RESOLUTION NO. 2003-06 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOSCOW, OF LATAH COUNTY, IDAHO REGARDING FUNDS RECEIVED BY THE CITY FROM THE ESTATE OF BOBBY C. HAMILTON; DESCRIBING SOME OF THE POSSIBLE USES OF THESE FUNDS; AND PROVIDING FOR OTHER MATTERS PROPERLY RELATING THERETO CITY OF MOSCOW Latah County, Idaho BE IT RESOLVED by the City of Moscow, of Latah County, Idaho, (the "City"), that the City is a duly and properly fonned municipal corporation under and by virtue of the constitution and laws of the State of Idaho; WHEREAS, the City was the recipient of funds from the Estate of Bobby C. Hamilton ("Hamilton Funds"); WHEREAS, the Hamilton Funds are designated to be used by the Parks & Recreation D epartment of the City for the benefit of young people, as described in the Will of Bobby C. Hamilton; WHEREAS, the City wishes to identify some possible uses of the Hamilton Funds; NOW THEREFORE, BE IT FURTHER RESOLVED as follows: Section 1; Hamilton Funds. The City has deposited the Hamilton Funds into a fiduciary account labeled "Hamilton Funds", tor uses described in the Last Will & Testament of Bobby C. Hamilton. These moneys are held separate and apart from other accounts and funds of the City. The Hamilton Funds may be used as detennined by the appropriate officials of the City for the benefit of young people in the Moscow community, including to pay the costs of construction, operation, maintenance and debt service on the Certificates associated with the Hamilton Indoor Recreation Center. Section 2: Ratification. Any and all steps heretofore taken by the Council, City staff and agents working for the City relative to the Hamilton Funds are hereby ratitled and approved. Section 3: Severability. If any section, paragraph, clause, or provision of this Resolution shall be held to be invalid or unenforceable for any reason, the invalidity or unenforceability of each section, paragraph, clause, or provision shall in no manner aHect any remaining provision of this Resolution. - I - ---PAGE BREAK--- unenforceability of each section, paragraph, clause, or provision shall in no manner affect any remaining provision of this Resolution.
