THE PARK CENTER in Murray Center Rules and Regulations All rules and regulations contained herein or later adopted by management shall be considered a part of the membership agreement and shall govern the rights and obligations of each member & patron of the Park Center in Murray (“Center”). The Center or Murray City may amend the Rules and Regulations as necessary for the operation of the Center at any time. Proper Attire Members and guests shall wear clothing suitable to the applicable activity at all times while in the Center. Athletic footwear is required in the fitness & gym areas of the Center. Street shoes are not permitted on the pool decks. Tops/ shirts are required in all dry land areas. Modest authorized swim wear are required in pools. The Park Center is not responsible for damage to swim suits due to water treatment or extractor. Children under 3 or not toilet trained must wear a swim diaper with plastic pant and swimsuit to utilize the swimming pools. No food or glass on the pool decks or locker rooms. Acceptable Use of the Center Use of the Center is available to all members & patrons with the following guidelines: Children under the age 9 must be accompanied in the facility by a responsible adult age 18 years or older. Direct adult supervision is required in ALL the fitness areas of facility. Children under age 6 must be accompanied by an adult IN THE WATER while swimming. Patrons of the swimming pools must follow pool rules and direction given by lifeguard staff. o Game Tables. Play station games: Ages 9 years and older for members only (ages under 9 require direct adult supervision) o KidZone: Ages 6 months – 12 years old. Reservations required o Group Fitness Classes: Attendance in group fitness activities is available to patrons age 14 & older. Adherence to group fitness etiquette is required. o Weight room, track, and cardiovascular areas are available to patrons ages 14 & older. Youth ages 12-13 must be supervised by an adult and must be capable of using the equipment safely and follow etiquette rules of area. o Behavior: Courteous behavior is expected of all patrons and members at all times. Profanity, shouting, threats, harassment of any type, lewd or vulgar actions or any behavior that may offend other patrons or staff will not be tolerated. o Smoking, Drug & Alcohol Use is prohibited: The Center maintains a drug-free environment. The use of these items is prohibited by City Ordinance. o Solicitation on Center premises is prohibited. o SKATE BOARDING IS PROHIBITED around the Center and in the Park. Lockers are available for DAY USE only. Members should use their personal pad-lock to secure items in locker. Do not store valuables in lockers. Lockers are empty The Center shall not be responsible for lost property. The Center will retain unclaimed property for 30 days, after which the property will be donated to charity as required by City Ordinance. THE PARK CENTER IS NOT RESPONSIBLE FOR LOST OR STOLEN ITEMS Membership Identification Card Each member in good standing will be provided a membership ID card that must be presented to the front counter when entering the Center. All members must scan in to access the Center. Members not displaying a membership card will be required to sign in and manually check in. Membership and ID barcode # is exclusive to the person named on the membership ID card. Use by any person other than member will result in termination or suspension of membership privileges. Replacement Card A fee of $5.00 will be charged for replacement ID cards. Membership cards that are misused will be confiscated by the staff. Memberships are only for the person that it is issued to. Cards used by unauthorized person will result in loss of facility privileges for the member and main contact & turned over to the police as fraud. Membership & Programs Refunds Except as noted below, the Center does NOT offer membership or program refunds. The facility will be closed annually for maintenance. No extensions or adjustments to memberships will be made for this closure. The Park Center or the City does NOT offer extension, credits or refunds for situations beyond control. Cancellation / Suspension of Membership Request for membership cancellation must be in writing and must be received 30 days prior to requested cancellation date. Membership will only be cancelled without a cancellation fee upon review and approval in the following circumstances: 1. Medical Cancellation. If during the term of this membership agreement the member dies, becomes permanently disabled or unable to use the Center due to a medical condition, the Center may credit or refund the unused portion amount of the remaining membership contract or cease EFT / Payroll deductions. All medical cancellations must be accompanied by a physician’s / executor’s /legal statement. 2. Hardship/Relocation Cancellation. If during the term of the membership agreement, the member is transferred for work, is laid off, or terminated from employment and fulfilling the membership term represents an economic hardship, the Center may credit or refund the unused amount of the remaining membership contract or cease EFT or Payroll deductions. Proof of termination or relocation must accompany the request for cancellation. Divorce does not entitle a member to Hardship/Relocation Cancellation. Management shall have the discretion to determine if such a hardship exists. 