Otsego County, Michigan 1 Request for Proposal for Demolition and Disposal of Buildings and Debris on Various Foreclosed Properties Otsego County, Michigan BID 2020-08 SECTION I. INTRODUCTION Proposals for the demolition and disposal of buildings and miscellaneous debris various foreclosed properties will be received by Otsego County to the attention of Chris Churches in the Administration Office, 225 West Main Street, Suite 203, Gaylord, Michigan, 49735 until 10:00 a.m. local time on Thursday, October 1st, 2020. Bids will be publicly opened and read at 10:05 a.m. on Thursday, October 1st in Room 100 at 225 W. Main Street, Gaylord, MI. Any questions must be received by Monday, September 28th, 2020 at noon. The County reserves the right to accept, reject or negotiate any or all bids, to waive or not waive informalities or irregularities in bids or bidding procedures, to rebid the project/purchase, and to accept any bid determined by the County to be in the best interest of the County, regardless of price. The reason for rejection may include past performance issues, and compatibility with existing equipment or software. Vendors located in Otsego County are hereby granted a 5% cost variance for low bid determination. ---PAGE BREAK--- Otsego County, Michigan 2 SECTION II. INSTRUCTIONS, INFORMATION AND REQUIREMENTS 1. Purpose: The purpose of this Request for Proposal (RFP) is to receive proposals for selection of a contractor to provide demolition and disposal services for the following buildings and miscellaneous debris located in Otsego County: 1. Parcel # 011-820-000-020-00 located at 1908 John Street in Bagley Township. 2. Parcel # 072-310-000-076-00 located at 2887 Pine Grove St in Hayes Township. 3. Parcel # 080-030-200-030-00 located at 1531 N Townline Road in Livingston Township. (See Appendices A through C for photos and lead-based paint, mold, and asbestos survey results for each property). This RFP does not constitute a contract for services performed or to be performed. After selection of the successful firm (referred to as the contractor), Otsego County, and the contractor will negotiate a contract and a complete scope of services. All proposals submitted become the property of Otsego County and will not be returned. The County is not responsible for any costs incurred by the respondent in proposal preparation, presentations, site visits, or benchmarks performed. 2. Submittal of Proposals/Bids: Submittal of proposals/bids shall be on the form attached hereto in Section IV no later than noon on Thursday, October 1st, 2020. Proposals shall be sealed and clearly marked as BID 2020-08 on the outside, and sent to the following: Attn: Chris Churches 225 W. Insurance Requirements: Contractor shall furnish a Certificate of Insurance from an insurance company licensed to do business in the State of Michigan and acceptable to the County for the following: a. Workers Compensation and Employers’ Liability, Michigan Statutory Limits of Liability. b. Commercial General Liability Insurance. c. Motor Vehicle Liability Coverage, and Michigan No-Fault Coverages including all owned, non-owned, and hired vehicles. Otsego County will be named as Additional Insured on all insurance coverage, with the exception of Workers Compensation and Employers’ Liability insurance. Limits of Liability for General Liability, and Vehicle Liability shall be within the following guidelines based on contract amount: Projects up to $750,000: Minimum of $1,000,000 per occurrence and aggregate. Projects $750,001 to $1,750,000: Minimum of $2,000,000 per occurrence and aggregate. Projects $1,750,001 to $2,750,000: Minimum of $3,000,000 per occurrence and aggregate. The required amounts continue to escalate by adding $1,000,000 to the beginning and ending project range and to the minimum insurance requirement. A Waiver of Subrogation is required on the certificate of liability insurance. The certificate of liability insurance is required to have a 30-day notice of cancellation. 6. Bid and Performance Bonds: Bid bonds are required for construction or repair projects in the amount of $100,000 or more. Bid bonds and performance bonds are required for construction or repair projects in the amount of $250,000 or more. Bid bonds shall be in the amount of 10% of the total contract price. Performance bonds will be in the amount of 100% of the total contract price. Bond requirements cannot be waived. 7. Lien Waivers: For construction or repair projects in the amount of $50,000 or more, the contractor is required to provide partial lien waivers, verifying all subcontractors and suppliers have been paid for their work to date, for payment requests beyond 25% of the total contract price. The final 10% of the contract price can be paid prior to receipt of lien waivers. The contractor will provide final lien waivers within 30 days of contract completion. In the event that a contractor does not provide the required lien waivers, the contract will not be eligible for future County projects without the consent of the County Infrastructure Committee. ---PAGE BREAK--- Otsego County, Michigan 4 8. Licenses: The winning bidder hold any licenses necessary to work in the State of Michigan. 9. References: Bidder shall provide the names of three commercial accounts for similar work performed. References are also required for any subcontractors. 10. Evaluation and Award: Bids/proposals shall be evaluated and awarded by the County as soon as practicable. Award of the bid will be based on quality, service, completion date, experience and price. Information on each of these categories shall be included in bid responses. 11. Compliance with the Law: Contractor shall comply with all applicable federal, State and local laws and ordinances, rules and regulations, as well as any applicable County policies. 