RESOLUTION 2013 - 07 A RESOLUTION OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, AUTHORIZING THE DESIGNATION OF A 5.69 ACRE PROPERTY LEGALLY DESCRIBED HEREIN AND AS SHOWN ON EXHIBIT ATTACHED HERETO, AND INCORPORATED HEREIN BY THIS REFERENCE, AS AUTO-URBAN COMMERCIAL (AU-C) AND URBAN RESIDENTIAL (UR); PROVIDING THAT THIS RESOLUTION BE IN EFFECT UPON ITS PAS SAGE, APPROVAL, AND PUBLICATION ACCORDING TO LAW. WHEREAS, the subject property is currently designated as Auto-Urban Residential (AU-R) upon the City of Moscow Comprehensive Plan; and WHEREAS, the owner of the subject property has requested that the Auto-Urban Residential (AU-R) designation be amended to a combination of Auto-Urban Commercial (AU-C) and Urban Residential (UR); and WHEREAS, the Planning and Zoning Commission after conducting a duly noticed public hearing on May gth, 2013 and recommended approval of the proposed amendment to the Comprehensive Plan Land Use Designation with the condition that the UR designation be expanded in the northwest comer to coincide with the original parcel boundary of Lot 1, Block 7; and WHEREAS, the Moscow City Council conducted a public hearing on June 3rd, 2013 and passed a motion to approve the amendment from the AU-R designation to a combination of AU-C and UR; and NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Moscow, Idaho as follows: That the Comprehensive Plan Land Use Designation of the approximately 5.69 acres legally described below be amended to a combination of Auto-Urban Commercial (AU- C) and Urban Residential (UR) upon annexation into the City of Moscow, Idaho. LEGAL DESCRIPTION: UR Property A parcel of land legally described as Lot 1, Block 7 of Indian Hills 6th Addition to the City of Moscow, Latah County, Idaho. Excepting therefrom a parcel of land located in the SE ~ of the SE ~ of Section 17, T.39N., R.5W., B.M., Indian Hills 6th Addition to the City of Moscow, Block 5, Latah County, Idaho, more particularly described as follows: Beginning at the Northwest comer of Lot 21, Block 5 of said Indian Hills 6th Addition and the TRUE POINT OF BEGINNING; Resolution 2013-07 Page I of3 ---PAGE BREAK--- thence N 69°14'51" W 163.58 feet along the North boundary of said Indian Hills 6th Addition; thence S 00°07'50" W 272.34 feet to a point on the North Right·of-Way oflndian Hills Drive; thence N 89°52'38" E 183.62 feet said Right-of-Way to the Southwest comer of said Lot 21; thence N 00°07' 50" W feet along the westerly boundary of said Lot 21 to the TRUE POINT OF BEGINNING.
