1 Ogden City Council Work Session: October 3, 2017 PROPOSED AMENDMENTS TO REGULATIONS REGARDING FRONT YARD PAVEMENT COVERAGE FOR SINGLE-FAMILY AND DUPLEX PROPERTIES To further review the proposed text amendment Approval of amendments to front yard parking standards (5-0) In conjunction with a petition to address front yard parking with regard to reasonable access to an abutter’s alley, the Planning Staff proposed amendments to front yard parking and coverage standards for all single- family and duplex properties. The amendments proposed by Planning Staff limit the coverage for driveway hardscape to no more than 50% of the front yard area and no wider than 50% of the lot or 32 feet, whichever is less. The amendments specific to the petitioner’s request have been separated from these amendments and will be addressed in a separate action by the Council. The Council requested further review of the amendments proposed by Planning Staff. These amendments will be reviewed during the Council’s October 3, 2017 work session. A petition has been filed by Ms. Anne Hagopian and Mr. Kevin Koons to clarify what constitutes reasonable access to an abutter’s alley with regard to expanding front yard parking. The petitioner’s request deals more specifically with the situation in which a property owner wishes to expand non-conforming front yard parking when reasonable access exists to an abutter’s alley to the rear of the subject property. The petitioner’s request would provide standards for when a property owner would be required to use the abutter’s alley for expanded parking versus being able to expand non-conforming parking within a front yard setback. In a separate but related amendment, Planning Staff proposed amendments to the City’s zoning ordinance regarding total parking coverage for front yards for single-family and duplex properties. The ---PAGE BREAK--- 2 Ogden City Council Work Session: October 3, 2017 amendments proposed by the Planning Staff originated from the discussions with the Planning Commission regarding the petitioner’s request but would not directly affect the petitioner’s situation. The amendments proposed by the Planning Staff were voted on separately by the Planning Commission but rolled into the ordinance containing the petitioner’s amendments when transmitted to the Council. As the Council reviewed all of the proposed amendments at the September 19, 2017 work session, concern was raised about the amendments proposed by Planning Staff. The Council felt comfortable with the changes included in the petitioner’s request but had further questions about the amendments proposed by Planning Staff. As a result of this, two ordinances were created: one with the petitioner’s amendments and one with the Planning Staff’s amendments. The ordinance containing the petitioner’s amendments will be processed separately and considered separately from the amendments proposed by Planning Staff. The ordinance containing the amendments proposed by Planning Staff will be reviewed by the Council during the Council’s October 3, 2017 work session. The current proposal is to amend the City’s zoning ordinance clarifying how much of a front yard may be covered by parking and hardscape. As proposed, for single-family and duplex lots in residential zones:  Driveways shall be a minimum of nine feet and a maximum of 32 feet (32’) or fifty percent whichever is less. The minimum width of 9 feet is a change from a ten feet minimum, but the maximums are not proposed to change.  Driveway widths may not have more than fifty percent (50%) of the front yard area covered by hard surface material. In addition to the amendments for single-family and duplex lots, Planning Staff is also proposing further amendments to the non- conforming front yard setback parking regulations. The proposal would limit the total width for non-conforming front yard parking to no more than 50% of the width of the home fronting the public street or twenty feet whichever is less. The proposal also includes a cut-off date of August 1, 2017 after which the amendments would apply. The Planning Commission reviewed the amendments at its July 5, 2017 meeting and forwarded a recommendation of approval to the Council. The Commission made its motion on the amendments proposed by Staff and voted to recommend approval with a vote of 5-0. The findings for the motion were that the amendments were consistent with the intent and purpose of the regulations of the zoning ordinance, and that the amended language provides better clarity in meeting the intent of the ordinance and that the amendments are consistent with the general plan.
