PERMANENT PUBLIC EASEMENT KNOW ALL MEN BY THESE PRESENTS, that RUBECK RIDGE CONDOMINIUM ASSOCIATION, INC. (GRANTOR), owner of real property affected hereby, in consideration of one dollar and other valuable consideration in hand paid, does hereby grant the CITY OF MOSCOW, a municipal corporation of the State of Idaho, 206 East Third Street, Moscow, Idaho 83843, (GRANTEE), and its agents and assigns, a permanent easement and right-of-way, including the right to enter upon, occupy and use property located in the City of Moscow, Latah County, Idaho, to wit: A public easement consisting of a portion of Lot 4, Block 2, Baker Addition to the City of Moscow, the plat of said addition recorded in Book 6 of Plats, page 53, records of said Latah County, and located in the northwest quarter of the southwest quarter of Section 7, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho, with said portion shown on the attached Exhibit and being more particularly described as follows: Commencing at the northeast corner of said Lot 4; thence N59'56'29"W 27.88 feet along the northerly boundary of said Lot 4 to the northwest corner of a tract of land described in Quitclaim Deed No. 404982, on file with the Recorder's office of said County, said point being the TRUE POINT OF BEGINNING; thence continuing along said northerly boundary, N59'56'29"W 12.13 feet; thence leaving sa id boundary, S30'03'31"W 6.08 feet; thence S65"13'43"E 20.09 fee t; thence N30'03'31 "E 3.18 feet to a point on said tract desc ribed in Quitclaim Deed No. 404982; thence along said tract, 7.97 feet, along a curve to the left having a radius of 30.00 feet, a central angle of 15"12'42", and a chord of N52'20'18'W 7.94 feet to the TRUE POINT OF BEGINNING and the end of this description. Said easement contains 101 square feet, more or less. For the purpose of constructing, operating, maintaining, and replacing a public bus stop shelter by the City of Moscow or its agents or contractors. GRANTOR, its successors and assigns, reserves the right to improve said easement area as long as such improvement shall not unreasonably interfere with the construction, operation, maintenance, repair and/or reconstruction of the shelter. GRANTOR agrees that it and its agents or transferees will not build or place any new encroachment thereon which will unreasonably interfere with the right of GRANTEE. GRANTEE, its agents or transferees, shall have the right to perform any maintenance it may deem necessary or wish to exercise in connection with the aforesaid shelter (including, but not limited thereto, the right to make necessary repairs, alterations, and removals or replacement thereof. It is expressly intended that these burdens and restrictions shall run with the land and shall bind GRANTOR, its agents or transferees until said bus stop shelter site is no longer required by GRANTEE, at which point said shelter will be removed by GRANTEE and said easement area shall be retumed to it's prior condition.