12. SCOPE OF SERVICE Furnish and provide all materials, supplies, tools, equipment, labor, supervision, and expertise to properly and professionally perform all required services described in this RFP. CONTRACTOR RESPONSIBILITIES The Contractor Responsibilities are below. (See Appendices A-C for photos and lead based paint, mold, and asbestos survey results for each property). General Information: Contractor must obtain any and all permits necessary to complete the work described herein. The cost of the permits should be included in the bid price. All work must be completed by December 15th, 2020. A mold, lead-based paint, and asbestos survey was conducted at each of the below properties. The survey results for each property are contained in Appendices A-C. The contractor shall be solely liable for the determination of needed abatement measures and proper disposal of materials generated from demolition. The contractor shall follow all relevant NESHAP, Michigan Department of EGLE, and MIOSHA requirements and protocols. Parcel # 011-820-000-020-00 located at 1908 John Street in Bagley Township: 1. Demolition/removal/disposal of main building and all outbuildings, including foundations, all building contents, utilities, miscellaneous concrete and asphalt, etc. following all relevant NESHAP, Michigan Department of EGLE, and MIOSHA requirements and protocols. 2. Backfilling all excavations with clean material (MDOT Class III or better) and providing a level finished ground. The site should be in appropriate condition for future construction. 3. Removal of all furniture, trash, scrap metal, concrete, debris, etc. encountered at the site. 4. Abandonment of all site utilities. Contacting MISS DIG will also be the responsibility of the contractor. 5. All erosion control measures including the placement of topsoil, seed and mulch following building removal and cleanup. 6. Proper containment and protection of the demolition site. Residential Home – 2887 Pine Grove Street – Hayes Twp. Residential Home & Outbuildings – 1531 North Townline Road – Livingston Twp. Gaylord, Otsego County, Michigan Sagasser & Associates, Inc. Project #82003 Dear Mr. Churches: Sagasser & Associates, Inc. has completed an asbestos survey & lead-based paint sampling at each of the three aforementioned foreclosed residential properties located in Otsego County, Michigan (Site). The purpose of the asbestos survey and sampling was to determine the presence and percentage of asbestos mineral fibers in the identified suspect asbestos containing materials (SACM) in the building prior to demolition. As per the National Emissions Standard for Hazardous Air Pollutants (NESHAP) regulations, 40 CFR; Part 61, Subpart M, prior to demolition or renovation of a building must be inspected for friable and non-friable ACM and the friable/potentially friable ACM must be removed to minimize the release of asbestos emissions during a demolition and/or renovation. The purpose of the lead-based paint (LBP) sampling was to determine if the paint contained concentrations of lead at levels above the regulatory criteria to provide for worker protection during renovation or demolition activities. The purpose of the mold survey was also to provide for worker protection. Authorization Authorization for performance of the asbestos survey and sampling was provided to Sagasser & Associates, Inc. by Ms. Rachael Frisch, Administrator of Otsego County (Client). Written authorization was given on August 25, 2020, through acceptance of Sagasser & Associates, Inc. Proposal# P82003, dated August 24, 2020, which detailed a proposed scope-of-work, estimated costs and conditions for completing survey and sampling. Scope of Work Sagasser & Associates, Inc. completed the sampling using the standard asbestos sampling protocol/techniques to minimize the creation of airborne fibers and standard sampling protocols for the collection of suspect samples. Lead-based paint samples were collected from large painted areas within one residential home. It should be noted that no significant areas of mold were observed during the site surveys. Sagasser & Associates, Inc. completed the following scope-of-work: Visually assessed the buildings on the three properties for suspect asbestos containing materials (SACM), LBP, and mold. Collected forty-six (46) bulk samples of the SACM which were submitted to SanAir Technologies Laboratory (SanAir) for analysis by EPA Method #600/R-16/116- Polarized Light Microscopy (PLM). ---PAGE BREAK--- Asbestos Survey & Lead-Based Paint & Mold Sampling Report Project #82003 2 Three Residential Properties – Otsego County, Michigan Collected four specific or composite paint samples from the various painted components of the residential home located on 5131 North Townline Road. Prepared a concise letter report detailing the results of the sampling and locations of the ACM, LBP and mold sampling results. Residential Home – 1908 John Street - Asbestos Survey & Sampling On August 27, 2020, Mr. Scot Egleston of Sagasser & Associates, Inc. completed an asbestos survey of the residential home and outbuildings for SACM. Each homogeneous SACM type was touched to determine its friability. The following building materials were identified as SACMs in the residential home: transite siding, two types of window glazing, 12”x12” floor tiles, 12”x12” ceiling tiles, drywall, two types of tar paper, roof shingles and sink undercoating. The transite siding and the two types of window glazing were determined to contain asbestos. The kitchen sink undercoating is presumed to contain asbestos. Residential Home – 2887 Pine Grove Street - Asbestos Survey & Sampling On August 27, 2020, Mr. Scot Egleston of Sagasser & Associates, Inc. completed an asbestos survey of the residential home for SACM. The shed building was locked and not accessible. No SACMs were readily observed on the exterior