LEASE AGREEMENT THIS LEASE, entered into by and between the city of Moscow, a municipal corporation of the State of Idaho (hereinafter referred to as the "LESSEE") and Tidyman's, Inc., a corporation of the State of Washington, hereinafter referred to as "LESSOR"); WITNESSETH L PREMISES LEASED. Upon the terms and conditions hereof, the LESSOR has granted, and the LESSEE has accepted, the right to lease and use the following- described property: A portion of the parking lot, adequate for the collection, storage and transportation of household and small business generated waste, of the premises commonly known as Tidyman's, 1638 South Blaine Street, Moscow, Idaho. II. PURPOSE OF LEASE The above-described premises will be used on a short­ term basis for the collection, storage, and transportation of household and small business generated hazardous waste. III CONSIDERATION. As consideration for this Lease the LESSEE has paid the LESSOR the sum of One Dollar receipt of which is hereby acknowledged. IV. TERM. This Lease shall be for a term of three days, from and including April 25, 1997, up to and including April27, 1997. V. LESSEE ASSUMES RISK The LESSEE shall assume all risks incident to or in connection with the activity conducted hereunder and shall hold LESSOR harmless for any accidents or injuries of whatsoever nature or kind to persons or properties caused by the LESSEE'S activities at these premises. LESSOR assumes no responsibility whatsoever for any property placed on said premises and LESSOR is hereby expressly released and discharged from any liability for any loss, injury or LEASE AGREEMENT Page I 97-03 ---PAGE BREAK--- VL damage to persons or properties that may be sustained by reason of the occupancy under this Lease. CLEANUP OF PROPERTY Prior to expiration of this Lease, the LESSEE shall ensure that all waste and debris is removed from the property and that the property is returned to LESSOR in a condition which is as clean or cleaner than the date the property was occupied by the LESSEE. VII ASSIGNABILITY The LESSEE shall not assign this Lease nor sublet these premises. IN WITNESS WHEREOF, the LESSOR and the LESSEE, by and through its Mayor and City Clerk, have set their hands and seals to this Lease this 13th day of 1997. LEASE AGREEMENT By n· ­ Paul C.
