump to fill the balance of the term. Such person shall be selected from a list of no less than three candidates nominated by the remaining Town Board members. Such nominations shall be made during an open meeting within ten (10) days of the vacancy. The Town Board members attending such a meeting shall be considered a quorum regardless of number for the purpose of nominations only. NOTICE IS HEREBY GIVEN that Bill No. 86-3 proposing the adoption of an ordinance to establish how the Town Board Members are elected, the term of their service and; establishing an annual election by the Board of their Chairman and Town Clerk of the unincorporated Town of Pahrump, was proposed and read by title to the Pahrump Town Board at their meeting held on the 8th day of April, 1986. A copy of said bill has been filed with the Pahrump Town Board and the Nye ---PAGE BREAK--- Clerk and is available for public inspection at their offices. A public hearing on the said Bill will be held on the 29th day of April, 1986, at the hour of 8:00 o'clock p.m., at the Pahrump Community Center, at which time further discussion regarding sais ordinance, including public comments, will be held.
