Policy Title: Sale of Surplus Equipment Policy ID: IT-3 Origination Date: May 12, 2014 Update Date: May 12, 2014 IT3-1 Policy It is the policy of Ogden City IT to sell surplus electronic computer equipment according to City purchasing policy. IT3-2 Policy Purpose This policy suplements City Policy 1280 “Surplus and Obsolete Commodity Disposition for Personal Property” and describes I.T. internal procedures to facilitate the sale of obsolete equipment in a fair and equitable way. IT3-3 Evidence of Compliance The City will receive no complaints or accusations of unfair practices in the sale of surplus computer equipment. IT3-4 Policy Procedures 1. I.T. staff shall follow City policy 1280 “Surplus and Obsolete Commodity Disposition for Personal Property”. 2. I.T. shall receive from the Director of Management Services email approval to sell specific City surplus equipment prior to a sale taking place. 3. I.T. shall “scrub” the device of any City data and/or software following I.T. internal policy IT-2 “Electronic Data Removal from Devices”. 4. I.T. management shall determine a sale price for the equipment by averaging five sale amounts from a public action site (eBay, KSL, KUTV, etc.). The documentation shall be printed and attached to the sales contract. If five sale amounts are not available then an average of available amounts is used. 5. I.T. completes two “Surplus Computer, Equipment Purchase Agreement” contracts and secures the signatures of the Buyer and the Director of Management Services on each. The Buyer is given one contract and the other contract is filed with the City. 6. I.T. creates an invoice and provides it to the Buyer. 7. The Buyer pays the City Cashier and revenue is returned to the appropriate department. IT3-5 Enforcement: Any employee found to have violated this policy may be subject to disciplinary action up to and including termination of employment. ---PAGE BREAK--- SURPLUS COMPUTER EQUIPMENT PURCHASE AGREEMENT This Agreement is entered into between Ogden City Corporation, a Utah municipal corporation (“City”), and an employee of Ogden City. The purpose of this agreement is to memorialize the agreement of the parties with respect to the disposition of certain items of surplus computer equipment more particularly described as follows: WHEREAS, the useful life of such equipment has come to an end and the City has no further use for such equipment; WHEREAS, the equipment has a re-sale value that can be readily discernible by the purchasing agent (documentation attached); WHEREAS, the re-sale value of the equipment is negligible compared to the cost of sale by bid or at public auction; and WHEREAS, direct sale of the equipment to a City employee who desires to purchase this equipment is likely to bring the highest and best economic return to the City. NOW THEREFORE, the parties agree as follows: 1. City agrees to sell and employee agrees to purchase the above-described equipment for the following amount: 2. The equipment is sold as is, without warranty of any kind, including warranty as to the condition of the equipment.
