1 Ogden Redevelopment Agency Meeting: July 11, 2017 ADAMS COMMUNITY REINVESTMENT AREA (CRA) - Designation of Survey Area – Twelve Block Area (Some Partial Blocks) 20th to 28th Streets and Washington Boulevard to Jefferson Avenue - Authorization to Create Draft Plan Action: Adopt or Not Adopt Resolution Executive Summary The Board will consider a Resolution authorizing the creation of the Adams Community Reinvestment Survey Area. The Area is proposed to cover sections of a twelve-block area from 20th to 28th Streets and Washington Boulevard to Jefferson Avenue. The Resolution also authorizes the Administration to conduct a feasibility study and prepare a draft plan and budget for the area. This is the first step in creating a new Community Reinvestment Area. Note that the Administration is not requesting the use of eminent domain for future development in the Adams CRA. Background April 5, 2016 The RDA Office received an Administrative Transmittal requesting that the Board designate a survey area for the Adams Urban Renewal Project Area and authorize a study to examine the extent of blight conditions within the survey area. May 3, 2016 The Board adopted Resolution 2016-11 designating the Adams Survey Area. Boundaries for Survey Area were established from 23rd to 28th Street and Washington Boulevard to Adams Avenue. The proposed Resolution also authorized the Administration to complete a blight study as required by state law and report the findings to the Board. May 24, 2016 The Board held a public hearing relating to a different project area--the proposed Oak Den Urban Renewal Area. After receiving input from ---PAGE BREAK--- 2 Ogden Redevelopment Agency Meeting: July 11, 2017 residents, the hearing was continued to allow time for several informational open houses to be held. CED staff worked diligently with the residents to provide accurate information regarding the Agency’s plans. Ultimately, the Administration determined it would helpful and appropriate to develop a public outreach process that went beyond the statutory requirements before pursuing redevelopment areas for the Oak Den or Adams areas. May - December 2016 The Administration developed the Community Investment Framework process to address communications and public outreach issues raised during the Oak Den process. The Administration also determined it would restart the Adams project area using the new Framework process. January 3, 2017 The Administration presented the Community Investment Framework (Framework), an administrative document that outlines an in-depth process for creating a new Community Reinvestment Area which includes public outreach and education. The goal of the Framework is to more fully communicate the intent of the Agency regarding any given proposed CRA. The Framework is also intended to build on the Quality Neighborhoods Initiative and will be used to communicate the Agency’s intent regarding the proposed redevelopment to affected residents as new redevelopment areas are proposed. January 25, 2017 The Administration held the first of two open houses to provide an opportunity for residents to give input on the proposed Adams CRA. March 9, 2017 The Administration held the second of two open houses to provide an opportunity for residents to give input on the proposed Adams CRA. ---PAGE BREAK--- 3 Ogden Redevelopment Agency Meeting: July 11, 2017 June 6, 2017 The Board Offices received an Administrative Transmittal requesting the Board approve a Resolution initiating the Adams Community Reinvestment Project Plan by designating a Survey Area, conducting a feasibility study, and creating a draft plan. The proposal was to create a survey area from 23rd to 28th Street and Washington Boulevard to Jefferson Avenue. June 13, 2017 The Board held a work session to review the proposed Adams CRA survey area with boundaries from 23rd to 28th Street and Washington Boulevard to Jefferson Avenue. June 20, 2017 The proposed Adams CRA survey area was on the Special RDA meeting agenda for Board consideration. Prior to the meeting, the Administration requested the item be pulled to allow for a change to the proposal. The Administration indicated they would be proposing a modification to the survey area. The new proposal would recommend a survey area from 20th to 28th Street and Washington Boulevard to Jefferson Avenue. Proposal The Administration is requesting that the Board adopt a Resolution designating the Adams Survey Area. Boundaries for the survey area are proposed to be are approximately 20th to 28th Street and Washington Boulevard to Jefferson Avenue. The proposed boundaries were originally from 23rd to 28th and Washington Boulevard to Jefferson Avenue. The proposed Resolution also authorizes and directs the Administration to complete further study to determine whether project area development is feasible and authorizes the creation of a draft project area plan. This action will begin the process of creating the Adams CRA. Input gleaned from the two open houses will be considered when identifying investment and development opportunities that would ---PAGE BREAK--- 4 Ogden Redevelopment Agency Meeting: July 11, 2017 support and sustain this critical area adjacent to the City’s central business district. This input will also be used to develop an appropriate project area plan. CS Note: The Administration is not anticipating the use of eminent domain in the Adams CRA and therefore the proposed Resolution does not authorize its use. Community Reinvestment Creation Process - Without Eminent Domain Authorization (Official Actions Highlighted) RDA 1) Adopt a resolution designating a survey area and authorizing creation of a project area plan and an examination, investigation or negotiation regarding project area. 2) Prepare a draft project area plan. 3) Planning Commission reviews for consistency with General Plan. 4) Set hearing on the draft project area plan. (Draft project area plan must be made available to the public at the Agency's offices during normal business hours for 30 days.) 5) Hold a public hearing on the draft project area plan. Allow public comment regarding whether the draft plan should be revised, approved, or rejected. 