ORIGINAL IDAHO PCBLIC SAFETY Al\D ll\FOR:VlATIOl\ SYSTEM MANACEMENT CONTROL ACREEMENT -IT STAFF Between NOl\-CRL\111\AL JUSTICE AGENCY of_M _ o_s c_ o_w _ _ and CRINIIl\AL JUSTICE AGENCY Moscow Police Department PURPOSE: This agreement is intended to establish the minimum required oversight of the CRIMINAL JUSTICE AGENCY over the NON-CRIMINAL JUSTICE AGENCY which provides personnel and support services to an agency with ILETS/NCIC access. SCOPE: The use of all computers, electronic switches, and manual terminals interfaced directly with the ILETS/NCIC computer must be under the oversight control of criminal justice agencies. This control includes, but is not limited to, the supervision of staff, equipment, systems design, programming, and the operation of the interface to ILETS/NCIC by the NON-CRIMINAL JUSTICE AGENCY * * * * * * Pursuant to the above Purpose and Scope of requirements established by the Idaho Law Enforcement Telecommunications System (!LETS) and the National Crime Information Center (NCIC). Federal Bureau of Investigation, the NON-CRIMINAL JUSTICE AGENCY and the CRIMINAL JUSTICE AGENCY agree to the following CRIMINAL JUSTICE AGENCY shall have direct management input into· a. The priority of service provided to CRIMINAL JUSTICE AGENCY by NON-CRIMINAL JUSTICE AGENCY. b. The standards for selection, supervision, assignment, and removal of personnel employed by NON-CRIMINAL JUSTICE AGENCY to manage, supervise, or operate the interface to the ILETS/NCIC computer c. Policy covering the selection, ma1ntenance. and separation of that portion of the equipment used by NON-CRIMINAL JUSTICE AGENCY to store, process, and transmit data to/from the ILETS:NCIC computer. 2 CRIMINAL JUSTICE AGENCY has the nght to imtiate administrative action leading to the transfer or removal of personnel authorized to have direct access to the i.ntertace when such personnel violate ILETS:NCIC operating or security rules or regulations 2007-37 REv ---PAGE BREAK--- 0 I NAL Management Cortroi Agreer:rent Page 2 3 NON-CRIMINAL JUSTICE AGENCY agrees that CRIMINAL JUSTICE AGENCY shall have the authority to perform the following: a. Conduct background screening on all personnel to be authorized to have direct access to criminal history record information or the ILETSINCIC interface consistent with IDAPA Rule 11.10.20.06 and reject for employment any such candidate that does not meet a standard consistent with the rules and regulations set by !LETS and NCIC. b. Audit, monitor, and inspect all operations of the NON-CRIMINAL JUSTICE AGENCY that are related to the operation of the interfaces to the ILETSINCIC computer. 4 NON-CRIMINAL JUSTICE AGENCY agrees to notify CRIMINAL JUSTICE AGENCY and !LETS of any change in personnel and/or services provided by the NON-CRIMINAL JUSTICE AGENCY to the CRIMINAL JUSTICE AGENCY. WE, THE UNDERSIGNED PARTIES, AGREE TO THE ABOVE PURPOSE, PRINCIPLES, AND STANDARDS OF MANAGEMENT CONTROL AND RESPONSIBILITY. 3.1
