1 Ogden City Council Work Session: October 10, 2017 PROPOSED REZONE OF PROPERTY LOCATED AT 450 WEST 12TH STREET FROM M-1 TO C-3 To review the proposed rezone Approval of the rezone (7-0) A petition has been submitted by Winchester Land Company to rezone 17.5 acres of property located at 450 West 12th Street from M-1 (Limited Manufacturing) to C-3 (Regional Commercial). The petitioner is looking to acquire the land to develop multi-family dwelling units with commercial uses along 12th Street. Transmittal documents indicate that the owner of the property is supportive of the rezone. A petition has been filed by Winchester Land Company to rezone property located at approximately 450 West 12th Street. The petitioner is looking to acquire the 17.5 acres of property to develop a mixture of multi-family residential units and commercial sites. The petition requests the property be rezoned from the current M-1, Limited Manufacturing, to the C-3, Regional Commercial, zone. The property is not yet developed and is currently being used for agricultural purposes. The proposed rezone is consistent with elements of the 12th Street Corridor Plan, adopted in 2005, and the Lynn Community Plan, adopted in 1986. The proposed rezone is also consistent with a number of the policies included in the General Plan. These are discussed in more detail in the Planning Commission report included with this memo. It should be noted that the transmittal documents indicate that the owner is supportive of the rezone. A petition to rezone property may be filed by someone other than the owner of a property. State law requires that the owner be provided notice and an opportunity to speak to the petition at a properly noticed public hearing; however, best practices suggest that discussions with the owner prior to the public hearing are appropriate. ---PAGE BREAK--- 2 Ogden City Council Work Session: October 10, 2017 The current proposal is to rezone approximately 17.5 acres of property from the current M-1 zone to the C-3 (also shown as the CP-3) zone. The Planning Commission reviewed the petition at its September 6, 2017 meeting. The Commission forwarded a recommendation of approval to the Council with a 7-0 vote. The Commission’s recommendation was made with the finding that the request is consistent with the corridor plan and general plan. No comments were given at the Commission’s September 6, 2017 meeting. 1.
