PAHRUMP TOWN BOARD RESOLUTION NO. 94 R 01 SUBJECT: PROCLAMATION OF SENIOR CITIZEN WEEK APRIL 18, 1994 THROUGH APRIL 24, 1994 WHEREAS, the Town Board of the Town of Pahrump officially recognizes the contributions made by its Senior Citizens to the Town of Pahrump, and WHEREAS, the Town Board of the Town of pahrump wishes to express its appreciation and gratitude to its Senior Citizens for these contributions, and WHEREAS, the Town Board of the Town of Pahrump desires to encourage future and further participation by its Senior Citizens in Town projects, and WHEREAS, the Town Board of the Town of Pahrump is justifiably proud that the Senior Pro Rodeo has selected the Town of Pahrump as the site of one of its rodeo events, and WHEREAS, the Town Board of the time of the Senior Pro Rodeo pay homage and respect to t.he Pahrump. the Town of Pahrump feels that is a fitting and proper time to Senior Citizens of the Town of NOW, THEREFORE, the Town Board of the unincorporated Town of Pahrump does resolve as follows: That the week of the Senior Pro Rodeo event in Pahrump, Nevada, namely, the week of APRIL 18, 1994 THROUGH APRIL 24, 1994, be and hereby is proclaimed to be PAHRUMP SENIOR CITIZEN WEEK. That the Town of Pahrump is a vital growing community which takes pride in its local government operation. 2. That the Town of Pahrump desires to present its local government as representative of the community and professional in nature. 3. That the Town of Pahrump currently houses its administrative functions in rented office space at continued expense to the taxpayers of the community. 4. That the Town of Pahrump would benefit from the building of a Town Office Complex due to smoother operations, higher morale, and a facility which meets the increasing administrative and staffing needs of our growing community. WHEREAS, proper notice was given of the intention to act upon the Resolution Authorizing Short-Term Financing pursuant to NRS 354.618 and Nevada Administrative Code 354.550 through 354.620. Now, therefore, it is hereby RESOLVED that the Town Board of the Town of Pahrump proposes to borrow a sum not to exceed $80,000.00 at an annual interest rate not to exceed 6.15% to be repaid over a period of not more than ten years. The proposes for which the funds are to be used is: Payment for construction costs of a new Town Office Complex of approximately 2000 square feet. The funds will be repaid from the following sources: Annual revenues associated with the Town of Pahrump general government fund (501). The revenues are derived from Ad Valorem taxes; Supplemental City/County Relief taxes; Intergovernmental Sources including gasoline tax, grants from Nye County, and MVPT; Licenses and Permits; and Fines and Forfeitures. It is further RESOLVED that the Clerk forward the necessary documents to the Executive Director, Department of Taxation, Carson City, Nevada. WHEREAS, the revenues of the Pahrump Capital Project-Special Park Fund, Town of Pahrump were budgeted to be $80,000 on July 1, 1993 and WHEREAS, the revenues are now determined to be $83,414 WHEREAS, said sources are as follows: Transfer from general fund 501 Beginning fund balance TOTAL = $80,000 $3,414 $83,414 WHEREAS, there is need to apply these excess proceeds in the Pahrump Capital Project-special Park Fund NOW, therefore, it is hereby RESOLVED, that the Town of Pahrump shall augment its 1993-94 budget by appropriating $3,414 for use in the Pahrump Capital Project-Special Park Fund, thereby increasing its appropriations from $80,000 to $83,414. A detailed schedule is attached to this Resolution and by reference is made a part hereof. D~e November 7, 1994 ---PAGE BREAK--- PETITION AND RESOLUTION FOR EXEMPTION It is resolved by the Board of the Pahrump Swimming Pool District, Nye County, State of Nevada that; Whereas, the Pahrump Swimming Pool District is in current compliance with the Local Government Budget Act, NRS 354.470 to 354.626, inclusive; and Whereas the total expenditures for said District for the fiscal years ending June 30, 1994 and 1995 are not anticipated to exceed $100,000 including debt service: Therefore, it is resolved that the Pahrump Swimming Pool District Board of said District petition the Nevada Department of Taxation for exemption from the following: 1. Filing a tentative budget for the 1995-1996 fiscal year. 2. Filing an independent audit report for the 1994-1995 fiscal year. 3. Publishing requirements of the Local Government BUdget Act, other than the annual publication of a notice of budget adoption and filing. 