) 504281 PERMANENT STORM SEWER EASEMENT d.d-6.l < JAMES H. ROBINSON, whose current address i& r.e. Box 9?36, Moscow, Idaho, 83843, GRANTOR, for value received, does hereby convey and dedicate unto the CITY OF MOSCOW, IDAHO, an Idaho municipal corporation, GRANTEE, 206 East Third Street, Moscow, Idaho 83843, and its agents and assigns, a non-exclusive permanent easement and right-of-way in which to construct and maintain a storm sewer, including the right to enter upon, occupy and use property located in the City of Moscow, Latah County, Idaho, to wit: An easement for storm drain purposes being ten feet (1 in width, lying in and across a parcel of land located in the NE1/4, of Section 7, T39N, R5W, BM, Latah County, Idaho, as shown on the attached "Exhibit with the centerline of said easement being more particularly described as follows: Beginning at the Northeast Corner of said Section 7, thence S 86°30' W, along the north line of said Section 7, 400.15 feet, (deed 394.57 feet), to a point on the former westerly right of way line of the Burlington Northern Railroad; thence S 10°06' W, 1335.92 feet, (deed 1334.41 feet), along the westerly right of way line of said railroad to a point of curve (railroad station 4578+94.9); thence along a curve to the left, with radius of 2342.01 feet, a distance of 341.24 feet and a chord bearing S 5°55'33" W, 340.94 feet, to the former northwest corner of the Robinson tract as described in Instrument No. 367643 as recorded at the Latah County Courthouse, Moscow, Idaho, thence along the former northerly line of said Robinson tract, S 88°14'54" E, 10.63 feet, to the point of intersection with the easterly right of way of Almon Street; thence along the northerly line of said Robinson tract, S 88°14'54"E, 5.00 feet to the True Point of Beginning of said easement centerline; Thence departing said northerly line, southerly 183.52 feet, parallel with said easterly right-of-way line of Almon Street, along a curve to the left, said curve having a central angle of 6°32'50", a radius of 1606.02 feet, and a chord bearing S 0°47'30" E, 183.42 feet; Thence N 88°43'11" E, 82.95 feet, to a point on the easterly line of said Robinson tract, and The End of this described easement centerline. For the purpose of constructing, operating, maintaining, and repairing or replacing said storm sewer by the City of Moscow or its agents or contractors or franchised utility companies. GRANTOR, his successors and assigns, reserves the right to improve said easement area as long as such improvement shall not unreasonably interfere with the construction, operation, maintenance, repair and/or reconstruction of the storm sewer. GRANTOR agrees that it and his heirs or assigns will not build or place any new encroachment thereon which will unreasonably interfere with the right of the GRANTEE. GRANTEE, its agents or transferees, shall have the right to perform any maintenance it may deem necessary or wish to exercise in connection with the aforesaid storm sewer (including, but not limited thereto, the right to make necessary repairs, alterations, and removals or replacement thereof). Upon exercising these rights, GRANTEE shall PERMANENT STORM SEWER EASEMENT PAGE 1 ---PAGE BREAK--- 504281 restore the property to its prior condition and shall compensate GRANTOR, his successors or assignees, for any damages suffered. GRANTEE is granted the aforementioned rights, together with the rights and privileges of ingress and egress to and from said property for the above stated purposes. It is expressly intended that the rights, burdens and restrictions contained in this Easement shall run with the land and shall forever bind GRANTOR AND GRANTEE, their heirs and assigns.
