• • Pahmmp Town Ordinance No. 61 REPEAL OF PAHRUMP TO\VN ORDINANCE NO. 5~ AN ORDI~ANCE REPEALING PAHRL!MP TOW'N ORDINANCE NO. 54. PROVIDING FOR SEVERABILITY, REPEAL. EFFECTIVE DATE. AND OTHER f'..lATTERS PROPERLY RELATING THERETO. Whereas, it has come to the attention of the Town Board of the Town of Pahrump that the pnwisions of PTO 54- Pahrump English Language and Patriot Reaffirmation Ordinance of 2006 and has determined this Ordinance should be repealed because of the potential unconstitutionality and enfc1rceability. Additionally, Ordinance 5~ is beyond the authority granted by the federal and state constitutions to an unincorporated town gon:: rnmen t: NOW THEREFORE, THE TOWN BOARD OF THE UNINCORPORATED TO\v N OF PAHRUMP, NYE NEVADA DOES ORDAIN: PAHRUMP ORDINANCE NO. 61 REPEAL OF PAHRUMP TOWN ORDINANCE NO. 54 61.00 PURPOSE OF ORDINANCE. That Pahrump Town Ordinance No. 54, requiring that English be the oflicial language of the unincorporated Town of Pahrump and thereby reaffirming that by so doing \Viii reaffirm the Patriotism of the unincorporated Tovvn of Pahrump providing penalties for violations of the ordinance is of questionable constitutionality and enforceability and is beyond the authority granted by the federal and state constitutions to an unincorporated town government. 61.100 SEVERABILITY. Every section of this ordinance. and every part of each section hereof is hereby declared independent of each other and parts of sections, and the holding of any section or any part thcreofto be voided or ineffective for any cause, shall not be deemed to affect, nor shall it affect, any other section or part of section contained in this ordinance. 61.200 REPEAL. All ordinances. parts of ordinances. or chapters. sections, subsections or paragraphs or resolutions previously adopted by the Pahrump Town Board which are in conflict herev ith are hereby repealed. 61.300 EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage. adoption, and second publication in a newspaper printed and published \\ithin the Tcmn of Pahrump, Nye County. and State of Nevada.