3. Temporary Suspension. If a member will be temporarily unable to utilize the Center for a period of time in excess of 30 days, a written request to suspend the membership will be considered. A member requesting a Temporary Suspension of Membership will be required to pay a $25.00 processing fee. Memberships may only be temporarily suspended one time per contract period. Memberships are not transferable and may not be re-sold. Membership cancellation for reasons other than listed above requires approval from the Center Director. In addition, a cancellation fee will be Assessed. All outstanding dues, collection fees, bank fees or other costs associated with the membership will be due prior to membership cancellation. Requests for cancellation must be written and received 30 days prior to requested cancellation date. All outstanding amounts must be paid in full before cancellation can be processed. ALTERATION to existing memberships may require cancellation and re-purchase. Membership Fees Membership fees may be an ongoing obligation. Unpaid amounts will accrue until the membership terms have been met. Failure to pay this obligation will result in an unpaid debt and the City shall have the right to collect delinquent or unpaid dues, fees, interest and/or charges against the member, as well as reasonable collection fees, charges, costs and legal fees. Membership fees are due on the 1st or 15th of the for EFT withdrawals. Default may occur if payment is not received on or before the due date. A service fee of $20.00 will be assessed for returned or declined transactions. (2 declined transactions result in “cash only” status with City). See Murray City Municipal Code - Section 3.04.050. Memberships may not be modified, transferred or changed. Membership Qualifications Murray Resident rate The following information must be provided: Current Utility bill showing that you pay your utilities to Murray City (unless you live in the newly annexed area of Murray). Must live within the Murray City boundaries and/or own property in Murray which can be verified. Family membership Family means an adult(s) up to two adults and/or spouse with dependent children who live in the same residence, are legally related and claimed as dependents for Federal Income Tax purposes (Children up to age 24 who are attending college but live at home anytime during the year, qualify as family members). Foster children, foreign exchange students and other special situations will be determined on a case by case basis. DOCUMENTATION IS REQUIRED. Max of 2 adults per family membership. Provide a copy of Federal Income Tax claiming all those to be listed on the pass. Adult couple membership Two individuals, where one is 18 years of age to 59 years of age, living in the same household. No more than one adult couple membership per household. (Household means the related family members and all the unrelated people, if any such as lodgers, foster children, wards, or employees who share the same housing unit.) Senior couple membership Two individuals, where one is sixty (60) years of age or older, living in the same household. Under this section, only one senior couple membership per household is allowed. Murray Business/Corporation membership Must have regular employment with a licensed Murray City business. Proof of employment must be provided with one of the following types of documentation: 1. Written statement from employer verifying employment and Murray City Business License number. 2. Copy of pay stub within prior 30 day period. Membership options for additional immediate family members must meet the above criteria (see qualifications for family). Assumption of Liability & Release The Center, its employees, agents and the City shall not be liable for any damages arising from personal injuries sustained by any member in, on, or about the Center, or as a result of using the Center facilities, equipment or services. The Center shall not be liable for any loss or theft of personal property. Members assume full responsibility for any injuries, damages or losses which they may sustain in, on, or about the Center and fully and forever release and discharge the Center and all associated facilities, staff, City, employees and agents from all claims, demands, damages, rights of action, or causes of action present or future, whether the same be known or unknown, anticipated or unanticipated, resulting from or arising out of the member’s use or intended use of the facilities, equipment or services of the Center. Members are required to retain insurance coverage for any personal injuries to them personally or which they may cause to others. MEMBERS & PATRONS USE THE CENTER, ITS EQUIPMENT, FACILITIES, AND SERVICES AT THEIR OWN RISK. By signing this membership application I agree to receive e-mail and or text messages regarding The Park Center at the numbers l have listed on the front of the form. Group Fitness Terms, Conditions, Liability Release & Waiver I understand that my participation in Group Fitness activities is optional and it is my choice to enter the classes and activities at The Park Center. I am aware that there is a risk of injury in the participation of activities due to the inherent nature of the activities. Injuries include but are not limited to the following: sprains, fractures, heart attack, stroke, respiratory failure, neck, back, knee and ankle injuries and even death. I attest that I am in good physical condition and have had a recent physical examination by a physician prior to participating in this programming. I am aware that I am participating in this program and using the Center at my own risk.
