46th Circuit Court Default Holiday, School Break, and Summer Parenting Time Schedule Transportation: Transportation for parenting time in this schedule is to be shared equally with the receiving parent completing the transportation. Example: Parent A picks up the child at the start of their Easter holiday parenting time on Saturday at 6:00 p.m. and Parent B would pick up the child on Easter Sunday at 6:00 p.m. to start the parenting time for Parent B. The exception would be when the block of parenting time is less than three hours. The parent who is exercising the parenting time would transport both at the start and conclusion of the time. Example: Parent A picks up the child at 5:00 p.m. for Halloween and returns the child to Parent B three hours later at 8:00 p.m. Holiday parenting time: Holidays and school breaks will alternate yearly as reflected in this schedule. Holidays, including Mother’s Day, Father’s Day, and the child(ren)’s birthday take precedence over all other scheduled parenting time. If a holiday falls on a parent’s scheduled parenting time, the missed parenting time is not subject to a make-up time due to the holiday. Example: It is Parent A’s scheduled parenting time weekend, but it is Parent B’s Easter holiday. The allotted Easter holiday time for Parent B would take place rather than the Parent A’s full scheduled parenting time weekend. If the child’s birthday falls on another defined holiday designated for the other parent, the child’s birthday will be celebrated on the day prior to the defined holiday schedule. Example: Parent A has the Thanksgiving holiday and Parent B has the child’s birthday. Parent B would have the child the Tuesday before Thanksgiving. If additional traditional holidays are requested to be included in the ordered schedule, the matter will need to be addressed with the court to be incorporated into the parenting time order. The parenting time will commence at 6:00 p.m. the day school is scheduled to recess until 6:00 p.m. the day before school is scheduled to resume. *(Christmas Break (Holiday Winter Break): The holiday winter break will occur during the holiday school break of the school district where the child(ren) resides, even if the child is not of school age. The parenting time will commence 6:00 p.m. the scheduled day school is to recess for the holiday break until 6:00 p.m. the day before school is scheduled to resume. All exchanges within the break will be take place at 6:00 p.m. The school break will be an equal split of the allotted days of the break. The parent with the Christmas Eve holiday will enjoy the first half of the school break. If the Christmas Day holiday occurs during the first ½ of the school break, the holiday will take precedence following the holiday parenting time schedule. Summer School Vacation: The summer vacation parenting time will be determined by the school schedule for the district in which the child resides, even if the child is not of school age. The co-parent’s summer parenting time will commence at 6:00 p.m. the first Sunday following the school’s recess for summer. The co-parent will be entitled to seven weeks during the summer. The summer parenting time concludes 6:00 p.m. the Sunday one week prior to the start of the school year. The parenting time exchanges will occur on Sundays at 6:00 p.m. Summer Holidays take precedence over the summer parenting schedule. If an agreement cannot be reached on the seven week pattern of the parenting time, the pattern will begin with the co-parent having two consecutive weeks followed by the custodial parent having one week. This rotation continues until the co-parent has received the allocated weeks. (Example: 2-1-2-1-2- 1-1). The other parent may enjoy a mid-week visit the Wednesday of the second week from 5:00 p.m. to 7:00 p.m. Page 2 of 2 Revised 12 /15/22 ---PAGE BREAK--- 46th Circuit Court Default Standard Parenting Time Schedule Michigan law states that it is presumed to be in the best interests of a child to have a strong relationship with both parents, and the Court is required to order parenting time in a way that is calculated to promote this strong relationship. The court encourages parents to discuss parenting time plans that work best for their family circumstances. If parents are unable to agree on a schedule, the court may order this default standard parenting schedule. The 46th Circuit Default Standard Parenting Time Schedule applies when parents reside within a two hour driving time from each other’s residence. The schedule is defined for a custodial arrangement with the child(ren) residing with one parent primarily and the other parent enjoying co-parenting time with the child(ren). The 46th Circuit Holiday and Extended Parenting time schedule is to be included with this Default Standard Parenting Time Schedule. Holidays and extended parenting time as stated in that schedule takes precedence over the scheduled standard parenting time days. Transportation: Transportation for parenting time in this schedule will be shared equally with the receiving parent completing the transportation. Weekend Co-parenting Time: Co-parenting time will be alternating weekends from 6:00 p.m. Friday until 6:00 p.m. Sunday. Mid-week Co-parenting Time: Co-parenting time will be available for a mid-week visit every other Wednesday from 5:00 p.m. to 7:00 p.m. Communication: Both parents will communicate if the exchange time cannot timely be met. The co-parent will communicate to the other parent in the event the parenting time cannot be exercised. Telephone, Video, and electronic communications: Unless otherwise ordered, each parent may enjoy reasonable and appropriate telephone, video, text, and email communications with the child(ren) during extended periods of parenting time with the other parent. Vacations: When either parent takes the child(ren) on vacation away from that