ORDINANCE NO. 2001-24 AN ORDINANCE OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, PROVIDING THAT LANDS DESCRIBED IN SECTION I OF THIS ORDINANCE AND SHOWN ON EXHIBIT HERETO BE ANNEXED TO THE CITY OF MOSCOW; PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE BE DEEMED SEVERABLE; PROVIDING FOR THIS ORDINANCE TO BE IN FULL FORCE AND EFFECT FROM AND AFTER PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. WHEREAS, the Moscow Mayor and City Council adopted Resolution 2001-15 which established annexation standards and guidelines creating an annexation policy; and WHEREAS, lands described in Section I of this Ordinance and shown on Exhibit hereto are adjacent to and surrounded by the City of Moscow, Idaho; and WHEREAS, Idaho Code Section 50-222 authorizes city annexation of tracts of land adjacent to and surrounded by the City; and WHEREAS, the Moscow Mayor and City Council held a public meeting regarding this matter on July 2, 200 I; and WHEREAS, the Moscow Mayor and City Council held a public meeting regarding this matter on December 3, 2001; and WHEREAS, the Moscow Mayor and City have determined that annexation of lands described in Section I of this Ordinance and shown on Exhibit hereto as Parcel 2 is appropriate and is consistent with Council policy established in Resolution 2001-15; and NOW THEREFORE, be it ordained by the Mayor and Council of the City of Moscow as follows: SECTION 1: LEGAL DESCRIPTION: This Ordinance shall apply to the following described lands in Moscow, Latah County, Idaho, to-wit: Parcel2 A tract of land located in the southwest quarter of Section 5, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho and more particularly described as follows: Beginning at the southwest corner of said Section 5; thence S88°50'54"E 1366.27 feet along the south line of said Section 5; thence N00°40'59"E 486.17 feet to the northeast corner of Lot I , Block 5 of the Quail Run Addition to the City of Moscow, Latah County, Idaho as shown on the plat recorded as Instrument No.414835 on file with the recorder's office of Latah County, Idaho, and the TRUE POINT OF BEGINNING of this description; thence N87°46'38"W 124.75 feet along the north boundary of said Lot I, Block 5 to an angle point in the exterior boundary of said Quail Run Addition; thence Nl2°3l '30"W 514.00 feet along said exterior boundary to the southwest comer of Lot 6, Block 2 of said Quail Run Addition; thence S87°46'38"E 499.79 feet along said exterior boundary to the westerly ---PAGE BREAK--- right-of-way line of Polk Street, said right-of-way line being 25.00 feet distant of the centerline of said street; thence S l 2°3l '30"E 514.00 feet along said westerly right-of-way line to the northeast corner of the Gray tract described in Quit Claim Deed No.400134 on file with the recorder's office of said county; thence N8T46'38"W 375.04 feet along the north boundary of said Gray tract to the TRUE POINT OF BEGINNING. SECTION 2: ANNEXATION: The lands described in Section 1 of this Ordinance and shown on Exhibit hereto as Parcel 2 be and the same hereby are, annexed to the City of Moscow, Idaho and declared a part of the City of Moscow, Idaho; and the Moscow City Engineer is hereby ordered to make the necessary amendments to the official City limits map, zoning map, and Area of City Impact map for the City of Moscow, Idaho, which are on file at City Hall. SECTION 3: SEVERABILITY: Provisions of this Ordinance including every exhibit subpart of Section I of this Ordinance, shall be deemed severable and the invalidity of any provision of this Ordinance including any exhibit subpart of Section I of this Ordinance, shall not affect the validity of remaining provisions or subparts. SECTION 4: EFFECTIVE DATE: This Ordinance shall be effective upon its passage, approval and publication according to law.