6) Adopt the plan by resolution after all appropriate changes have been made and submit to the legislative body for adoption. Resolution must include a. Agency’s purpose and intent regarding the project area; b. The project area plan; c. Findings and determinations that the plan i. serves a public purpose; ii. produces a public benefit; iii. is economically sound and feasible; iv. conforms to the General Plan; and v. promotes the public peace, health, safety and welfare of the community. ---PAGE BREAK--- 5 Ogden Redevelopment Agency Meeting: July 11, 2017 City Council Adopt the project area plan by ordinance and provide for a 30-day protest period. However, due to certain provisions within the Utah Community Reinvestment Agency Act (the “Act”), the Agency Board may not approve a project area plan more than one year after adoption of a survey area. Therefore, it has become necessary to begin a new process to initiate a new project area, beginning with the adoption a survey area. Due to recent changes to the Act, the project area that is proposed will be a Community Reinvestment Project Area The determination to pursue the proposed CRA stems from information received by Agency Staff during a series of public open houses held in early 2017. This dialog and input from local residents helped to identify and describe the different investment and development activities that will support and sustain this area as an attractive and vibrant place to live and work. The information received from residents has been summarized in an administrative working document named the Adams Investment Area Community Investment Framework and is kept on file for reference. The process to create a Community Reinvestment Project Area is as follows: ---PAGE BREAK--- 1. Agency adopts a resolution designating a survey area for further study to determine whether project area development is feasible and authorizing the Agency to prepare a draft project area plan 2. Staff prepares a draft Project Area Plan and Budget 3. Make the draft Project Area Plan and Budget available for public review 4. Provide notice of a public hearing to review the draft Plan and Budget 5. Hold a public hearing and in the hearing allow public comment and receive all written and hear all oral objections to the draft Plan and Budget 6. Revise, approve, or reject the Plan and Budget based on public comment 7. If approved, approval by Agency resolution 8. Submit the Plan to the City Council for adoption by ordinance 9. Within 30 days after City Council adoption, record the plan with the Weber County Recorder and transmit a copy to the: o County auditor, attorney, surveyor, and assessor o County Commission o Governing body of each taxing entity o State Tax Commission o State Board of Education 10. Within 30 days after City Council adoption, transmit a copy of the plan to the Automated Geographic Reference Center 11. All interlocal agreements that provide funds for the CRA will be conducted pursuant to Utah Code 17C-5-304. The attached resolution and associated map have been prepared for consideration of the Board regarding the designation of Adams Survey Area. Recommendation Taking in consideration of the information received from the local residents as found in the Framework document, the Administration recommends the Agency approve the attached resolution authorizing the establishment of the Adams Survey Area located approximately between 20th Street and 28th Street from Washington Boulevard to Jefferson Avenue. A RESOLUTION OF THE OGDEN CITY REDEVELOPMENT AGENCY AUTHORIZING THE ESTABLISHMENT OF A SURVEY AREA COMPRISED OF APPROXIMATELY THE LAND BOUNDED BY AND INCLUDING THE FOLLOWING STREETS – 20th STREET TO 28TH STREET FROM WASHINGTON BOULEVARD TO JEFFERSON AVENUE. WHEREAS, the Ogden City Redevelopment Agency (“Agency”) is a separate public body corporate and politic, duly and regularly created, established, organized and existing under and by virtue of the Constitution and laws of the State of Utah; and WHEREAS, the Agency operates and is authorized to transact business and exercise its powers under and pursuant to the Limited Purpose Local Government Entities – Community Reinvestment Agency Act, Title 17C, Utah Code Annotated 1953, as amended (the “Act”), previously known as the Utah Redevelopment Agencies Act; and WHEREAS, the area of land approximately between 20th Street and 28th Street from Washington Boulevard to Jefferson Avenue (“Land”), which is more fully illustrated in the Adams Survey Area map attached hereto as Exhibit A is comprised of neighborhoods and businesses that are vital to the sound growth of the municipality, the health and safety of its citizens, and the economic vitality of the downtown specifically and the larger community in general; and WHEREAS, the Agency, having implemented the Quality Neighborhood Initiative, which targets areas within the east central neighborhood due to their significant need for investment and revitalization, and having conducted numerous community outreach meetings to engage with local residents to receive information and input regarding the creation of an informal structuring document known as the Adams Investment Area Community Investment Framework, desires now to have the Land designated as a survey area and requires further study to determine whether one or more community reinvestment projects within the survey area are feasible as defined in Section 17C-5-103 of the Act. NOW, THEREFORE, it is hereby resolved by the Redevelopment Agency of Ogden City, Utah, as follows: Section 1. That the Land described herein and as illustrated in the Map is hereby designated a survey area, to be known as the Adams Survey Area; and Section 2. That the Agency and its personnel, severally and collectively, are hereby authorized to prepare a proposed community reinvestment project area plan for each proposed community reinvestment project area; and 2017-4 ---PAGE BREAK--- Section 3.