parent’s residence for longer than three days, the vacationing parent will provide notification to the other parent of where the child will be and the anticipated vacation dates. Support Guideline Overnight Offset for the Standard Parenting Time Schedule includes the Holiday, School Break, and Summer Parenting Time Schedule Overnights are based upon an average of two years due to alternating parenting time pattern. The court encourages parents to discuss parenting time plans that work best for their family circumstances. If parents are unable to agree on a schedule, the court may order this default standard parenting schedule. The 46th Circuit Default Long Distance Parenting Time Schedule applies when parents reside more than a two hour, but less than a five hour, drive time from each other. The schedule is defined for a custodial arrangement with the child(ren) residing with one parent primarily and the other parent enjoying co-parenting time with the child(ren). Contact the Friend of the Court office when the drive time is more than five hours, as a parenting time plan will need to be established by the court on an individual bases. This schedule provides for a holiday, extended school breaks, and summer parenting time that may differ from the 46th Circuit Court Default Holiday, School Break, and Summer Parenting Time Schedule. The parenting time will be based upon the school district where the child(ren) resides. Transportation: Transportation for parenting time in this schedule is to be shared equally with the receiving parent completing the transportation. School aged children only or school aged and preschool children together The parenting time will be based upon the school district where the child(ren) resides. Weekend Parenting Time: It is the intention that the co-parent will have one three overnight weekend per month during the school year. In the months with extended parenting time such as the Spring and Christmas breaks, and Thanksgiving holidays, the extended parenting time will be considered the three overnight weekends for that month. The three overnight weekend, whenever possible, should be when the child(ren) have a Friday or Monday off from school due to a school in-service day, holidays, etc. If there is a month in which there is no scheduled school day off on a Friday or Monday, the co-parent continues to be entitled to a three overnight visit. The co-parent is responsible for obtaining a copy of the child(ren)’s school calendar so arrangements for the weekend parenting time can be determined. The co-parent will communicate to the other parent a minimum of (60) days in advance of when the parenting time will occur. The beginning of the weekend parenting time exchanges will occur at 5:00 p.m. and the ending parenting time exchange will be at 3:00 p.m. when occurring on a day before school. The ending parenting time exchange is to be 5:00 p.m. when there is no school the following day. Spring Break: The co-parent will have the children for the school spring break every year. The parenting time will commence at 6:00 p.m. the day school is scheduled to recess until 3:00 p.m. the day before school is scheduled to resume. Page 1 of 3 ---PAGE BREAK--- Summer Break: The co-parent will have the child(ren) a total of weeks during the summer school break. The parenting time will occur in two week and one week blocks of time commencing at 5:00 p.m. the day school recesses for the summer school break. The summer parenting time is to conclude on the Sunday one full week before the new school year is to begin. All parenting time exchanges will take place at 5:00 p.m. Thanksgiving Break: The co-parent will have the child(ren) every Thanksgiving Holiday break beginning 5:00 p.m. the Wednesday before Thanksgiving to 3:00 p.m. the Sunday following Thanksgiving. Winter (Christmas) Break: The Winter (Christmas) school break will be equally shared by the parents with the co-parent having the child(ren) the first half of the school break every ODD year. The co-parent will have the child(ren) the second half of the school break every EVEN year. The exchange times will be 5:00 p.m. If the following day is a school day, the exchange time will be 3:00 p.m. Pre-school aged child(ren) only Parenting Time: If no child in the family is of school age, the co-parent will have seven consecutive overnights each month with the exchanges at 5:00 p.m. The co-parent will communicate to the other parent a minimum of (60) days in advance of when the parenting time will occur. The co-parents’ overnights are to be incorporated into the following designated holiday schedule. The co-parent will have the child(ren) every EVEN year for the following holidays. Easter, Fourth of July, Thanksgiving, and the child(ren)’s birthday. The co-parent will have the child(ren) every ODD year for the following holidays. Memorial Day, Labor Day, Halloween, and the Christmas holidays. Mother’s Day: The child(ren) will spend every Mother’s Day with Mother. Father’s Day: The child(ren) will spend every Father’s Day with Father. The following apply to the parenting time for both pre-school aged and school aged children Additional Holidays: If additional traditional holidays are requested to be ordered, the matter will need to be addressed with the court to be incorporated into the parenting time order. Transportation: Transportation for parenting time in this schedule is to be shared equally with the receiving parent completing the transportation. When the child(ren) are within 30 miles of the co-parent’s residence, the other parent will contact the co- parent to offer parenting time. Vacations: When either parent take the child(ren) on vacation away from that parent’s residence for longer than three days, the vacationing parent will provide notification to the other parent of where the child will be and the anticipated vacation dates.