4. Maintaining accounting records on an accrual or modified accrual basis. Be it further resolved that if said District is granted the above-referenced exemption, that it will comply with the filing of an annual budget on or before April 15, 1995, the publication of a notice of budget adoption and filing of quarterly budget reports, pursuant to NRS 354.475, as well as the filing of an annual Statement of Revenues, Expenditures and Changes in Fund Balance and a Balance Sheet pursuant to NA 354.010. Passed and adopted this 13th day of December, 1994, by the fOllOr 'ng vo~ 0rth~oard of the par?r ~p w' ming Pool District./? rr-cv-?j)~JJac:~J _ ~ L P' . . _ J JiczJ ~ r ~ Ayes: . fl Nays: :BOb iiZ,1£?~ (S gned) December 13, 1994 ---PAGE BREAK--- REL 94-33RHN Resolution No. 94-28 NYE COUNTY BOARD OF CONMISSIONERS BOARD OF COUNTY COMMISSIONERS COUN'l'Y OF NYE, STATE OF NEVADA RESOLUTION PROVIDING FOR THE "NATURAL" MAINTENANCE OF A CERTAIN PORTION OF THE PAHRUMP CEMETERY GROUNDS WHEREAS, the Nye County Board of Commissioners (hereinafter "Board") is cognizant that the present day Pahrump Cemetery, which is mmed by Nye County, is located in the aboriginal lands of the Southern Paiutes and more specifically, the Pahrump Paiute Tribei and WHEREAS, the Board is aware that the Pahrump Cemetery is the final resting place of a great number of Southern Paiutes, including two Southern Paiute Chiefs, and that numerous descendants of these Southern Paiutes still reside in the Southern Nevada areai and WHEREAS, members of the Paiute Tribe continuously have maintained their portion of the Pahrump Cemetery over the yearsi and WHEREAS, the Board has been informed that the gravesites of the Southern Paiute, as t.hey are maintained vII th mounds and natural vegetation, play an integral part in the culture, religion, and traditional beliefs of the Southern Paiutei and ---PAGE BREAK--- · ; WHEREAS, the Board also has been informed that leveling and/or maintaining the graves of the Southern Paiute with a grass covering would be considered a desecration; and WHEREAS, the United states has adopted two laws, the American Indian Religious Freedom Act and the Native American Graves Protection and Repatriation Act which, among other things, provide that American Indians should have access to their burial sites and the full right to Horship through their traditional ceremonials and traditional rites; and I'/HEREAS, the Nevodo Legislature also has adopted lows for the protection of Indian burial sites, at NRS 383.150 ot seq.; and WHEREAS, NRS 383.180 makes it 0 crimo for nnyone to Hillfully remove, mutilate, deface, injure or destroy the cairn or grave of a native Indian; and WHEREAS, the Board has been advised thot segregation of the Pahrump Cemetery purposo of providing an exclusively for the burial of the Southern Poiutes would be a violation of the Civil Rights Act of 1866, as a denial of equal ~u \ utilization of a public facility; and WHEREAS, pursuant to NRS 244.292, the Board has the authority to control and mointoin the Pohrump Cemetery as it deems appropriate; and WHEREAS, the Board has determined that it is in the best interests of the residents of Nye County thot the Pahrump Cemetery not be segregated as to access or utilization, but that a portion 2 ---PAGE BREAK--- - . • thereof continue to be "naturally" maintained, as it has been by the Southern Paiutes, NOW THEREFORE, it hereby is resolved as follows: 1. A portion of the Pahrump Cemetery, more particularly described as being a portion of Section 14, Township 20 South, Range 53 East, M.D.B.&M., Block 2, Lot 25 of Calvada Unit APN # 3827113, and outlined on the maps attached hereto as Exhibits and shall hereafter be perpetually ma1nta1ned 1n the "natural" manner of the Southern Paiutes. 2. All persons, of whatever race, color, religion, or national origin, shall have full access and utilization of the said area described in Paragraph 1, so long as they agree to the maintenance of their graves in the "natural" manner established for that section.
