516nOJ PERMANENT STORM WATER DRAIN EASEMENT IT ANI LAND COMPANY LIMITED LIABILITY COMPANY, a Washington limited liability company, whose current address is SW 1515 Wadleigh Drive, Pullman, Washington, 99163, GRANTOR, owner of real property affected hereby, in consideration of one dollar and other valuable consideration in hand paid, does hereby grant the CITY OF MOSCOW, a municipal corporation of the State of Idaho, 206 East Third Street, Moscow, Idaho 83843, GRANTEE, and its agents and assigns, a non-exclusive permanent easement and right-of-way in which to construct and maintain a storm water drain system and related public utilities including the right to enter upon, occupy and use property located in the City of Moscow, Latah County, Idaho, to wit: An easement located in the southwest quarter of Section 9, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho, and situated within that parcel of land described in the Quit Claim Deed recorded as Instrument No. 513742 with the Recorder's office of said County, with said easement shown on the attached EXHIBIT and being 10 feet each side of the following described centerline: Beginning at the northwest comer of Lot 14, Block 1 of Rolling Hills 51h Addition to the City of Moscow, recorded as Instrument No. 453418, records of Latah County; thence N70'55'29'W, 50.00 feet to a point on the westerly right-of-way line of Sixth Street; thence, leaving said right-of-way line, S69'47'01'W, 47.01 feet; thence N65'46'20'W, 62.63 feet; thence S66'41'10'W, 49.66 feet; thence North, 135.06 feet to a point on the westerly boundary of a Permanent Storm Water Detention Easement recorded as Instrument No.499923 with the Recorder's office of said Latah County, said point being the TRUE POINT OF BEGINNING of said easement centerline; Thence N45'22'32'W, 308.48 feet along said centerline to its terminus. for the purpose of constructing, operating, maintaining, and repairing or replacing said storm water drain system and related public utilities by the City of Moscow or its agents or contractors or franchised utility companies. GRANTOR, its successors and assigns, reserves the right to improve said easement area as long as such improvement shall not unreasonably interfere with the construction, operation, maintenance, repair and/or reconstruction of the storm water drain system and related public utilities. GRANTOR agrees that it and its heirs or assigns will not build or place any new encroachment thereon which will unreasonably interfere with the right of the GRANTEE. The GRANTEE, its agents or transferees, shall have the right to perform any maintenance it may deem necessary or wish to exercise in connection with the aforesaid storm water drain system and related public utilities (including, but not limited thereto, the right to make necessary repairs, alterations, and removals or replacement thereof). Upon exercising these rights, GRANTEE shall restore the property to its prior condition. GRANTEE is granted the aforementioned rights, together with the rights and privileges of ingress and egress to and from said property for the above stated purposes.
