PERMANENT INGRESS/EGRESS EASEMENT CREACO INVESTMENTS, L.L.C., an Idaho limited liability company, GRANTOR. whose current address is 457 West Palouse River Drive, P.O. Box 9321, Moscow, Idaho 83843, owner of real property affected hereby, in consideration of one dollar and other valuable consideration in hand paid, does hereby grant the CITY OF MOSCOW, a municipal corporation of the State of Idaho, 206 East Third Street. Moscow, Idaho 83843, GRANTEE. and its agents and assigns, a non-exclusive permanent easement and right of-way in which to access water meters, including the right to enter upon, occupy and use property located in the City of Moscow, Latah County. Idaho, to wit: An easement consisting of all of that parcel of land described in Warranty Deed No.451502 on file with the Recorder's office of said Latah County, and situated in the NE Quarter of Section 19, Township 39 North, Range 5 West, Boise Meridian. Latah County, Idaho, as follows: Beginning at the Northwest corner of Lot 1 of Allen Tracts of Section 19, Township 39 North, Range 5, W.B.M.; thence South 72.5 feet, more or less, on the West boundary line of Lot 1 to a point; thence Southeast along the boundary line of Lot 1, 70 feet. more or less. to the middle of the creek intersecting the said West line; thence Northeasterly along the center line of the creek to its intersection of the North line of the Lot 1; thence West on the North line of Lot 1, 172 feet, more or less, to the POINT OF BEGINNING. ALSO, beginning at a point which is S. 87 degrees 08' W. 990.55 feet from the Northeast corner of Section 19, Township 39 North, Range 5, W.B.M.; thence S. 87 degrees 08' W. 157.45 feet along the section line; thence South 554 feet; thence N. 87 degrees 08' E. 157.45 feet to the TRUE POINT OF BEGINNING; thence North 100 feet; then N. 87 degrees 16' 27" E. 97.58 feet; thence S. 42 degrees 58' W. 143 feet to the TRUE POINT OF BEGINNING. ALSO Beginning at a point which is S. 87 degrees 08' W. 990.55 feet from the Northeast corner of Section 19, Township 39 North, Range 5, W.B.M.; thence S. 87 degrees 08' W. 157.45 feet along the section line; thence South 454 feet to the TRUE POINT OF BEGINNING; thence continue South 100 feet; thence N. 87 degrees 08' E. 157.45 feet; thence North 100 feet; thence S. 87 degrees 08' W. 157.45 feet to the TRUE POINT OF BEGINNING. ALSO Lot 2 of Allen Tracts to the City of Moscow, as shown by the recorded plat thereof. EXCEPTING THEREFROM Beginning at a point 171.3 feet North and 33.9 feet West of the Southeast comer of said Lot 2 of said Allen Tracts and running thence S. 89 degrees 47' W. 50.5 feet; thence S. 01 degrees 43' W. 26.6 feet; thence South 30 degrees 50' W. 23.63 feet; thence S. 89 degrees 42' W. 208.7 feet to a point on the West Boundary line of said Lot 2; thence North a distance of 448.7 feet on said West boundary line of Lot 2 to the Northwest corner of said Lot 2; thence in a Northeasterly direction on the North boundary line of said Lot 2 to a point 29.3 feet West of the Northeast corner of said Lot 2; thence S. 00 degrees 37' W. 454.3 feet to the POINT OF BEGINNING. GRANTOR, its successors and assigns, reserves the right to improve said easement area as long as such improvement shall not unreasonably interfere with the water meter access. GRANTOR agrees that it and its heirs or assigns will not build or place any new encroachment thereon which will unreasonably interfere with the right of the GRANTEE. The GRANTEE, its agents or transferees, shall have the right to perform any maintenance it may deem necessary or wish to exercise in connection with the aforesaid water meters (including, but not limited thereto, the right to make necessary repairs, alterations, and removals or replacement thereof). Upon exercising these rights, GRANTEE shall restore the property to its prior condition. GRANTEE is granted the aforementioned rights, together with the rights and privileges of ingress and egress to and from said property for the above stated purposes. It is expressly intended that the rights, burdens and restrictions contained in this Easement shall run with the land and shall forever bind GRANTOR AND GRANTEE, their heirs and assigns.
