ORDINANCE NO. 1365 AN ORDINANCE ANNEXING CERTAIN LANDS PARTICULARLY DESCRIBED IN SECTION 2 OF THIS ORDINANCE OF THE CITY OF MOSCOW, IDAHO; PROVIDING THAT THE CITY MAP AND THE COMPREHENSIVE PLAN OF THE CITY OF MOSCOW, IDAHO, BE AMENDED ACCORDINGLY AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF MOSCOW, IDAHO: WHEREAS, the land described in Section 2 of this Ordinance is land lying adjacent to the City of Moscow, Idaho; and whereas said land is in- tended and can reasonably be assumed to be used for the orderly development of the City of Moscow, Idaho; and whereas the owners of said land have re- quested in writing of the Council of the City of Moscow, Idaho, that said land be annexed to the City of Moscow, Idaho: SECTION 1. ANNEXATION. That the land described in Section 2 of this Ordinance be and the same hereby is annexed to the City of Moscow, Idaho, and that said land be and the same hereby is declared a part of the City of Moscow, Idaho. SECTION 2. DESCRIPTIONS. That the land annexed to and declared to be a part of the City of Moscow, Idaho, by this Ordinance is situated in Latah County, State of Idaho, and is more particularly described as follows, to- wit: Lots 1 thru 10 of Cosner's Subdivision of portions of Lots and of the Schumacher's Addition to Latah County, Idaho. And also: A tract of land lying in Lot and of Schumacher's Addition to Latah County, Idaho, and more particularly described as follows: Beginning at a point on the North line of Lot 11 of Cosner's Subdivision of Portions of Lots and of the Schumacher's Addition to Latah County, Idah o, and 316.55 feet S 89° 17' E of the Northwest corner of said Lot 11, and running thence South a distance of 136.5 feet, more or less, to a point of intersection with the North line of Lot 5 of said subdivision, said point of ---PAGE BREAK--- intersection being located 109.8 feet N 89° 20' W of the Northeast corner of said Lot 5; thence S 89° 20' E a distance of 234.7 feet along the North line of said Lot 5 and of Lot 7 of said subdivision to the Northeast corner of said Lot 7; thence North a distance of 17.54 feet to the Northwest corner of Lot 9 of said subdivision, thence S 89° 20' E a distance of 80 feet to the Southeast corner of said Lot 11; thence North a distance of 118(76 feet, more or less, along the East line of said Lot 11 to the Northeast corner of said Lot 11, thence N 89° 17' W a distance of 313.7 feet along the North line of said Lot 11 to the point of beginning. And also: A tract of land lying in Lot of Schumacher's Addition to Latah County, Idaho, and more particularly described as follows: Beginning at a point which is 435.68 feet South and 705 feet South 89° 20' East of the Northwest corner of Section 9, Township 39 N, Range 5 W Boise Meridian, said point being also the northeast corner of Lot 10 of the Cosner Addition; thence South 100 feet; thence S 89° 20' East 125.0 feet; thence North 100 feet; thence North 89° 201 West 125 feet to the point of beginning. And also: A tract of land lying in Lot of Schumacher's Addition to Latah County, Idaho, and more particularly described as follows: Beginning at a point which is 385.68 feet South and 710.0 feet S 89° 20' E of the Northwest corner of Section 9, Township 39 N Range 5 W Boise Meridian and going thence North 117.54 feet; thence S 89° 20' E 100.0 feet; thence South 117.54 feet; thence N 89° 20' W 100.0 feet, more or less, to the point of beginning. SECTION 3. The City Engineer of the City of Moscow, Idaho be and is hereby ordered and directed to make the necessary amendments to the Official Zoning Map and Comprehensive Plan of the City of Moscow, Idaho, which map and plan are on file at the City Hall at the City of Moscmv, Idaho, to provide that said area is to be henceforth a part of the City of Moscow, Idaho. SECTION 4. PUBLICATION. That this Ordinance shall be published in one issue of the official newspaper of the City of Moscow, Idaho. SECTION 5. EFFECTIVE DATE. That this Ordinance shall be effective from and after the date of its passage and approval and the publication thereof in the aforesaid official newspaper of the City of Moscow, Idaho.
