1 Ogden Redevelopment Agency Work Session: April 4, 2017 PROPOSED AMENDMENT TO THE OGDEN RIVER BEND PHASE 1 DEVELOPMENT AGREEMENT – ADDITION OF CARPORTS PurposeofWorkSession: Review proposed amendment to the Ogden River Bend Phase 1 Development Agreement Planning CommissionRecommendation: Approval of the development agreement amendments (5-0) Executive Summary The developer of the Ogden River Bend Phase 1 project at 20th and Grant Avenue is requesting an amendment to the development agreement which would allow the installation of carports at certain locations within the internal parking area of the project. This type of site plan amendment would not normally be considered by the Redevelopment Agency (RDA) Board; however, because the original development was approved through a Mixed Use Zone Master Development Agreement (MUMDA) process which requires a development agreement and RDA approval of a site plan, any amendment to the development agreement must be approved by the RDA Board. Background The Ogden River Bend Phase 1 development consists of several multi- family apartment and townhome buildings. The project design has been guided by a document known as the River Bend Master Plan and Design Guidelines approved by the RDA Board in 2011. The River Bend master plan came from efforts by the City to master plan the area between 18th and 20th Streets between Washington Boulevard and Wall Avenue. The City has been actively working on and investing in this area for many years as it believes the proper development of this area will have significant positive impacts on the viability of the downtown area. The Ogden River Bend Phase 1 project was initially approved by the RDA Board in 2013 with the approval of a Land Transfer and Development Agreement (LTDA). As part of the LTDA, a Mixed Use Zone Master Development Agreement (MUMDA) was adopted in draft form with the final review to come before the Board for approval at a later date. The final approval of the Exhibits (Exhibit C-1) detailing the building design and elevations as well as the project site plan, came in September 2014. The construction of the Ogden River Bend Phase 1 project began shortly after the approval and has been progressing over the last couple of years. The RDA Board has reviewed and approved one other change to the development agreement and that was specific to changes to the previously approved architectural style of the townhomes to be developed on the north-facing block on the project area. This amendment was approved in February 2016. With most development in Ogden, neither the City Council nor the RDA Board reviews specific site plans and/or building elevations. This is largely due to the fact that site development is not a matter of creating or amending policy but rather a matter of the execution of existing policy in the form of zoning and subdivision ordinance. There are, however, limited exceptions to this general practice. These include certain projects either funded with RDA funds or developed in areas under RDA control, projects approved with a conditional overlay (CO) zone, and certain projects approved in the City’s Mixed Use (MU) zone. In this case, because the project is located in the MU zone and because the City and RDA owned property on which the development was to take place, the RDA Board, per the City’s MU zoning ordinance, was required to review and approve the Mixed Use Zone Master Development agreement, or MUMDA, for the project. The initial RDA Board approval of a development agreement under the MUMDA process requires amendments to be reviewed and approved by the RDA Board as well. Timeline 2002 The River Project Redevelopment Area Plan and Budget was adopted by the City Council. 2011 In 2011, the RDA Board approved the Ogden Bend Redevelopment Master Plan and Design Guidelines covering the area located between 18th Street and 20th Street and Washington Boulevard and Wall Avenue. The design guidelines were developed to guide redevelopment of the area and provided guidance on the location and mix of land uses, design ---PAGE BREAK--- 3 Ogden Redevelopment Agency Work Session: April 4, 2017 guidelines, architectural styles and details, and open space locations and design. May 28, 2013 The RDA Board approved Resolution 2013-10 authorizing a Land Transfer and Development Agreement (LTDA) with Ogden 20th Street, LLC. The LTDA included as an exhibit a draft of the Mixed Use Zone Master Development Agreement (MUMDA). Under the terms of the agreement, final MUMDA and Phase 1 site development plans were to be reviewed and approved by the RDA Board prior to construction. September 10, 2013 The RDA Board adopted Resolution 2013-16 authorizing the RDA Executive Director to execute the MUMDA subject to confirmation by the Ogden City Planning Department that Exhibit C-1, showing final site plan and architectural details for Phase 1, was consistent with the Board’s direction and approval. September 2, 2014 The RDA Board adopted Resolution 2014-13 approving amendments to Exhibit C-1 of the MUMDA showing final site plan and architectural details for Phase 1 of the development. The amendments were specific to buildings B and B-1 of the development plan. September 9, 2014 The City and the developer enter into the MUMDA agreement for the Ogden Bend Master Planned Community. The RDA Board authorized the RDA Executive Director to enter into the agreement with the developer with Resolution 2013-16; however, the agreement was not executed until after the details or Exhibit C-1 were finalized with the adoption of Resolution 2014-13. February 23, 2016 The RDA Board approved Resolution 2016-5 amending the MUMDA to change the architectural style of the townhomes within Phase 1. Proposal The proposed amendments to the development agreement are specific to the installation of carports in the internal parking area of Phase 1. There is resident parking around the perimeter that is currently uncovered and the developers would like to install carport canopies to ---PAGE BREAK--- 4 Ogden Redevelopment Agency Work Session: April 4, 2017 remedy this. The proposed carports would not cover all parking spaces in the parking area. After review and discussion with Planning Staff, Planning Staff recommended that the building lines of the project be used as a limit for the carports. In addition, there was discussion regarding the color. The developer and City staff agreed that the color should be more compatible with the color scheme of the project. There were several other minor design recommendations made by City staff that the developer has agreed to. Planning Commission Because the changes relate to a development project, and because the Planning Commission is required to provide a recommendation on projects approved through the MUMDA process, the Planning Commission reviewed this proposal at its March 1, 2017 meeting and forwarded a recommendation of approval to the Board with a vote of The recommendation was made with the finding that the proposed site and structure designs with the amendments are consistent with the development patterns and design schemes of phase 1. The recommendation of approval was made with the following conditions: 1. The post, beams, and purlins be a seagull grey color. 2. Remove the cover over three stalls where the cover extends beyond the building line. 3. Clip the ends of the beams and extend roof deck over purlins to create architectural character. Attachments 1.
