BILL NO. 2018-01 TOWN OF PAHRUMP ORDINANCE NO.68 SUMMARY: An ordinance amending Town of Pahrump Code Chapter 22 Taxation by amending Section 30, as it relates to the distribution of Room Taxes, and providing for the severability, constitutionality and effective date thereof; and other matters related thereto. TITLE: AN ORDINANCE AMENDING TOWN OF PAHRUMP CODE CHAPTER 22 TAXATION BY AMENDING SECTION 30, AS IT RELATES TO ROOM, TAXES, AND PROVIDING FOR THE SEVERABILITY, CONSTITUTIONALITY AND EFFECTIVE DATE THEREOF AND OTHER MATTERS RELATED THERETO. WHEREAS, the Town of Pabrump desires to reallocate room tax monies to fund economic and tourism interests of the Town; and WHEREAS, Pabrump Town Ordinance No. 68 concerns the imposition of room taxes within the Town of Pabrump; NOW, THEREFORE, the Board of Commissioners of the County of Nyc, State of Nevada, sitting as the governing authority of the Town of Pahrump hereby adopts, promulgates and orders compliance therewith the following: TOWN OF PAHRUMP CODE IS HEREBY AMENDED BY AMENDING CHAPTER 22, TAXATION; THERETO AS FOLLOWS: 22-30 Tax Proceeds All taxes collected by the country treasurer shall be deposited in a separate fund to be designated and known as the Room Tax Fund and shall be expended therefrom in the same manner as other claims against the town, for the following purposes only: of one percent of the amount collected shall be sent to the state as required by law in NRS 269.170 and amendments thereto; and of one percent of the amount collected shall be used to promote tourism in the town; and Two percent shall be designated for the fairgrounds; and One-half of one percent shall be designated for the Pabrump Parks and Recreation Board; and Page 1 ---PAGE BREAK--- One-half of one percent shall be designated for the Pahrump Arena Board; and Four percent shall be designated for the town to promote tourism; and One percent shall be designated for the municipal golf course owned by the Town of Pahrump. SEVERABILITY. If any provision of this ordinance or amendments thereto, or the application to any person, thing or circumstance is held to be invalid, such invalidity shall not affect the validity or provisions or applications ofthe ordinance or amendments thereto which can be given effect without the invalid provisions or applications, and to this end the provisions of this ordinance and amendments thereto are declared to be severable. CONSTITUTIONALITY. If any section, clause or phrase of this ordinance shall be declared unconstitutional by a court of competent jurisdiction, the remaining provisions of this ordinance shall continue in full force and effect. EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after passage, approval, and publication as required by law, to wit, from and after the 9th day of July, 2018.
