RESOLUTION NO. 90-08 A RESOLUTION OF THE CITY OF MOSCOW, A MUNICIPAL OF IDAHO, PROVIDING FOR THE ADOPTION OF ACQUISITIONS MAP FOR THE CITY OF MOSCOW. CORPORATION A FUTURE WHEREAS, the railroad corridors through the City of Moscow comprise an interrupted and relatively undeveloped open space that connects the major residential and retail business centers on the west, north, and east areas of the City with the University of Idaho and the downtown area; and WHEREAS, if corridor space becomes available for acquisition and public use through abandonment of rail uses, the City of Moscow will have a unique, irreplaceable opportunity to create a non-motorized path system and greenbelt; and WHEREAS, railroad corridor land located south of Idaho State Highway 8 (Pullman Highway) between the washington State line and Line street is essential to proposed widening of the highway to the south; and WHEREAS, Moscow City Council adopted Resolution No. 89- 10 in June, 1989, establishing policies relative to the acquisition and development of railroad corridor properties; and WHEREAS, mechanism for acquisition by Idaho Code Section 67-6517 provides a the designation of land proposed for future a public agency; NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MOSCOW AS FOLLOWS: 1. That the following lands, which are depicted on the attached Future Acquisitions Map, be designated for future acquisition by the City: All of the Union Pacific Railroad right of-way within the city of Moscow; Burlington Northern Railroad right-of way from the Washington State line on the west to a point east of Moscow in line with the east boundary of Ridgeview Estates subdivision; which is the easterly most boundary of Moscow's corporate limits; and north on the Estes Branch to Street; and the portion of the area currently occupied by structures and which is bounded by Sixth ---PAGE BREAK--- Street on the north, Burlington Northern Railroad right-of-way on the northeast, u.s. Highway 95 on the south, and a line 100 feet southwest of the centerline of Paradise Creek on the southwest. 2. That the Moscow Future Acquisitions Map, dated September 10, 1990, is hereby adopted as the City's Future Acquisition Map, pursuant to Idaho Code 67-6517. 3. That the City Clerk is hereby directed to send copies of this resolution to the Burlington Northern Railroad and the Union Pacific Railroad forthwith. The resolution provides that a copy of the resolution be sent by the City Clerk to the railroad companies. Attached is a copy of the addresses to which copies of the resolution should be sent.
