RESOLUTION 2004- 01 A RESOLUTION OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO; PROVIDING FOR THE APPROVAL OF AN AMENDED AREA OF CITY IMP ACT AGREEMENT WITH LATAH COUNTY ATTACHED HERETO AS EXHIBIT AND IN CORPORA TED HEREIN BY THIS REFERENCE; AUTHORIZING THE MAYOR'S SIGNATURE THEREON; PROVIDING THAT THIS RESOLUTION BE IN EFFECT UPON ITS PASSAGE, APPROVAL, AND PUBLICATION ACCORDING TO LAW. WHEREAS, the Local Land Use Planning Act of 1975 as enacted by the Idaho Legislature requires adoption of an Area of City Impact around each city; and WHEREAS, Latah County and the City of Moscow have had an Area of City Impact agreement since 1993; and WHEREAS, the City of Moscow and Latah County have agreed to renegotiate the terms of the Af,>reement and Map of the Area; and WHEREAS, the renegotiated Agreement is deemed to be in the publie interest in that it addresses issues raised by Area of City Impact residents, as well as elected and appointed City and County officials; and WHEREAS, the Planning and Zoning Commission of the City of Moscow conducted a public hearing on this matter on December 10, 2003 and passed a motion recommending approval of the proposed Agreement; and WHEREAS, the Mayor and City Council of the City of Moscow held a public hearing on this matter on January 5, 2004 and passed a motion to approve the proposed agreement. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Mayor and Council of the City of Moscow, Idaho as follows: That the Agreement set forth in Exhibit attached hereto and made a part hereof by this reference, is hereby approved by the City Council and the Mayor is hereby authorized to sign said agreement.