of the shed. Each homogeneous SACM type was touched to determine its friability. Residential Home & Outbuildings – 1531 North Townline Road - Asbestos Survey & Sampling On August 27, 2020, Mr. Scot Egleston of Sagasser & Associates, Inc. completed an asbestos survey of the residential home and outbuildings for SACM. It should be noted that a portion of the large outbuilding appears to be situated on a basement/crawl space with a small entry access. The basement/crawlspace represents a confined space and was not entered. Each homogeneous SACM type was touched to determine its friability. The following building materials were identified as SACMs in the residential home and outbuildings: transite siding, tar paper, window caulk, plaster, drywall, pipe wrap insulation, ceiling texture material, and roof shingles. Residential Home & Outbuildings – 1531 North Townline Road Asbestos Analytical Results The samples of the tar paper, roof shingles, drywall, and plaster (asbestos concentration below regulatory threshold of were determined not to contain asbestos. The samples of the transite panels in the outbuilding and pipe wrap insulation in the basement of the residential home were determined to contain asbestos. The square/linear footage of the ACM present in the buildings is as follows: Transite Panels – ~1,000 ft2 AirCell Pipe Wrap Insulation – ~25 linear feet* (*AirCell pipe wrap insulation estimated due to a skunk in the basement.) A copy of the laboratory analytical report is attached. Residential Home – 1531 North Townline Road - Lead-Based Paint Sampling Sagasser & Associates, Inc. completed the sampling of the various colors of paint on the building to determine if it contained lead above the regulatory limits. The burgundy paint was collected from the exterior, a composite sample collected from the family room/dining room, the bathroom, and northwest bedroom. Paint Sample Analytical Results The following details the paint sample lead analytical results: PS-1 – 109,300 parts per million (ppm) / 10.93% by weight – Burgundy / Exterior PS-2 – 466.7 ppm / 0.047% by weight – Composite / Dining Room-Family room PS-3 – <85.6 ppm / <0.009% by weight – Blue / Bathroom PS-4 – 6,406 ppm / 0.541% by weight – Beige / Northwest Bedroom The Housing & Urban Development (HUD) definition of lead-based paint is 0.5% by weight / 1.0 mg/cm2 / 5,000 ppm. Paint samples PS-1 & PS-4 were found to be above the HUD limit. Paint samples PS-2 & PS-3 were determined to be below the HUD limit for lead-based paint. A copy of the laboratory analytical report is attached. ---PAGE BREAK--- Asbestos Survey & Lead-Based Paint & Mold Sampling Report Project #82003 9 Three Residential Properties – Otsego County, Michigan Conclusions Sagasser & Associates, Inc. has completed an Asbestos, Lead-Based Paint & Mold Survey of three residential properties located at 1908 John Street, 2887 Pine Grove Street, and 1531 North Townline Road in Otsego County, Michigan. Approximately 950 ft2 of asbestos containing transite siding and approximately 2 ft2 of window glazing was identified in the residential home located at 1908 John Street. The limited areas of painted building components were identified and no paint sampling was conducted. Additionally, no areas of mold were observed in the building. In a demolition, cementatious ACM (a.ka. transite siding) cannot remain in a structure, as it is likely to become regulated in the demolition/handling process and must be removed prior to demolition. The window glazing is classified as a Category II non-friable ACM. No asbestos containing materials were identified in the residential home located at 2887 Pine Grove Street. No painted surfaces were identified. Only a small area of mold on drywall in the basement was observed. Approximately 1,000 ft2 of transite panels located in the outbuilding and ~25 linear feet of pipe wrap insulation is located in the basement of the residential home located on North Townline Road. In a demolition, cementatious ACM (a.ka. transite) cannot remain in a structure, as it is likely to become regulated in the demolition/handling process and must be removed prior to demolition. The pipe wrap insulation is friable and classified as a regulated asbestos-containing material (RACM) and must be removed prior to demolition. The exterior burgundy paint and beige paint located on/in the residential home located at 1531 North Townline Road was found to contain lead at concentrations above the HUD limit for lead-based paint. No significant areas of mold were observed in the residential home located at 1531 North Townline Road. The roof of the large outbuilding has been compromised and is open to the elements. The NESHAP agency overseeing the Site needs to be notified in writing of the intention to demolish 10 days prior to the demolition. Maps and sketches are provided for informational purposes and should not be considered surveys or engineering studies. No sampling of metal, wood, materials identified as fiberglass, rubber or foam insulation, or materials not typically identified as suspect asbestos containing was conducted. Additionally, no sampling of any electrical wiring/ components was conducted and should be presumed to contain asbestos, if identified. Sagasser & Associates, Inc. collected three samples when practical of each identified miscellaneous materials and instructed the laboratory to analyze each sample set to the first positive samples. Thereby, not all of the bulk samples collected and submitted for laboratory analysis were analyzed and Sagasser & Associates, Inc. makes no representation as to the asbestos content of untested samples. Samples were not collected from all painted surfaces in the building. The paint samples collected were from large painted areas which would represent the greatest exposure during demolition activities.
