RESOLUTION 2005- 09 A RESOLUTION OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, AUTHORIZING THE AMENDMENT OF THE COMPREHENSIVE PLAN LAND USE MAP (COMPREHENSIVE PLAN, FIGURE 8) TO REDESIGNATE 66 ACRES GENERALLY LOCATED NORTH NORTHEAST OF THE PALOUSE MALL AND AS SHOWN ON EXHIBIT ATTACHED HERETO AND INCORPORATED HEREIN BY THIS REFERENCE FROM AGRICULTURAL AND HIGH DENSITY RESIDENTIAL (HR) TO EXTENSIVE COMMERCIAL (EC); PROVIDING THAT THIS RESOLUTION BE IN EFFECT UPON ITS PASSAGE, APPROVAL, AND PUBLICATION ACCORDING TO LAW. WHEREAS, undeveloped land designated for future commercial development is in demand due to the lack of availability of such land; and WHEREAS, the owner of the subject land has requested Comprehensive Plan Map Land Use Designation from Agricultural and High Density Residential (HR) to Extensive Commercial (EC) for future commercial development; and WHEREAS, the land proposed to be re-designated from Agricultural and High Density Residential (HR) to Extensive Commercial (EC) is found as being appropriate for such proposed designation; and WHEREAS, tbe subject land is adjacent to land currently designated as Extensive Commercial (EC) on its south side; and WHEREAS, the Planning and Zoning Commission after the conduct of a public hearing on May II, 2005 recommended approval of the subject Comprehensive Plan Map amendment; and WHEREAS, the Mayor and City Council held a public hearing on this matter on June 6, 2005 and passed a motion to re-open the public hearing on this proposed Comprehensive Plan Map amendment at a later date; and WHEREAS, the Mayor and City Council re-opened the public hearing on this matter on August 15, 2005 and passed a motion to approve this Resolution for Comprehensive Plan Map Land Use Designation amendment; and WHEREAS, Idaho Code Section 67-6509(d) requires that the governing board not consider Comprehensive Plan Map amendments more frequently than once every six months; and WHEREAS, the Mayor and City Council have not considered a Comprehensive Plan Map amendment within six months of their June 6, 2005 meeting. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Moscow, Idaho as follows: That the Comprehensive Plan Land Use Designation of the 66 acres generally described as being located north and northeast of the Palouse Mall and as shown on Exhibit attached hereto and incorporated herein by this reference be changed from Agriculture and High Density Residential (HR) to Extensive Commercial (EC) and that the Resolution 2005-09 August 15. 2005 Page I of2 ---PAGE BREAK--- Comprehensive Plan Land Use Map (Comprehensive Plan, Figure 8) of the Moscow Comprehensive Plan be so amended.
