New city regulations permit residential vacation rentals in all residential zones under certain conditions. Like any land use there are requirements established to protect both owner and neighbor interests in this specific use. Understanding and following those requirements will benefit the entire community.  Obtain and maintain Residential Vacation Rental permit and rooming house business license.  Rental occupancy is limited to a total of two people per bedroom plus two additional people. * ( e.g. 3 bedroom house means a total of 8 occupants)  Have off street legal parking of a minimum of 2 spaces plus additional parking may be required if more than 4 bedrooms or if the owner occupant is home at the time of the rental.  There is a designated manager who can physically respond to complaints on site within 30 minutes.  Include in all advertisements city permit number, occupancy and parking limits, number of bedrooms and if pets allowed.  Passes inspection and rental meets egress window sizes and has interconnected smoke alarm system. *For larger homes the occupancy may be determined by net square living space. This would be determined at time of application. ---PAGE BREAK--- Owner occupants are not required to be in the home at the time of the vacation rental. Occupancy rules however vary depending if the home is occupied during the vacation rental by the owner or person related to the owner. 1. When the owner is not home The total number of people the home is rented to is based on the number of bedrooms or other area calculation. The occupants also need to meet the city definition of family. 2. When the owner is home When the owner is at home at the time of the rental the rental occupancy is limited to two adults with or without their minor children keeping in mind the maximum limits of two people per bedroom plus two. 3. Parking when owner is not home If the home has more than four sleeping rooms then parking needs to be provided at ½ stall per bedroom over four. 4. Parking when owner home The parking requirement is two stalls for the owner plus ½ space per sleeping room rented. 1. Can I rent out an apartment? An apartment can be rented out as a vacation rental in an R-2 or greater zone but will be subject to the one per lineal block rule of non-owner occupied. 2. If I have a duplex in an R-1 zone can I have a vacation rental out of one unit? No, only owner occupied dwellings are allowed in the R-1 zone. The duplex would need to be converted to one dwelling and the owner live in the dwelling. 3. Can there be a long term and a short term rental for the same dwelling unit in the same year In R-2 or greater zones the answer is yes with the following conditions: a. Each use needs to have a business license. b. Occupancy limits are less for long term rentals and cannot be mixed. c. In order to qualify for this provision, the owner must maintain the property requested for the vacation rental as the location of the owner’s primary residence. There is a two-step process required to verify primary residence under the City’s zoning regulations. Please complete the form and provide the requested information at the time of application for an owner occupied residential vacation rental license.
